US Senator Elizabeth Warren, joined by Senators Chris Van Hollen and Ron Wyden, has called on the Office of the Comptroller of the Currency (OCC) to address potential conflicts of interest involving President Donald Trump’s cryptocurrency activities.

In a letter to OCC head Jonathan Gould, the senators raised concerns about President Trump’s financial connections to stablecoin projects and how those ties could affect regulatory decisions.

Their letter questions how the OCC will make sure President Trump’s private business interests do not interfere with the agency’s work. The lawmakers pointed to USD1, a stablecoin issued by World Liberty Financial.

They noted that Trump and his family have investments in multiple crypto ventures, including mining and token trading companies.

The letter argued that President Trump’s financial stake in these ventures could influence how he approaches crypto policy. It warned that his personal wealth is linked to the success of USD1 and similar projects.

They also pointed to a recent $2 billion investment deal involving UAE-based firm MGX and Binance

. According to the letter, MGX would use USD1 to buy a stake in Binance, which could lead to large profits for the Trump family.

The senators noted that Binance has a history of violating US anti-money laundering and sanctions laws.

Additionally, the lawmakers raised questions about Gould’s role as head of the OCC. They asked if he believes President Trump could remove him from the position at will and whether he would step down or alert Congress if he came under political pressure.

The senators requested a full response from the OCC by August 14.

ABA Urges OCC to Pause Crypto Firms’ Bank Licence Applications https://earlybirdsinvest.com/aba-urges-occ-to-pause-crypto-firms-bank-licence-applications/ https://earlybirdsinvest.com/aba-urges-occ-to-pause-crypto-firms-bank-licence-applications/#respond Mon, 21 Jul 2025 16:50:30 +0000 https://earlybirdsinvest.com/aba-urges-occ-to-pause-crypto-firms-bank-licence-applications/

Several banking and credit union groups have asked US regulators to hold off on granting federal bank licences to crypto companies.

In a letter sent on July 17, the American Bankers Association and other trade groups urged the Office of the Comptroller of the Currency (OCC) to delay any decisions until more details about the applicants’ plans are made public.

The groups said the applications from firms like Circle, Ripple, and Fidelity Digital Assets raise legal and policy questions.

If approved, the licences would let these crypto companies operate as national banks, handle payments more quickly, and avoid having to get separate approvals in each state.

The groups, however, said the available information in the applications does not allow for proper review or public feedback. They also noted that the OCC itself should face more scrutiny if it decides to move ahead.

The letter stated that offering custody of digital assets is not a fiduciary activity, and granting charters where such services are not central would change OCC policy.

Caitlin Long, founder of Custodia Bank, stated in a July 19 post on X that the debate over whether trust charters are being used as a kind of bank licence with lighter requirements is likely to end up in court.

She added that if crypto companies succeed, traditional banks might switch to trust charters to lower their own costs and reduce their regulatory burden.

On July 14, three US federal agencies released a joint document warning banks about the risks of holding cryptocurrency for their customers. What did they say? Read the full story.

OCC, Fed, FDIC publish joint guidance for banks offering crypto custody https://earlybirdsinvest.com/occ-fed-fdic-publish-joint-guidance-for-banks-offering-crypto-custody/ https://earlybirdsinvest.com/occ-fed-fdic-publish-joint-guidance-for-banks-offering-crypto-custody/#respond Mon, 14 Jul 2025 23:13:43 +0000 https://earlybirdsinvest.com/occ-fed-fdic-publish-joint-guidance-for-banks-offering-crypto-custody/

The Office of the Comptroller of the Currency (OCC), the Federal Reserve Board (Fed), and the Federal Deposit Insurance Corporation (FDIC) released a joint statement explaining how existing banking rules apply when institutions custody crypto for customers.

The guidance describes “safekeeping” as the act of holding a digital asset on a client’s behalf and stresses that it does not create new supervisory demands.

Risk control centers on cryptographic keys

Regulators instructed boards and executives to view crypto custody as a service that relies on exclusive control of private keys and other sensitive data. They note that a bank must prove no other party, even the customer, can unilaterally move an asset once it enters custody.

Management must assess how key-generation tools, wallet types, and contingency plans align with the institution’s broader control environment and ensure that staff possess the necessary technical skills to maintain these safeguards.

The statement also told banks to weigh the volatility of the asset class and the rapid pace of technological change when allocating capital and staffing for custody operations.

The agencies said sound programs include continuous reviews of each supported token’s software dependencies and ledger design to spot vulnerabilities that could threaten safety and soundness.

Compliance, governance, and third-party oversight

The three agencies reminded institutions that crypto custody must satisfy Bank Secrecy Act, anti-money laundering, counter-terrorism financing, and Office of Foreign Assets Control rules, including the “travel rule” that attaches identifying information to transfers.

Boards must involve the BSA officer and senior managers early in any custody rollout to gauge illicit-finance exposure and document controls.

Additionally, banks that delegate storage to sub-custodians remain responsible for the performance of those vendors. The guidance instructed firms to examine a sub-custodian’s key management methods, segregation of assets, and insolvency protections before signing contracts.

Firms will also be required to build notice requirements for any breach or operational event. Institutions that keep assets in-house but buy third-party software must apply the same vendor-risk disciplines.

Finally, the agencies requested that auditors expand their testing to include crypto-specific elements, such as key generation, wallet security, and on-chain settlement controls.

When internal teams lack expertise, management should hire independent specialists to validate safeguards and report directly to the audit committee.

The joint statement concluded that existing fiduciary, custody, and information security regulations already provide a framework for banks that wish to safeguard their crypto.

However, those banks must demonstrate that they can control keys, manage vendors, and comply with federal financial crime statutes in real time.

Private Banker Faces Lifetime Industry Ban After Allegedly Stealing $3,437,536 From Customer Accounts Over Three Years: OCC https://earlybirdsinvest.com/private-banker-faces-lifetime-industry-ban-after-allegedly-stealing-3437536-from-customer-accounts-over-three-years-occ/ https://earlybirdsinvest.com/private-banker-faces-lifetime-industry-ban-after-allegedly-stealing-3437536-from-customer-accounts-over-three-years-occ/#respond Sat, 21 Jun 2025 18:01:43 +0000 https://earlybirdsinvest.com/private-banker-faces-lifetime-industry-ban-after-allegedly-stealing-3437536-from-customer-accounts-over-three-years-occ/

The Office of the Comptroller of the Currency (OCC) is taking action against a former bank employee who allegedly stole millions of dollars from customer accounts.

The OCC says it’s issuing an order of prohibition against William Shane Garrow, the former senior vice president of private banking for a subsidiary of BOK Financial in Tulsa, Oklahoma.

Says the OCC,

“Between approximately March 17, 2021 and March 12, 2024, respondent misappropriated approximately $3,437,536 from multiple customers’ accounts under the bank’s custody for his personal benefit, without the customers’ knowledge or authorization.”

According to the OCC, Garrow engaged in unsafe and unsound practices and violations of law that resulted in significant losses for the bank.

The regulator has now banned Garrow from working at insured depository institutions, including banks and credit unions. The former bank executive is consenting to the issuance of the order without admitting or denying the OCC’s findings.

The OCC action comes after Garrow pleaded guilty to bank fraud and willfully making and subscribing a false Federal income tax return. Garrow was sentenced last month to 71 months in prison. He was also ordered to pay $3.86 million in restitution and $1.519 million to the IRS.

Prosecutors said Garrow directed fraudulent wire transfers and cashier’s checks from at least 16 client accounts to entities and bank accounts that he controlled. If a client asked about the transactions, Garrow blamed it on a banking error and would return the funds stolen or transfer money from another victim’s account.

Said US Attorney Clint Johnson last month,

“Garrow deceived people for over 12 years, and his actions wreaked havoc on banking personnel who were tasked with correcting his wrongs. This was not a simple banking error or an accident, but rather a criminal scheme. Garrow abused the trust given to him by the bank and its customers.”

American national banks are now legally allowed to buy and sell crypto on behalf of their customers. The ruling was made on Wednesday in the form of a revised interpretive letter from the Office of the Comptroller of the Currency (OCC), eliminating previous regulatory hurdles and allowing banks to go ahead with digital asset services.

Banks Permitted To Provide Full Crypto Services

Under the OCC guidance, federal savings associations and national banks may now offer the full array of crypto services. That would encompass buying and selling digital assets, converting them into US dollars, making settlements, maintaining customer records, and even supporting asset valuations and tax reporting.

These services may be managed either by the banks themselves or in collaboration with third-party providers. But in both instances, the OCC was unambiguous: banks need to have robust internal controls and risk management procedures.

The new guidance also indicates a broader change in the way US regulators are thinking about crypto. On March 7, the OCC eliminated a rule that had compelled banks to obtain supervisory non-objection before making a foray into digital currencies.

Then on April 24, the Federal Reserve backtracked on its 2022 policy mandating state member banks to provide prior notice before becoming involved in crypto activities. According to Faryar Shirzad, Coinbase’s Chief Policy Officer, this new direction brings more clarity. He also credited Acting Comptroller Rodney Hood with assisting to advance it.

Banks Must Act On Customer Direction

The OCC’s letter also makes it clear that banks can act on a customer’s instruction. So if one holds crypto with their bank and wishes to sell the crypto, then the bank can execute the transaction directly. This enhances customers’ control and paves the way for easier crypto transactions using well-known banking conduits.

This explanation is based on previous guidance from the OCC, but now eliminates any uncertainty. Banks are not required to wait for special approval to provide these services, which may accelerate adoption.

As of today, the market cap of cryptocurrencies stood at $3.23 trillion. Chart: TradingView

Risk Oversight Rules For Outside Providers

The OCC guidance also establishes requirements for how banks are to deal with third-party crypto service providers. In the event that banks outsource activities such as crypto custody or transaction facilitation, due diligence needs to be conducted and oversight instituted.

Sub-custodians, especially, need to adhere to security protocols to safeguard customer assets. Banks are expected by the OCC to hold such partners to the same standards they apply in other banking segments. Risk frameworks need to be consistent with current regulations to safeguard customers from possible mishandling.

Crypto’s Path Into The Banking Mainstream

This announcement is a strong message that crypto is no longer taboo for mainstream banks. By providing banks with more latitude to engage without the need for prior approval, the OCC is signaling a more embracing attitude toward digital asset services within regulated finance.

Whether that leads to a flood of banks into the business is uncertain. But the guidelines are in place, the door is open, and customers can now choose to get crypto services from the same banks where they hold their checking accounts.

The US office of the currency secretary, which regulates national banks, has issued an interpretation that at the request of its clients, that institutions can buy and sell crypto assets in detention.

The newly explained policy stance announced by the OCC on Wednesday revealed that bankers can outsource cryptocurrency activities to third parties, including custody and enforcement services. As long as you check all the boxes of WatchDog’s security and sounding requirements, the OCC is giving crypto freedom to the bank.

This week’s move follows a reversal of a long-standing policy march that requires bankers to check with government supervisors before moving forward with new cryptocurrencies. “These letters show a change in the OCC’s approach,” said Katherine Kirkpatrick Boss, general counsel at Starkware and former chief justice officer at CBOE Digital, on social media site X. And the additional guidance that third parties are OK is “the benefit of regulated crypto native service providers.”

OCC reaffirms banks’ authority to offer crypto services without prior approval https://earlybirdsinvest.com/occ-reaffirms-banks-authority-to-offer-crypto-services-without-prior-approval/ https://earlybirdsinvest.com/occ-reaffirms-banks-authority-to-offer-crypto-services-without-prior-approval/#respond Wed, 07 May 2025 22:55:30 +0000 https://earlybirdsinvest.com/occ-reaffirms-banks-authority-to-offer-crypto-services-without-prior-approval/

The Office of the Comptroller of the Currency (OCC) clarified on May 7 that federally chartered banks and savings associations may offer crypto services, namely custody and execution, including through third-party providers, provided they adhere to sound risk management practices and legal compliance.

The clarification, issued through Interpretive Letter 1184, confirms and expands on earlier guidance related to crypto activities.

The OCC stated that institutions may buy and sell assets held in custody at the customer’s direction and outsource crypto-asset functions, including custody and trade execution services, to third parties.

These activities remain subject to the same oversight and operational standards applied to traditional financial services, including due diligence, third-party risk management, and cybersecurity protocols.

The letter builds on prior OCC guidance outlined in Interpretive Letters 1170 and 1183. It also reinforces the regulator’s view that digital asset services can fall within the scope of permissible banking activities when conducted safely and in compliance with applicable regulations.

Regulatory context and policy shift

The clarification follows a policy change first announced by the OCC on March 7, which removed the requirement for prior regulatory approval for certain crypto-related activities.

That earlier announcement departed from previous supervisory practices under former President Joe Biden’s administration, when banks needed to notify examiners and receive a letter of no objection before engaging in crypto services.

In its March update, the OCC confirmed that national banks may engage in crypto-asset custody and stablecoin activities and even participate as validators on distributed ledger networks.

The updated guidance effectively reversed previous cautionary statements and removed procedural hurdles, allowing banks to incorporate crypto services into their operations without seeking advance approval.

At the time, acting comptroller of the currency Rodney Hood said the OCC aimed to streamline oversight while maintaining high safety standards.

Reinforcing permission

The May 7 letter builds on that policy foundation, formally integrating execution services and sub-custodian relationships into the scope of authorized activity.

The OCC reiterated that institutions must manage associated risks, whether they handle crypto services internally or through third parties.

Interpretive Letter 1184 reaffirms the permission to federally regulated banks to engage with digital assets in a custodial capacity, provided these activities are executed with appropriate safeguards and in compliance with federal banking law.

The OCC’s updated position affirms crypto services as permissible under existing authorities and signals continued regulatory normalization of digital asset services within the US banking sector.

Fed Joins OCC, FDIC in Withdrawing Crypto Warnings for U.S. Banks https://earlybirdsinvest.com/fed-joins-occ-fdic-in-withdrawing-crypto-warnings-for-u-s-banks/ https://earlybirdsinvest.com/fed-joins-occ-fdic-in-withdrawing-crypto-warnings-for-u-s-banks/#respond Fri, 25 Apr 2025 00:52:13 +0000 https://earlybirdsinvest.com/fed-joins-occ-fdic-in-withdrawing-crypto-warnings-for-u-s-banks/

The Federal Reserve has joined its fellow U.S. banking regulators in deleting its crypto guidance of previous years, including notices that banks should get pre-approvals before they get involved in crypto activity.

Now, all three agencies — including the Office of the Comptroller of the Currency and the Federal Deposit Insurance Corp. — have joined in reversing those previous policies, leaving crypto matters at banks in the hands of their managers and compliance executives. In the absence of guidance, the banking industry awaits new laws from Congress to define how the digital assets industry should operate in the U.S.

“These actions ensure the Board’s expectations remain aligned with evolving risks and further support innovation in the banking system,” the Fed said in the Thursday statement announcing the change.

Banking supervision of its state member banks is one of the multiple roles performed by the Fed, which is better known for its monetary policy work. The agency’s move on Thursday will specifically remove four pieces of crypto guidance the board signed onto in 2022 and 2023, highlighting risks to banks posed by the sector.

Fed officials “will instead monitor banks’ crypto-asset activities through the normal supervisory process.”

Operation Choke Point 2.0 Not Over Despite OCC Easing Crypto Rules, Says Custodia Bank CEO Caitlin Long https://earlybirdsinvest.com/operation-choke-point-2-0-not-over-despite-occ-easing-crypto-rules-says-custodia-bank-ceo-caitlin-long/ https://earlybirdsinvest.com/operation-choke-point-2-0-not-over-despite-occ-easing-crypto-rules-says-custodia-bank-ceo-caitlin-long/#respond Mon, 10 Mar 2025 21:38:09 +0000 https://earlybirdsinvest.com/operation-choke-point-2-0-not-over-despite-occ-easing-crypto-rules-says-custodia-bank-ceo-caitlin-long/

A top US regulator’s recent easing of its stance on crypto doesn’t mean that the US government’s crusade against the industry is over, according to Custodia Bank CEO Caitlin Long.

Late last week, the Office of the Comptroller of the Currency (OCC) announced that banks in the US could now go ahead with a range of crypto services, including custody and certain stablecoin activities.

Said Acting Comptroller of the Currency Rodney E. Hood,

“Today’s action will reduce the burden on banks to engage in crypto-related activities and ensure that these bank activities are treated consistently by the OCC, regardless of the underlying technology. I will continue to work diligently to ensure regulations are effective and not excessive, while maintaining a strong federal banking system.”

However, Long says that Operation Choke Point 2.0 – a term commonly used to describe the US government’s covert agenda to stifle the crypto industry – isn’t over unless two other US regulators abandon their unfriendly stance on digital assets.

Last December, a Freedom of Information Act (FOIA) request by the crypto exchange Coinbase found dozens of instances where the Federal Deposit Insurance Corporation (FDIC) asked banks to freeze crypto-related services.

Long also calls upon the Fed to allow Custodia – a prominent digital asset custody bank – to have a master account, or a bank account that financial institutions hold directly with the Federal Reserve.

Says Long,

“AMID ALL THE JUBILATION ABOUT the OCC news, Operation Choke Point 2.0 (OCP 2.0) isn’t over until:
1. Fed and FDIC also rescind their anti-crypto guidance, which is still in effect (Fed & FDIC were far more detrimental to crypto banking than OCC) and

2. Custodia Bank has its Fed master account.

Context: banks that wanted to serve crypto but got regulatory pressure not to (OCP 2.0) were mostly Fed and FDIC-regulated banks, not OCC-regulated. OCC’s move is a big positive an has implications on the other two agencies, but FDIC and Fed anti-crypto guidance is still in effect.“

The House Committee on Oversight and Government Reform recently requested access to unredacted documents from the FDIC to investigate allegations that banks were deliberately de-banking the crypto industry.

The FDIC has not formally answered the request.

OCC gives green light for banks to custody digital assets https://earlybirdsinvest.com/occ-gives-green-light-for-banks-to-custody-digital-assets/ https://earlybirdsinvest.com/occ-gives-green-light-for-banks-to-custody-digital-assets/#respond Sat, 08 Mar 2025 17:28:53 +0000 https://earlybirdsinvest.com/occ-gives-green-light-for-banks-to-custody-digital-assets/

The Office of the Comptroller of the Currency (OCC), the US regulatory body responsible for overseeing national banks, issued a significant clarification on Friday regarding crypto activities. The OCC announced that banks are now permitted to engage in certain crypto-related operations without seeking prior regulatory approval, giving the green light for banks to custody digital assets.

The OCC statement outlined specific crypto activities that national banks can now undertake, including crypto-asset custody services, certain stablecoin operations, and participation in distributed ledger networks, enabling them to become validators on public Proof-of-Stake networks.

The announcement marks a step change in this administration’s regulatory approach, eliminating the requirement that banks obtain advance permission from regulators before engaging in these activities.

Under Biden, bank personnel were required to inform their supervisors about planned crypto activities, demonstrate their risk management strategies, and ensure there were no objections from supervisory bodies. The OCC also withdrew its previous statements that cautioned banks against engaging with the crypto sector. Acting Comptroller Rodney Hood affirmed:

“The OCC expects banks to have the same strong risk management controls in place to support novel bank activities as they do for traditional ones. Today’s action will reduce the burden on banks to engage in crypto-related activities and ensure that these bank activities are treated consistently by the OCC, regardless of the underlying technology. I will continue to work diligently to ensure regulations are effective and not excessive while maintaining a strong federal banking system.”

“Biggest news of the day,” commented Nic Carter, partner at Castle Island Ventures and the cofounder of blockchain data aggregator Coinmetrics.io. “Goodbye, Operation Chokepoint 2.0,” posted Alexander Grieve, VP of Government Affairs at Paradigm.

This announcement coincided with the White House Crypto Summit and followed President Donald Trump’s executive order establishing a strategic reserve for Bitcoin and other select cryptocurrencies.

Despite the bullish news for the crypto sector, Custodia Bank founder and Wyoming Blockchain Task Force member Caitlin Long cautioned that Operation Chokepoint 2.0 would not be over until the Federal Reserve and the Federal Deposit Insurance Corporation (FDIC) also rescinded their detrimental anti-crypto guidance, and Custodia Bank is awarded its Fed master account.
