Federal authorities are challenging the outcome of a sentencing decision involving two Estonian citizens who admitted to running a large-scale crypto mining scam.

The appeal, submitted to the Ninth Circuit Court of Appeals, disputes both the judge’s final order and the process that led to it.

Estonians Sergei Potapenko and Ivan Turõgin had previously admitted to organizing a fraudulent crypto operation that raised over half a billion dollars. The scam sold fake mining contracts under the HashFlare brand between 2015 and 2019.

According to the investigation, the two displayed false profit data to users via online dashboards, despite not having the mining equipment they had advertised.

In February, both men pleaded guilty to conspiracy charges related to this activity. Prosecutors argued that they tricked around 440,000 individuals across the world and requested prison terms of 10 years for each of them.

However, on August 12, Judge Robert S. Lasnik issued “time served”, along with three years of supervised release and fines of $25,000 each.

The judge explained that the court had taken into account the possibility of transferring the sentence to Estonia, where both defendants would serve their time.

He noted that if the transfer request was denied, the two might end up with longer sentences and be held in immigration custody indefinitely after serving time in the US.

On August 22, Anton and James Peraire-Bueno asked a Manhattan court to stop prosecutors from using their Google search activity in an upcoming trial. Why? Read the full story.

A former manager at a Chinese tech company has been sentenced to over 14 years in prison for stealing company funds and hiding them through cryptocurrency.

According to South China Morning Post’s report on July 29, the Beijing court found that the man, known by the surname Feng, took 140 million yuan (around $19.5 million) while overseeing reward payments at a short video platform.

Prosecutors explained that Feng worked with outside contractors to submit fake claims. The company’s money was then sent to accounts he controlled. From there, the funds were turned into Bitcoin and other digital currencies using eight foreign trading platforms.

To hide where the money came from, Feng and his partners used crypto mixing tools. However, the authorities were able to follow the money. They recovered over 90 Bitcoin, worth nearly $11 million.

The investigation used digital tracking methods to uncover the full scheme. Prosecutors said they followed the movement of money from the time it was stolen to when it was exchanged and moved abroad. They were also able to connect those exchanges back to Chinese bank accounts.

Prosecutor Li Tao described the case as an example of low-level employees being involved in serious fraud, using crypto to move the money, and companies not having strong enough controls to stop it.

Trump’s DOJ asks for a one-day sentence in Breonna Taylor raid conviction https://earlybirdsinvest.com/trumps-doj-asks-for-a-one-day-sentence-in-breonna-taylor-raid-conviction/ https://earlybirdsinvest.com/trumps-doj-asks-for-a-one-day-sentence-in-breonna-taylor-raid-conviction/#respond Fri, 18 Jul 2025 08:56:40 +0000 https://earlybirdsinvest.com/trumps-doj-asks-for-a-one-day-sentence-in-breonna-taylor-raid-conviction/

This story appeared in The Logoff, a daily newsletter that helps you stay informed about the Trump administration without letting political news take over your life. Subscribe here.

Welcome to The Logoff: In a major reversal from the Biden administration, the Justice Department is asking for a token one-day prison sentence for an ex-police officer who fired shots into Breonna Taylor’s home during a fatal raid in March 2020.

Why is this in the news now? Brett Hankison, a former Louisville, Kentucky, officer, is set to be sentenced next week after being convicted last year of violating Taylor’s civil rights. He could face a maximum sentence of up to life in prison — but under the DOJ request, would ultimately serve no time.

What did Hankison do? Hankison was one of multiple officers to execute a raid on Taylor’s apartment in March 2020. He blindly fired 10 shots into her apartment through a covered window and door, some of which entered an occupied adjoining apartment. None of the bullets Hankison fired ultimately struck a person, but Taylor was shot and killed by another Louisville police officer.

What does the DOJ request mean for Hankison? If the judge — a Trump appointee — adheres to the DOJ sentencing memo, Hankison will never return to jail for his conviction. The memo requests that he receive credit for time already served, rendering even the single-day sentence irrelevant. It also calls for three years of supervised release and a meager fine as part of the sentence.

Why does this matter? Breonna Taylor’s death was one of several high-profile police killings in early 2020 that led to widespread racial justice protests following the murder of George Floyd that May. Since then, strides — though often halting and imperfect — have been made toward police accountability and addressing racial discrimination in policing. The DOJ sentencing memo is the latest sign of the Trump administration’s complete lack of interest in those efforts and preference to roll the clock back to an earlier era.

And with that, it’s time to log off…

Today, I wanted to highlight this podcast by my colleague Sean Illing, about the idea of “hopeful pessimism.” Sean talks with Mara van der Lugt about what the term means and how to sustain hope when you’re feeling pessimistic. As she puts it, hope can be “oriented not on certainty or expectation, but rather on the openness of the future” and a commitment to our values. It’s a fascinating, lovely discussion that’s really worth your time — I hope you take a moment to listen.

30-Year Sentence for Funding ISIS with $185,000 in Crypto, Says DOJ https://earlybirdsinvest.com/30-year-sentence-for-funding-isis-with-185000-in-crypto-says-doj/ https://earlybirdsinvest.com/30-year-sentence-for-funding-isis-with-185000-in-crypto-says-doj/#respond Sat, 10 May 2025 03:17:58 +0000 https://earlybirdsinvest.com/30-year-sentence-for-funding-isis-with-185000-in-crypto-says-doj/

On May 8, the US Department of Justice sentenced a man from Virginia to more than 30 years in prison for sending cryptocurrency to members of the Islamic State of Iraq and Syria (ISIS).

Mohammed Azharuddin Chhipa was found guilty in December 2023 and received his sentence on May 7. Judge David Novak sentenced him to 30 years and 4 months behind bars.

Between October 2019 and October 2022, Chhipa raised over $185,000 and sent it to women linked to the Islamic State in Syria. These funds helped them escape detention camps and continued to support the group’s activities.

Prosecutors said he used social media to ask for money and sometimes traveled long distances to collect it in person. After receiving donations, he converted the money into cryptocurrency and sent it to people in Turkey. From there, the funds were smuggled into Syria to reach Islamic State members.

A federal jury found Chhipa guilty on five charges—one for conspiracy to support a terrorist group and four for sending or attempting to send that support.

Attorney General Pamela Bondi said:

This defendant directly financed ISIS in its efforts to commit vile terrorist atrocities against innocent citizens in America and abroad.

She added that the prison term was meant to show that anyone who finances terrorism will face serious legal consequences, including decades in prison.

Meanwhile, on May 5, the Treasury’s Office of Foreign Assets Control (OFAC) announced sanctions against the Karen National Army (KNA), a militia group based in Myanmar. What were the allegations? Read the full story.

Celsius Collapse: Mashinsky Faces 20-Year Sentence Over Crypto Fraud https://earlybirdsinvest.com/celsius-collapse-mashinsky-faces-20-year-sentence-over-crypto-fraud/ https://earlybirdsinvest.com/celsius-collapse-mashinsky-faces-20-year-sentence-over-crypto-fraud/#respond Wed, 30 Apr 2025 03:03:27 +0000 https://earlybirdsinvest.com/celsius-collapse-mashinsky-faces-20-year-sentence-over-crypto-fraud/

The US Department of Justice (DOJ) has asked a New York court to sentence Alex Mashinsky, the former CEO of Celsius, to 20 years in prison.

Prosecutors said that his actions caused major financial losses for thousands of customers who trusted the platform with their digital assets.

The DOJ filed a 97-page document on April 28 outlining their request. They said Mashinsky led a “years-long campaign of lies and self-dealing” that ended with users losing billions of dollars when Celsius froze withdrawals in June 2022.

According to the filing, around $4.7 billion in customer funds became locked after the platform stopped operating.

The prosecutors noted that Mashinsky did not simply make mistakes or act carelessly. Instead, they said he made “deliberate, calculated decisions to lie, deceive, and steal in pursuit of personal fortune”.

The filing also stressed that Mashinsky’s behavior damaged trust in the wider cryptocurrency industry. Prosecutors believe that a harsh sentence would send a message that such behavior will not be tolerated, especially in areas where regulations are still developing.

The court is scheduled to sentence Mashinsky on May 8. Judge John Koeltl from the Southern District of New York will oversee the hearing, which may also include decisions on financial penalties to recover some of the funds taken.

Mashinsky’s legal problems grew after he pleaded guilty in December 2024. In court, he admitted to leading the fraudulent activities at Celsius. The DOJ said the losses from his crimes totaled more than $550 million, and that he personally made over $48 million during the scheme.

On April 23, Jay Clayton, the newly appointed acting US Attorney for Manhattan, submitted over 200 written statements to the court regarding Mashinsky’s case. What did they say? Read the full story.

Braiscompany $190,000,000 Crypto Ponzi Scheme Lands Mastermind a 128-Year Jail Sentence: Report https://earlybirdsinvest.com/braiscompany-190000000-crypto-ponzi-scheme-lands-mastermind-a-128-year-jail-sentence-report/ https://earlybirdsinvest.com/braiscompany-190000000-crypto-ponzi-scheme-lands-mastermind-a-128-year-jail-sentence-report/#respond Fri, 18 Apr 2025 22:42:26 +0000 https://earlybirdsinvest.com/braiscompany-190000000-crypto-ponzi-scheme-lands-mastermind-a-128-year-jail-sentence-report/

The leaders of a Brazilian crypto Ponzi scheme have reportedly been handed a combined sentence of over 170 years behind bars.

According to a new report, the three leaders of Braiscompany, which perpetrated the scheme, were sentenced for defrauding investors out of nearly $190 million, or $1.1 billion Brazilian Reals.

The report says the company’s main operator, Joel Ferreira de Souza, was handed a sentence of 128 years behind bars, while the other two perpetrators, Gesana Rayane Silva and Victor Augusto Veronez de Souza, were given sentences of 28 and 15 years, respectively.

According to authorities, the trio promised “exorbitant” returns on the crypto investments of their victims in order to initially get their funds and engaged in money laundering.

Ferreira de Souza was found to be controlling crypto portfolios through third parties, as well as using shell companies to facilitate his crimes. He was convicted of 11 counts of money laundering, while Reyane Silva, the firm’s broker, was found responsible for intermediating financial transactions and transporting funds. De Souza, Joel’s son, was also found guilty of being involved with one of the companies involved in the illegal transactions.

The judge in the case said that proceeds from the scam should go directly to the government. However, Artêmio Picanço – the lawyer representing the victims of Braiscompany – argued on one of his social media accounts that the fund should go directly to the victims.

Virgil Griffith, a former Ethereum developer who worked on the Ethereum Name Service (ENS), has been released from prison on parole and relocated to a halfway house.

Updates posted on X on Wednesday, April 9, 2025, disclosed that Griffith is now starting his return to civilian life after serving some of his sentence for violating US sanctions.

Ethereum Developer’s Prison Release Confirmed By Sources

Brantly Milegan, executive director of Ethereum Identity Foundation, broke the news with a photo of Griffith and his parents outside the prison. Alexander Urbelis, ENS general counsel and part of Griffith’s legal team, confirmed his release from FCI Milan in Michigan.

Griffith was arrested in November 2019 after speaking at a cryptocurrency conference in North Korea. Prosecutors claimed his presentation provided information that could help North Korea evade sanctions and launder money.

From 63 Months To 56: The Sentence Journey

In 2022, Griffith was sentenced to 63 months in prison and meted a fine of $100,000 after pleading guilty to the International Emergency Economic Powers Act. In July 2024, US District Judge Kevin Castel lowered his sentence to 56 months, citing him as a first-time offender.

Crypto Return Faces Serious Hurdles

Griffith himself starts a several-year probation term. His attorneys are fighting to transfer him from the halfway house to home confinement, but returning to regular life is hindered.

The Department of Commerce placed severe export restrictions on Virgil that will extend until 2032, Urbelis explained. These limits could block his return to the cryptocurrency field.

Presidential Pardon Possibility Under Trump Administration

Before joining Ethereum, Griffith earned a Ph.D. from Caltech and created WikiScanner, a tool tracking anonymous Wikipedia edits. He also worked with Aaron Swartz on Tor2web.

According to Urbelis, Griffith is seeking a pardon from US President Donald Trump. Trump has previously granted clemency to others in crypto-related cases, including Ross Ulbricht and Arthur Hayes.

The case has triggered debate about sharing open-source information versus helping sanctioned nations. Ethereum co-founder Vitalik Buterin has supported Griffith, even signing a petition calling for his release in 2023.

Man Faces 10-Year Sentence for Stabbing Crypto CEO in South Korean Court https://earlybirdsinvest.com/man-faces-10-year-sentence-for-stabbing-crypto-ceo-in-south-korean-court/ https://earlybirdsinvest.com/man-faces-10-year-sentence-for-stabbing-crypto-ceo-in-south-korean-court/#respond Sat, 22 Mar 2025 18:38:36 +0000 https://earlybirdsinvest.com/man-faces-10-year-sentence-for-stabbing-crypto-ceo-in-south-korean-court/

A South Korean man who attacked a crypto executive with a weapon during a courtroom trial could be sentenced to 10 years in prison.

Prosecutors have sought this sentence for the individual, identified as Mr. Kang, who was charged with attempted murder and disrupting courtroom proceedings after stabbing Mr. Lee Hyung-soo, the CEO of Haru Invest, during his fraud trial.

The Courtroom Attack

According to local media reports, the incident occurred on August 28, 2024, in courtroom 306 of the Seoul Southern District Court in Sinwol-ro, Yangcheon-gu, Seoul. Kang, a daily customer of Haru, had reportedly lost 100 BTC and, in a fit of rage, stabbed Lee in the neck severally. At the time, the Haru Invest CEO was on trial for allegedly defrauding around 16,000 investors of roughly $826 million.

During Kang’s final hearing on March 19, prosecutors argued that the crime was serious and carried out in an “evil” manner, warranting a 10-year sentence.

The 51-year-old’s defense attorney admitted that his client had stabbed Lee but insisted that he had not intended to kill him. He argued that Kang had acted impulsively after suffering financial losses and claimed the attack should be classified as special assault rather than attempted murder.

The defense further stated that the crime had not been premeditated, calling it a tragic mistake made under emotional pressure. The lawyer noted that Lee himself had requested leniency for Kang, recognizing the emotional distress he had faced.

However, a psychiatric evaluation from the National Forensic Hospital was presented in court, with the court stating that the offender had not been in a state of mental weakness or loss of consciousness at the time of the attack.

Sentencing Details

Kang’s legal team also requested the cancellation of his arrest, arguing that his period of detention should count toward the six-month limit under Article 172 of the Criminal Procedure Act.

The court announced that a decision on this would be made separately or together with the sentencing scheduled for April 4. In his final statement, the accused expressed remorse, saying, “I deeply reflect and regret that this act occurred in a place where it should not have happened, and I am truly sorry.”

A separate case from earlier this month in Korea saw a Chinese man die after suffering multiple stab wounds. The individual was the victim of a crypto deal gone wrong that instead ended in him getting attacked and robbed of 85 million won at a luxury hotel where the transaction was to take place.

Roger Ver, an early Bitcoin (BTC) investor, once known as “Bitcoin yes,” in support of cryptocurrency, was charged with tax fraud last year and could face life in prison.

Veterans from many industries are now coming to support him. Vitalik Buterin, co-founder of Ethereum, calls the potential statement “absurd.”

“It’s ridiculous to go to jail for the rest of your life over non-violent tax violations,” Buterin said in a social media post. “The lawsuit against Roger appears to be very politically motivated. Like Ross Ulbricht, there were many people and businesses facing far more milder writing than Roger faces, but far worse writing.”

His words come after Ross Ulbricht, founder of the Silk Road. He was sentenced to life in prison for creating the Darknet Marketplace, and later forgiven by US President Donald Trump, showing support for Ver, saying “the rest of his life should not be spent in prison on taxes.”

Similarly, Kraken founder Jesse Powell discusses in Ver’s defense. “The reality is, they don’t like him, they want to get him.

Ver and his legal team are challenging the case, claiming that the charges against him are politically motivated.

Ho Kai Xin, a former payroll manager at WeChain, has been sentenced to nine years and 11 months in prison for stealing $5.7 million from the crypto exchange Bybit

$2.95B

.

On February 20, a Singapore court announced the sentence after she pleaded guilty to 44 charges, including fraud and money laundering.

While overseeing payroll at WeChain, which managed salary payments for Bybit, Ho exploited her position by altering financial records. She redirected payments into four cryptocurrency wallets under her control, transferring a total of $4.2 million over several months. She then converted the stolen funds into traditional currency.

Her fraudulent activities went undetected for months, allowing her to continue diverting funds. In early 2023, WeChain discovered irregularities and reported Ho to authorities, which led to her arrest two months later.

Authorities found that Ho used the money to fund a luxury lifestyle, including placing a $750,000 deposit on a penthouse and purchasing designer items. Despite a court order to stop using the stolen funds, she continued spending and was sentenced to an additional six weeks in jail for contempt of court.

Bybit recovered over $1.1 million in Tether

from Ho’s crypto wallets and another $140,000 from her bank account. Police also confiscated more than $330,000 worth of assets, including a Mercedes-Benz car. However, she has not offered to return the remaining stolen funds.

During questioning, Ho attempted to mislead investigators by claiming that an individual named “Jason Teo” was responsible for the illegal transfers. Authorities later confirmed that this person did not exist.

Ho’s lawyer requested a reduced sentence, citing her role as a mother of two young children. However, prosecutors argued that her repeated offenses and attempts to deceive investigators warranted a harsher punishment.
