Roman Storm’s legal team and US prosecutors have agreed to extend the procedural deadline that could affect the retry of tornado cash co-founders involving a conspiracy to violate money laundering and sanctions.
Filed Monday in the US District Court for the Southern District of New York (SDNY), Judge Catherine Faila approved a schedule agreed by Storm’s lawyers and the US government, promoting the start of a potential retrial.
Prosecutors did not suggest whether they intend to reclaim the storm on two felony charges, but could be scheduled for later in 2025, past the 70-day deadline following “the conclusion of the first trial.”
“The court has found that by excluding the time until December 18, 2025, an end to justice is provided, and that a prompt retrial will outweigh the interests of the people and the defendant if defense times can be considered and prepared for post-trial moves,” Fila said.

On August 6th, the ju judge discovered that he had committed a one-count conspiracy crime to run an unlicensed money business related to his role in Tornado Cash. The judges were unable to reach a decision on the remaining charges a few days after deliberation.
Storm is expected to be sentenced to a single count soon, but as of Tuesday, there is no scheduled hearing.

Tornado cash developers are still under scrutiny
Storm was charged in the US in August 2023 for money laundering, conspiracy to operate a license-exempt money transmitter, and conspiracy to violate US sanctions. He pleaded not guilty and has been released on bail since his arrest.
Two other Tornado Cash co-founders Alexey Pertsey and Roman Semenov are at legal risk just like Storm.
Semenov was charged with SDNY along with Storm, but remained in general at the time of publication. Petzev was found guilty of money laundering in the Netherlands in 2024 and sentenced to more than five years in prison. He is appealing for the decision.
