The New York Department of Financial Services (NYDFS) has imposed a $48.5 million penalty on Paxos as part of its enforcement action against the stablecoin issuer, according to an Aug. 7 announcement.

The settlement includes a $26.5 million civil monetary fine and mandates Paxos to spend an additional $22 million over three years to strengthen its compliance systems.

According to the financial regulator, this development follows a wide-ranging investigation into Paxos’ compliance failures related to anti-money laundering (AML) and customer due diligence procedures.

Paxos’ relationship with Binance attracts scrutiny

The enforcement action centered on Paxos’ relationship with Binance, the largest crypto exchange by trading volume.

According to the financial regulator, Paxos began issuing the Binance USD (BUSD) stablecoin in collaboration with the exchange.

However, it failed to perform adequate due diligence on the trading platform, violating the terms of a 2020 agreement with the NYDFS.

This lack of oversight came to light during a review of Binance transactions conducted between 2017 and 2022. The review found that $1.6 billion worth of transactions were linked to illicit actors or entities sanctioned by the US Office of Foreign Assets Control (OFAC).

As a result, the NYDFS ordered Paxos to halt the issuance of BUSD in February 2023. This directive effectively ended Paxos’ partnership with Binance and led to the gradual phase-out of BUSD from the market.

Apart from the Binance issues, the NYDFS also highlighted broader systemic issues within Paxos’s compliance program.

These include weak Know-Your-Customer (KYC) protocols and delayed responses to law enforcement inquiries. Additionally, outdated, manual transaction monitoring systems failed to detect coordinated suspicious activity and clear money laundering patterns.

The investigation further noted that Paxos lacked internal policies to determine when to initiate investigations after receiving a law enforcement request. This oversight limited the firm’s ability to identify and respond to high-risk behavior in a timely manner.

New York’s crypto enforcement trend

The action is part of a broader trend in New York’s regulatory approach to the crypto industry.

Over the years, the NYDFS has taken enforcement actions against firms including Robinhood, Block Inc. (operator of Cash App), and the now-bankrupt Genesis.

Commenting on these enforcement actions, Superintendent Adrienne Harris reaffirmed the agency’s commitment to safeguarding financial markets and consumers.

She said:

“The Department of Financial Services has led the nation in regulating the virtual currency industry, protecting consumers and markets through examinations, supervision, and where necessary, enforcement.”

Letitia James, Attorney General of New York, is asking Congress to make changes to two proposed laws focused on stablecoins.

In a letter sent on July 1, she said the current versions of the STABLE Act and the GENIUS Act are not strong enough to protect people who use or invest in these digital assets.

James said the bills need clearer rules to stop anonymous transactions. She warned that, without proper checks, stablecoins could be used for illegal activity such as fraud or money laundering.

One of her suggestions is that stablecoin holders get the same kind of insurance protection that banks offer through the Federal Deposit Insurance Corporation (FDIC). This would help protect users if the company behind a stablecoin were to go out of business.

James also recommended that companies behind stablecoins should follow the same rules as banks. Since these companies hold people’s money and promise to keep its value steady, James noted that they should be treated like financial institutions.

This would include meeting certain standards to prevent harm if any of them fail.

Rathod is reported to have used this method while operating several business bank accounts to receive and move the stolen money.

Seven bank accounts across six different banks were used. Records indicated that around $1.2 million was converted into Bitcoin and sent to unknown addresses.

At least three of the banks warned Rathod that the deposits looked suspicious. In response, he provided an invoice to explain the money, but it turned out to be fake. One bank showed this invoice to a victim, who confirmed it was not real.

The FBI also said Rathod allegedly involved his girlfriend and family members by transferring funds through their accounts. Over $1 million passed through their hands, though Citibank was able to recover $800,000 of that amount.

Rathod faces several charges, including wire fraud and money laundering. If convicted, he could spend up to 20 years in prison.

On June 18, authorities in New York stopped a crypto-related scam that targeted Russian-speaking users through fake online ads.

The scam involved misleading advertisements placed on platforms like Facebook. These ads directed users to a fake cryptocurrency investment site that falsely claimed to be licensed in New York.

Most of the ads were in Russian and promoted high returns to attract people from the Russian community. Once users visited the site and sent in money, they received little or no follow-up.

The scam mainly affected people in Brooklyn, where more than 300 victims have been identified. Losses in that area alone have topped $1 million.

Amazon has announced it now has permission to use content from The New York Times across its artificial intelligence (AI) systems, including Alexa.

The partnership, announced on May 29, gives the tech giant access to articles, cooking instructions, and sports updates from The Times, The Athletic, and NYT Cooking.

Alexa users might hear cooking steps read aloud or get updates on live games. The content will also help Amazon improve its AI systems’ ability to understand and respond to language.

However, neither company shared any details about the amount of money involved or the duration of the deal.

A second man tied to a recent crypto-related kidnapping in New York is expected to turn himself in, according to ABC7 New York’s report on May 26.

He is believed to be a Swiss crypto investor who worked closely with John Woeltz, the main suspect in the case.

The suspect’s name has not been publicly shared, but he is reportedly a co-founder of a trading company based in Switzerland. While a report from NBC says he plans to report to police within the week, FOX5 New York suggests he might already be in custody.

The case centers around Michael Valentino Teofrasto Carturan, a 28-year-old from Italy, who said he was kidnapped in a SoHo apartment for over two weeks.

According to the police, Carturan was allegedly tortured and pressured to hand over the recovery phrase to his cryptocurrency wallet. His estimated net worth is around $30 million.

Carturan told officers that he arrived in New York on May 6 to meet business partners. He said his passport was taken, and he was beaten until he agreed to share his crypto access details.

He told his captors he needed to retrieve the recovery phrase from a laptop in another room. As he walked away to get it, he saw an opportunity to run. That escape led to the arrests and helped police connect Woeltz to his Swiss business partner.
