The Department of Justice (DOJ) has hinted that Tornado Cash co-founder Roman Storm is unlikely to face a second trial on new charges.

Storm was convicted on one felony count in August, but the latest comments from Matthew Galeotti, the acting assistant attorney general in charge of the criminal division, suggested a narrower focus on intent in crypto-related prosecutions.

Speaking at a Wyoming event hosted by the American Innovation Project, Galeotti outlined how the department plans to approach enforcement in the crypto industry. He said the goal was to bring more clarity and predictability to developers and businesses.

Although he did not mention Storm directly, Galeotti described cases that closely resemble Storm’s, including disputes over whether someone’s work amounts to operating an unlicensed money-transmission business. He said:

Innovating new ways for the economy to store and transmit value and create wealth, without ill intent, is not a crime.

Still, he explained that the DOJ will still go after people who break the law or help others commit crimes such as fraud, money laundering, or evading sanctions.

He also noted, “The department will not use federal criminal statutes to fashion a new regulatory regime over the digital asset industry. The department will not use indictments as a law-making tool. The department should not leave innovators guessing as to what could lead to criminal prosecution”.

Foundation has pledged to match up to $500,000 in new donations to support the legal defense of Roman Storm, co-developer of Tornado Cash.

Wei Wang, co-executive director of the foundation, stated in an August 7 post on X, “Privacy is normal, and writing code is not a crime”. The pledge follows earlier donations that have already helped raise more than $2 million for Storm’s defense.

Storm’s supporters, including the group Free Pertsev & Storm, warned that Storm could face up to five years in prison if his appeal fails, and much longer if the government moves forward with the other two charges.

In July, Storm said his legal expenses were growing and asked for an extra $1.5 million. He explained that his legal team had been working long hours throughout the three-week trial, which added to the pressure.

The Ethereum Foundation’s commitment comes after a New York jury found Storm guilty of running an unlicensed money transfer service. The jury could not agree on two other charges, money laundering and sanctions violations, which prosecutors could still retry.

The US government can still retry Tornado Cash developer Roman Storm on counts of money laundering and violating sanctions due to a hung jury, according to attorneys.

“The Department of Justice (DOJ) will decide in the coming days if it wants to retry those charges in a new trial,” Jake Chervinsky, chief legal officer at venture capital firm Variant Fund, wrote on X.

Storm was convicted on one felony count for his involvement with Tornado Cash on Wednesday. The jury found him guilty of conspiracy to operate an unlicensed money transmitting business.

However, jury members did not reach a unanimous verdict on the charges of conspiracy to commit money laundering and conspiracy to violate North Korea sanctions.

Attorney Aaron Brogan told Cointelegraph that Storm’s verdict still carries broader legal implication for decentralized protocols.

“The problem with this broad application of federal money transmitter law is that, frankly, many in DeFi worry they could apply as strongly to them as to Tornado Cash. And while the government probably won’t bring charges against all of DeFi, the broad exposure gives them a powerful stick in any negotiations.”

The case’s potential for lasting implications has drawn close attention from the crypto industry and privacy advocates. Attorneys say the precedent-setting trial is critical for digital privacy and could have a significant impact on open-source software developers in the United States.

Attorneys react to the partial verdict

The US can still bring Roman Storm back to court on the unresolved charges of conspiracy to commit money laundering and conspiracy to violate North Korea sanctions. The decision would depend on several factors, including the likelihood of securing a conviction in a second trial.

“If the Trump administration wants the USA to be the crypto capital of the world, then the DOJ must not be allowed to retry the two deadlocked charges,” Chervinsky said.

Chervinsky described the partial verdict as “a sad day for DeFi,” warning that section 1960 under the US Code, which prosecutors used to charge Storm with operating an unlicensed money transmitting business, represents an existential threat to decentralized finance applications.

“All in all, this leads to a pretty depressing conclusion,” attorney Zack Shapiro wrote on X, but said that it was good the “draconian” prison sentences for the money laundering charges were off the table for now.

A US court overturned the Tornado Cash sanctions in January 2025, handing decentralized crypto and privacy-preserving protocols a major legal victory.

The sanctions were imposed by the US Office of Foreign Assets Control (OFAC) in 2022, accusing the crypto mixing service of money laundering.

DOJ officials claimed the Tornado Cash protocol helped launder over $7 billion in crypto between 2019 and 2022 and was instrumental to North Korean state-sanctioned hackers laundering funds stolen through hacking.

On July 17, the court heard from FBI employees, including a forensic accountant and an agent who searched Storm’s home near Seattle. On July 15, jurors also heard from witnesses tied to alleged hackers linked to North Korea’s Lazarus Group who used Tornado Cash to move stolen funds.

Meanwhile, a disagreement has come up over what the jury should be allowed to hear when the defense takes its turn.

In a court filing, Storm’s legal team stated that one of their witnesses might talk about kidnappings involving crypto holders. They argued that this shows why privacy tools like Tornado Cash can help protect users from such crimes.

Tornado Cash has become a tool for North Korea’s Lazarus Group after the hackers stole $600 million from the Ronin Bridge in 2022, US prosecutors told jurors on July 15 as the trial of Roman Storm began in Manhattan.

Roman Storm, the co-founder of the crypto mixing service Tornado Cash, has asked for help to raise an immediate $500,000 ahead of his trial on Monday on charges of money laundering and sanctions violations.

Storm posted on X on Saturday that he faces a “critical shortfall” and needs to raise $500,000 in the next few days, and will need another $1 million within the next few weeks to cover the cost of his legal battle.

“My team is working nonstop to defend code as free speech, protect software development, and push back against government overreach that threatens us all,” he added.

In May, Free Pertsev & Storm, an organization set up to provide legal aid to the Tornado Cash founders, projected that the total legal costs for Storm’s trial would be $2 million.

However, Storm said on Friday that his legal fees will mount to $3.5 million as his trial could last up to four weeks, double the initially anticipated two weeks, due to “complex legal arguments and unforeseen witnesses and evidence.”

Storm was arrested in August 2023 on counts of money laundering, conspiracy to operate an unlicensed money transmitter, and conspiracy to violate US sanctions and faces up to 45 years in prison if found guilty.

On Friday, Storm’s legal team attempted to postpone the trial, arguing that prosecutors disclosed a witness after the scheduled deadline had ended.

The judge overseeing Storm’s criminal trial, Judge Katherine Failla, said she would not allow any mention of the US Treasury’s sanctions levied against Tornado Cash, which were withdrawn in March.

In April, the crypto lobbying group the DeFi Education Fund petitioned the Trump administration to end the so-called “lawless prosecution” of open-source software developers, including Roman Storm.

57% of goal raised for Tornado Cash trial

Storm is attempting to raise $3.5 million in total. At the time of writing, Storm has managed to raise $1.96 million, approximately 57% of the goal.

Since the donations are made in Ether (ETH), the amount raised can fluctuate. Currently, ETH is trading at $3,030, up 2.9% in the past 24 hours, according to Nansen.

Last month, the Ethereum Foundation said it would donate $500,000 and match community donations up to $750,000 for Storm’s legal defense.

Roman Storm, one of the founders of Tornado Cash, is still facing federal charges, but federal prosecutors have agreed to drop one part of the case.

In a letter sent to Judge Katherine Polk Failla on May 15, acting US Attorney Jay Clayton said that one of the charges, related to operating an unlicensed money-transmitting business, would be removed.

As a result, prosecutors will no longer argue that Storm broke rules by failing to register as a money transmitter. But they are not dropping the accusation that he moved funds knowing they were tied to criminal activity.

The government also continues to claim that Tornado Cash helped criminals move over $1 billion in cryptocurrency. Some of that money came from the Lazarus Group, a North Korea-linked hacking team.

Storm still faces two other charges, one for being part of a money laundering scheme and another for helping to break US sanctions. Both of these charges carry a maximum sentence of 20 years in prison.

The U.S. Department of Justice will drop part of one count of its case against Tornado Cash developer Roman Storm due to a recent policy memo, the agency said Thursday.

The DOJ will not go to trial on a charge alleging Storm failed to comply with money transmitter business registration rules, but still plans to go to trial in July over allegations he knowingly transmitted funds tied to crimes, conspired to commit money laundering and conspired to violate sanctions law, the DOJ said in a letter filed to the judge overseeing its case.

“The Government writes to update the Court regarding this case, which is scheduled for trial on July 14, 2025,” the letter said. “After review of this case, this Office and the Office of the Deputy Attorney General have determined that this prosecution is consistent with the letter and spirit of the April 7, 2025 Memorandum from the Deputy Attorney General.”

The April 7 memo, authored by Deputy Attorney General Todd Blanche, directed prosecutors not to pursue cases where regulations may be unclear, or did not meet certain criteria, specifically saying the DOJ should end “regulation by prosecution.” Prosecutors in another case against the developers of crypto mixer Samourai Wallet have already asked a judge overseeing that case to pause it while they consider the memo.

In a statement, Brian Klein of Waymaker LLP told CoinDesk that his firm, which represents Storm, believes “that this case should never have been brought.”

“Its dismissal would be consistent with the policies of the Trump Administration and the principles outlined by the Department of Justice in its recent cryptocurrency guidance memo,” he said. “Roman’s prosecution is a threat to the entire crypto industry and the interests of justice will be best served by its swift dismissal. We will not cease to fight for Roman and that result.”

Klein spoke at CoinDesk’s Consensus 2025 conference in Toronto on Wednesday, where he also shared his view that the case should not have been brought.

“One of the defenses we’ve raised, which is recognized in the U.S., is that coding — literally typing out code — you are given free speech protections for coding,” he said. “It’s just as if you wrote a book or you did some other type of expressive activity.”
