Jito Labs and two of its executives will be removed “without bias” from Burwick Law’s Pump Fun lawsuit after reaching an agreement with the plaintiff following a leak of 5,000 chat logs.
Berwick and Wolf Popper, a law firm representing plaintiffs Diego Aguilar, Kendall Carnahan and Michael Okafor, passed on Friday their allegations against Jeet Lab, Jeet Foundation, CEO, COO Lucas Bruder and Brian Smith to Judge Colleen McMahon.
The letter does not address the reasons why the plaintiffs and the JITO Institute reached the agreement, and Judge McMahon has not yet approved the order.
However, last week, a request to issue a second amendment lawsuit filed by an attorney said the defendant had said, “narrow the case even further. ”
Whistleblower shares chat logs between Solana and Pump fun
The request asks for more time to make corrections after whistleblowers provide 5,000 chat logs to Berwick and Wolf Popper and 5,000 chat logs showing Solana Lab and Pump fun.
This evidence suggests that Solana Labs engineers are “direct contact” with Pump Fun personnel, perhaps as they discuss and provide advice on “major components involved in suspected companies,” such as “token program behavior, verification equipment/priority inclusion pathways, or firing flow mechanics.”

Burwick and Wolf Popper argued that “these communications are in the Southern District of New York, taking into account the existence of Solana Labs’ New York, and these communications are responsible for the venue and jurisdiction of the operation and management of suspected assault companies, scheduled allegations, and supervision.”

Jito CEO did not technically file a lawsuit
Jito Labs, Jito Foundation, Bruder, and Smith were added to their first amended lawsuit in July, but Bruder, Smith, and the foundation avoided being offered.
The lawsuit accused Jito Labs of helping Pump Fun provide infrastructure for suspected illegal casino companies and accusing the implementation of MEV tools and validators of being “necessary to expand operations.”
The remaining defendants still facing claims from the plaintiff include Pump Fun (named Baton Corporation), as well as its executives Alon Cohen, Noah Bernhard Hugo Tweedale and Dylan Kerler.
Co-founders of Solana Foundation, Solana Labs, CEO Anatoly Yakovenko and Raj Gokal, President Lily Liu is still facing lawsuits.
