South Korean prosecutors probing the former President Yoon Suk-yeol and the former First Lady Kim Keon-hee have interrogated the suspected crypto fraudster Jon Bur Kim (real surname Park).

Park, a crypto market maker and luxury sports car collector, has been indicted for crypto fraud. Prosecutors think he issued and manipulated two so-called “scam coins,” and manipulated their prices by issuing fake news about the tokens.

However, prosecutors earlier this month established a possible link between Park’s case and that of the former First Lady.

Kim Keon-hee is accused of peddling influence, stock manipulation, and other corruption-related charges.

Former President Yoon: Arrest Warrant Incoming?

Prosecutors are investigating Kim Keon-hee along with Yoon, who failed in a bid to declare martial law in South Korea in early December last year.

The former President was later impeached. He has since been charged with various corruption-related offences.

But Former President Yoon has twice refused to respond to court summons requests. This has led prosecution officials to consider requesting an arrest warrant.

Yonhap reported that the probe has also expanded to Yoon and Kim’s associates. The South Korean news agency wrote that the special prosecution team is believed to be investigating the former senior prosecutor Kim Sang-min.

Prosecutors believe Kim Sang-min may have “received illicit money” from the chief suspect in a crypto fraud case.

Media outlets assume that this is Park, who is accused of embezzling 80.9 billion won ($58.1 million) worth of investors’ money.

Prosecutors think that Park gave Kim Sang-min money to pay for motor vehicle rental fees. Kim Sang-min then allegedly used this money to pay for the vehicles as he attempted to win the People Power Party nomination for the Changwon Uichang district seat ahead of the April 10 legislative election last year.

Kim Sang-min was ultimately unsuccessful in his bid, and was eliminated during the primaries. But prosecution officials appear to think that Kim Keon-hee used her influence to help him run.

Rug Pull Suspect Summoned

The latest development appears to confirm reports from earlier this month. These claimed that the special prosecution team had asked to see the Park/scam coin case files.

Prosecutors think that Park and a CEO surnamed Moon stole hundreds of billions of won. They think the duo issued and listed a suspected scam coin named Atube in 2021.

They have also accused Park of masterminding a rug pull scam for a token named Podo Coin, also in 2021.

Prosecutors to Close Roman Storm Case by July 25, Defense Up Next https://earlybirdsinvest.com/prosecutors-to-close-roman-storm-case-by-july-25-defense-up-next/ https://earlybirdsinvest.com/prosecutors-to-close-roman-storm-case-by-july-25-defense-up-next/#respond Sun, 20 Jul 2025 05:59:41 +0000 https://earlybirdsinvest.com/prosecutors-to-close-roman-storm-case-by-july-25-defense-up-next/

Prosecutors in New York’s Southern District expect to wrap up arguments against Tornado Cash co-founder Roman Storm by July 25.

This was shared in court on July 17, according to Inner City Press, with Assistant US Attorney Thane Rehn saying the government’s presentation is nearly complete.

Once the prosecution rests, Storm’s lawyers will begin presenting their side. Before the trial started, Storm shared on X that he thought the case might last three to four weeks because of complicated arguments and unexpected evidence.

On July 17, the court heard from FBI employees, including a forensic accountant and an agent who searched Storm’s home near Seattle. On July 15, jurors also heard from witnesses tied to alleged hackers linked to North Korea’s Lazarus Group who used Tornado Cash to move stolen funds.

Meanwhile, a disagreement has come up over what the jury should be allowed to hear when the defense takes its turn.

In a court filing, Storm’s legal team stated that one of their witnesses might talk about kidnappings involving crypto holders. They argued that this shows why privacy tools like Tornado Cash can help protect users from such crimes.

However, prosecutors are asking the judge to prevent any testimony that refers to kidnapping or torture.

Meanwhile, Roger Ver, known as “Bitcoin Jesus”, recently appealed to the European Court of Human Rights to block his extradition to the US on tax evasion charges. What did he claim? Read the full story.

Tornado Cash Trial Day 2: Prosecutors and Defense https://earlybirdsinvest.com/tornado-cash-trial-day-2-prosecutors-and-defense/ https://earlybirdsinvest.com/tornado-cash-trial-day-2-prosecutors-and-defense/#respond Wed, 16 Jul 2025 00:12:43 +0000 https://earlybirdsinvest.com/tornado-cash-trial-day-2-prosecutors-and-defense/

Today, on the second day of the tornado cash trial, the prosecutors and defense provided the case defendants with an opposite account in their opening statement about why the Roman storm started tornado cash.

These statements came after the ju apprentice selection process was completed.

The judges consist of seven women and five men. The two members of the ju apprentice are four in their 60s and 40s, one in their 30s and five in their 20s. Eight have bachelor’s degrees, three have high school degrees, and one has a master’s degree.

The ju judge stood up shortly after 2pm EST, just before both the prosecutors and the defense issued their opening statement.

An opening statement from the prosecutor

The prosecutor first submitted his opening statement.

From the prosecutor’s team, Mosley faced a ju-degree trooper and was plagued by the notion that Storm created tornado cash with the main motivation to enrich himself.

Mosley said hundreds of millions of dollars worth of codes have been poured through tornado cash, and the storm and his co-conspirators Roma Semenov and Alexei Pertsev chose not to do so, although tornado cash is not appealing to criminals.

He also cited how tornado cash promoted sanctions violations as North Korean hackers used the service to wash their crypto funds.

He admixed funds stolen from hacks in the online crypto game Axie Infinitiy by North Korean hackers using tornado cache, and Storm’s Thas and and and and tornado crinado crinado craws on tornado crinado craws on tornado washing washing washing washal (defense admitted in its opening statement that Storm was wearing such a T-shirt in “bad taste.”

Mosley also said the evidence also shows that the tornado cash Storm and his co-conspirators intentionally operated a code “washing machine” to wash funds for bad actors, and that he was unable to design the tornado cash when he allegedly failed to make changes to the tornado cash design.

“He chose to wash his money multiple times,” said Mosley of Storm.

Mosley added that Storm attempted to “hidden his actions” by using his account to “cash out” his multi-million dollar songs. (No details are provided as to whether this is a bank or crypto exchange account.)

Finally, Mosley said the evidence in the incident included encrypted chats about the tornado cash business. Defendant’s communication with Crypto Hacks victims, funds flowing through Tornado’s cash. A document showing that Storm used cash out in August 2022 using another person’s account.

Opening statement from Defense

Axel, a member of the defense team, spoke to the ju umpire after Mosley.

She began by painting Storm as a hardworking immigrant who likes computer programming, adding that he works for many reputable high-tech companies, including Amazon.

She said Storm created tornado cash to resolve financial privacy issues when trading on public blockchains, claiming that he had none of the bad actors who used the service.

“Roman had nothing to do with the hacking or fraud that the government was talking about,” Axel said. “Bad actors misused tornado cash to cover their trucks.”

Axel also shared that it was a conversation with Ethereum creator Vitak Buterin (the blockchain on which tornado cash is being deployed), which prompted him to create tornado cash.

She spoke about how Storm met Butarin at the meeting and asked him what would be an important project to work on for Ethereum. Axel said Butarin told Storm that transaction privacy is an important issue to be resolved. Storm soon began developing tornado cash.

Axel then walked through the Juju jury through a series of illustrations explaining how Ethereum works and how tornado cash anonymizes transactions on the network.

(The defense has distilled this information well, but I think it’s still a bit confusing to the ju-decides.

Axel stressed the fact that Tornado cash doesn’t charge a fee for services, but that was able to do so.

She added that the first tornado cash test pool was launched in the way that Baterin herself participated in the “unreliable ceremony” in May 2020.

She also said that once Tornado’s cash mixing pool is launched, Storm and his co-founder will burn the keys, leaving developers unable to control what happened within the pool.

“The government’s case is about the Romans that should stop hackers from using pools,” Axel said. “But he couldn’t do this.”

Axel concluded her opening statement by saying tornado cash was merely a tool used by both bad and good people.

First Witness

Following the conclusion of the opening statement, the prosecutor called on the first witness, Mr. Lin, to the stand.

Lynn convinced the scammer to contact her via WhatsApp, detailing another messaging app, scenario, and opening a Crypto.com account and depositing a total of more than $200,000.

The scammer walked through Lin the process of purchasing a “crypto” as Lin said, then transferred the code to a shell company called NTU Capital.

The witness was rejected before either her or the prosecutor concluded the story, but given the purpose of the trial, it may be assumed that the funds were stolen from Ms. Lynn and cannot be tracked through tornado cash. (To be clear, the second half of the previous sentence is speculation.)

Tomorrow’s schedule

The trial is scheduled to resume tomorrow at 9am.

Prosecutors informed the judge that they plan to bring at least three witnesses to the stands tomorrow.

DOJ Will Still Pursue Roman Storm Case Despite Blanche Memo, Prosecutors Say https://earlybirdsinvest.com/doj-will-still-pursue-roman-storm-case-despite-blanche-memo-prosecutors-say/ https://earlybirdsinvest.com/doj-will-still-pursue-roman-storm-case-despite-blanche-memo-prosecutors-say/#respond Fri, 16 May 2025 03:32:02 +0000 https://earlybirdsinvest.com/doj-will-still-pursue-roman-storm-case-despite-blanche-memo-prosecutors-say/

The U.S. Department of Justice will drop part of one count of its case against Tornado Cash developer Roman Storm due to a recent policy memo, the agency said Thursday.

The DOJ will not go to trial on a charge alleging Storm failed to comply with money transmitter business registration rules, but still plans to go to trial in July over allegations he knowingly transmitted funds tied to crimes, conspired to commit money laundering and conspired to violate sanctions law, the DOJ said in a letter filed to the judge overseeing its case.

“The Government writes to update the Court regarding this case, which is scheduled for trial on July 14, 2025,” the letter said. “After review of this case, this Office and the Office of the Deputy Attorney General have determined that this prosecution is consistent with the letter and spirit of the April 7, 2025 Memorandum from the Deputy Attorney General.”

The April 7 memo, authored by Deputy Attorney General Todd Blanche, directed prosecutors not to pursue cases where regulations may be unclear, or did not meet certain criteria, specifically saying the DOJ should end “regulation by prosecution.” Prosecutors in another case against the developers of crypto mixer Samourai Wallet have already asked a judge overseeing that case to pause it while they consider the memo.

In a statement, Brian Klein of Waymaker LLP told CoinDesk that his firm, which represents Storm, believes “that this case should never have been brought.”

“Its dismissal would be consistent with the policies of the Trump Administration and the principles outlined by the Department of Justice in its recent cryptocurrency guidance memo,” he said. “Roman’s prosecution is a threat to the entire crypto industry and the interests of justice will be best served by its swift dismissal. We will not cease to fight for Roman and that result.”

Klein spoke at CoinDesk’s Consensus 2025 conference in Toronto on Wednesday, where he also shared his view that the case should not have been brought.

“One of the defenses we’ve raised, which is recognized in the U.S., is that coding — literally typing out code — you are given free speech protections for coding,” he said. “It’s just as if you wrote a book or you did some other type of expressive activity.”

Secret Deal Backfired? FTX Exec's Wife Alleges Broken Promise by Prosecutors https://earlybirdsinvest.com/secret-deal-backfired-ftx-execs-wife-alleges-broken-promise-by-prosecutors/ https://earlybirdsinvest.com/secret-deal-backfired-ftx-execs-wife-alleges-broken-promise-by-prosecutors/#respond Sat, 10 May 2025 12:11:13 +0000 https://earlybirdsinvest.com/secret-deal-backfired-ftx-execs-wife-alleges-broken-promise-by-prosecutors/

Former FTX Digital Markets co-CEO Ryan Salame’s wife, Michelle Bond, is asking a US judge to drop the charges against her.

She said that federal prosecutors tricked her husband into pleading guilty by promising they would not go after her.

In a filing submitted on May 7 to a federal court in New York, Bond’s lawyers repeated claims Salame had made. They argued that the government used misleading tactics to get Salame to agree to a deal that ultimately sent him to prison.

According to the filing, prosecutors privately said they would stop investigating Bond—but refused to put that in writing. Meanwhile, the court document said:

Mr. Salame and Ms. Bond’s attorneys were advised that the agreement to cease investigating Ms. Bond could not be placed within the four corners of the Salame plea or other written agreement.

However, it adds that the government still used the promise as a way to persuade him to plead guilty.

It also stated that there was enough disagreement over what promises were made to Salame and Bond that a court hearing—with access to more evidence—should take place.

In August 2024, federal officials charged Bond with several campaign finance violations, including excessive donations, accepting money from companies through middlemen, and filing false reports with election regulators.

Bond’s filing also suggests politics played a part. She hints that her Republican party affiliation may have influenced the charges against her. However, the charges she faces are based on financial records and campaign donations—not on political views.

US court delays Do Kwon hearing as prosecutors unveil 4 terabytes of evidence https://earlybirdsinvest.com/us-court-delays-do-kwon-hearing-as-prosecutors-unveil-4-terabytes-of-evidence/ https://earlybirdsinvest.com/us-court-delays-do-kwon-hearing-as-prosecutors-unveil-4-terabytes-of-evidence/#respond Tue, 04 Mar 2025 21:58:13 +0000 https://earlybirdsinvest.com/us-court-delays-do-kwon-hearing-as-prosecutors-unveil-4-terabytes-of-evidence/

A US federal court has postponed a key hearing in the case against Terraform Labs co-founder Do Kwon after prosecutors submitted an extensive amount of new evidence, significantly broadening the case.

According to court filings, the status conference, originally scheduled for March 10 in the Southern District of New York, has been pushed to April 10.

Hearing delayed

Prosecutors argued that the defense requires additional time to analyze the newly provided four terabytes of discovery. The court concurred, citing the “voluminous discovery” as justification for the delay.

Court documents indicate that on Feb. 27, the US government handed over 600 gigabytes of evidence to Kwon’s legal team, including data from his cellphones, emails, and crypto transactions.

Authorities now intend to provide an additional four terabytes of discovery by next week.

Despite the postponement, the jury trial remains scheduled for Jan. 26, 2026. Additionally, victims of the Terraform Labs collapse have until April 30 to submit claims for financial losses.

The delay in Kwon’s case introduces further complexity to an already high-profile legal battle. With an immense volume of discovery materials now under review, his defense team must navigate a challenging process ahead of trial.

Federal prosecutors allege that Kwon knowingly misrepresented the stability of Terraform’s ecosystem, leading to one of the most significant financial downturns in crypto history.

Meanwhile, Kwon continues to deny any wrongdoing and claims that the market downturn was unforeseen rather than the result of fraudulent activity.

SEC case

Kwon, who was extradited from Montenegro to the US on Dec. 31, 2024, entered a not guilty plea on Jan. 2 to multiple fraud-related charges. His case stems from the collapse of Terraform Labs’ algorithmic stablecoin, TerraUSD, which resulted in roughly $40 billion in investor losses in 2022.

Kwon’s extradition followed a prolonged legal battle between authorities in Montenegro, South Korea, and the US. Terraform Labs has also faced scrutiny from the Securities and Exchange Commission (SEC), which has accused Kwon of orchestrating a large-scale crypto fraud.

In April 2024, a jury found Do Kwon and Terraform Labs liable for defrauding investors in crypto asset securities. The SEC had argued that Kwon and his company misrepresented the stability of their ecosystem, leading to significant investor losses.

Following the jury’s verdict, the SEC filed a motion requesting $5.3 billion in disgorgement and civil penalties against Terraform Labs and Do Kwon. This amount was described as a “conservative” but “reasonable approximation” of the ill-gotten gains from the alleged fraud.

The court ultimately imposed a $4.5 billion fine on both Kwon and Terraform Labs.

This story appeared in the Logoff, a daily newsletter that helps you stay informed about the Trump administration without letting political news take over your life. Subscribe here.

Welcome to the Logoff. Today I’m covering another purge at the Justice Department, where Donald Trump’s administration is taking revenge against high-ranking career prosecutors who prosecuted Trump allies over January 6 and in other criminal cases.

What’s the latest? The head of the Washington, DC, US attorney’s office demoted seven high-ranking prosecutors on Friday, Reuters reports, moving them to entry-level positions in a bid to force them to quit. Those demoted include:

The experienced attorneys will now mostly handle misdemeanors and low-level crimes. The demotions follow the January firing of US attorneys who prosecuted Trump over his attempt to steal the 2020 election.

Why were they demoted? Ed Martin, the Trump-appointed new head of the DC office, claimed the moves reflected a shift in priorities and a focus on local crime in DC. But the Trump-related experiences of the officials selected — and the move of experienced prosecutors to entry-level jobs — make it difficult to believe this wasn’t an act of retribution.

What’s the big picture? The demotions send a strong signal to prosecutors that there will be consequences for officials who try to hold Trump and his allies accountable to the law. It’s also another blow against the DOJ’s independence, as Trump works to remake law enforcement as a tool he can wield for political ends. And the move weakens the US attorney’s office in Washington, which is tasked with prosecuting abuses of power by some of the country’s most powerful people.

And with that, it’s time to log off…

Vox’s Gray Area podcast this week is about the science of changing one’s own personality — how, why, and if one should endeavor to fix the parts of ourselves that we don’t like. It’s a 45-minute listen, perfect for a walk outside (or, in my case, doing some long-overdue dishes). Whatever you decide to do while listening, I promise it’s a far, far better option than the doomscroll. I hope you enjoy it. Thanks for all the smart emails this weekend, and I’ll see you back here tomorrow.
