Federal authorities are challenging the outcome of a sentencing decision involving two Estonian citizens who admitted to running a large-scale crypto mining scam.

The appeal, submitted to the Ninth Circuit Court of Appeals, disputes both the judge’s final order and the process that led to it.

Estonians Sergei Potapenko and Ivan Turõgin had previously admitted to organizing a fraudulent crypto operation that raised over half a billion dollars. The scam sold fake mining contracts under the HashFlare brand between 2015 and 2019.

According to the investigation, the two displayed false profit data to users via online dashboards, despite not having the mining equipment they had advertised.

In February, both men pleaded guilty to conspiracy charges related to this activity. Prosecutors argued that they tricked around 440,000 individuals across the world and requested prison terms of 10 years for each of them.

However, on August 12, Judge Robert S. Lasnik issued “time served”, along with three years of supervised release and fines of $25,000 each.

The judge explained that the court had taken into account the possibility of transferring the sentence to Estonia, where both defendants would serve their time.

He noted that if the transfer request was denied, the two might end up with longer sentences and be held in immigration custody indefinitely after serving time in the US.

Japan’s top financial regulator, the Financial Services Agency (FSA), is preparing to allow the first stablecoins tied to the yen later in 2025, according to a report by The Nihon Keizai Shimbun.

If approved, it would be the first time a yen-pegged digital currency is officially recognized in the country.

The first launch is expected to come from JPYC, a fintech company based in Tokyo. According to Japanese outlet Nikkei, JPYC will register as a money transfer business within the month. Once that process is complete, the company will begin rolling out its tokens.

Each JPYC token will match one yen in value. To keep this link steady, the firm plans to back its coins with secure reserves, including commercial bank deposits and Japanese government bonds.

After individuals or businesses apply to purchase, payment will be made through bank transfer, and the stablecoins will then be sent to digital wallets.

Okabe, a representative of JPYC, has argued that yen-backed coins could influence the government bond market. In the US, leading stablecoin firms hold large amounts of Treasury bills as reserves.

If JPYC grows in scale, he suggested a similar pattern could appear in Japan, with higher demand for Japanese government bonds (JGBs).

He also cautioned that countries moving too slowly on stablecoin regulation may face rising borrowing costs, since they miss out on this new type of institutional demand.

UK retail investors will be able to buy exchange-traded notes (ETNs) linked to cryptocurrencies starting October 8, according to an August 1 announcement by the Financial Conduct Authority (FCA).

This is the first major change since the FCA banned crypto ETNs and derivatives for retail customers over concerns about high risk and unclear benefits.

David Geale, executive director for payments and digital finance at the FCA, said, “Since we restricted retail access to cETNs, the market has evolved, and products have become more mainstream and better understood”.

This change does not apply to crypto derivatives, such as futures or options. These products remain unavailable to retail investors in the UK. The FCA said it will keep watching how these markets develop and may adjust its position in the future.

The regulator noted that it plans to continue reviewing all high-risk investment products. It also reminded firms offering crypto ETNs to meet their rules for clear information, fair pricing, and customer protection.

Crypto ETNs differ from exchange-traded funds (ETFs). While ETFs hold the actual digital assets they track, an ETN is a type of debt.

The Austrian platform Bitpanda explained, “Instead of equity in the fund, each traded note of an ETN represents an obligation from a legal entity holding the underlying asset as collateral”.

On July 22, the US Securities and Exchange Commission (SEC) approved Bitwise’s plan to turn its cryptocurrency index fund into an exchange-traded fund (ETF), only to stop the process later in the same day.

The SEC’s Division of Trading and Markets gave what it called “accelerated approval” for the Bitwise 10 Crypto Index Fund to change its structure to an ETF.

This type of approval would have let Bitwise ask the SEC to make its registration effective sooner than usual.

However, that approval did not stand for long. SEC Assistant Secretary Sherry Haywood said the order was “stayed until the Commission orders otherwise” and confirmed that the Commission itself would review the decision.

Bloomberg ETF analyst James Seyffart stated on X that the fund “cannot actually convert it into an ETF yet” because it had been” held up by either one or multiple commissioners”.

He added that the SEC acted earlier than expected, as a decision wasn’t due until next week.

Scott Johnsson, a partner at Van Buren Capital, also shared on X that the approval came “under delegated authority” and speculated this was done to avoid interference from Caroline Crenshaw, the sole Democrat on the SEC.

He also suggested the pause might be a way for the agency to stretch the standard 240-day review period.

A group of Spanish lawmakers wants the country’s financial top regulator to force crypto to carry “traffic light”-style risk warnings.

The Spanish news agency EFE (via MSN ) reported that the Sumar group of MPs wants the National Securities Market Commission (CNMV) to use the system for retail investors.

The group says that the system would let users “clearly and visually” identify the type of asset they are purchasing.

Sumar has sent a written proposal to the regulator. The group complained that a “significant portion” of tokens traded on crypto exchange platforms “lack material backing or any underlying value.”

Traffic Light Crypto Warnings Coming to Spain?

The parliamentary group also wants to rename cryptoassets like Bitcoin (BTC) and Ethereum (ETH).

It proposes using terms like “crypto bets” or “unbacked assets.” The lawmakers justified their request by explaining that coins “do not grant their owners any rights to tangible assets or have any connection to productive activities.”

The traffic light warning system would see the CNMV apply one of three labels to each cryptoasset on an exchange or bank’s investing platform.

  • The regulator would give a green light to cryptoassets that are registered, supported, and supervised. These coins would also need to demonstrate stable market performance.
  • It would use yellow for cryptoassets that have “limited backing” or display moderate volatility.
  • An orange light would identify “unsupervised” coins with high risk levels.
  • And a final red label would be reserved for “speculative assets with no identified issuer or material backing.”

Crypto Concentrates Wealth, Say Lawmakers

Sumar said it is wary of “extreme forms of fictitious capital that do not generate value, but rather generate volatility, inequality, and wealth concentration.”

He added that crypto trading is often more similar to betting than to investing. Furthermore, Sumar wants the CNMV to force banks and exchanges to ensure their customers read pre-purchase information on cryptoassets before allowing them to buy coins.

This should apply regardless of a token’s individual classification, Sumar said. It added that these mandatory warnings must be clearly summarized and contain visual elements.

Sumar suggested that the CNMV use prominent warning systems. It said the regulator should base its models on those already used in sectors such as gambling or tobacco sales.

Restrict Access to AI-powered Trading, MPs Urge

Sumar lawmakers also want to create specific regulations for algorithmic trading pools. And the group wants to restrict retail investors’ access to trading platforms that use AI or algorithms.

Sumar is a left-wing coalition comprising 20 parties that was first formed to run in the July 2023 general elections.

Although it does not have a representation in the Senate, it has 31 lawmakers in the lower house, the Congress of Deputies. It makes up one of the 11 political blocs in Prime Minister Pedro Sánchez’s ruling coalition.

The decision would enable the firm to directly manage the reserves backing USDC and operate under the supervision of a single federal regulator, the Office of the Comptroller of the Currency (OCC).

If the OCC approves the plan, Circle would launch First National Digital Currency Bank, NA, a federally regulated trust company. Unlike traditional banks, this type of institution cannot make loans or take cash deposits, according to a report by Reuters.

Instead, it focuses on storing and protecting assets, such as the dollar reserves tied to USDC. The trust bank would also be able to provide custody services to large clients, including other financial institutions.

Circle said this new setup would help it meet the requirements of the GENIUS Act, a stablecoin regulation bill that recently passed in the US Senate and is being considered in the House of Representatives.

In a statement, Circle’s co-founder and CEO, Jeremy Allaire, said the company is working to strengthen the foundation of USDC. He explained that the trust bank would support Circle’s efforts to build a digital financial system that is open, reliable, and follows US regulations.

Allaire added that this decision could help expand the use of the dollar globally by giving institutions more secure ways to use stablecoins.

Last Thursday, I took my son to the Rose Center for Earth and Space at New York’s Museum of Natural History. In the Hayden Planetarium, we watched a simulation of the Milky Way bloom above us, while the actor Pedro Pascal — who truly is everywhere — narrated the galactic dance unfolding on the screen.

It was breathtaking. But it didn’t compare to what was blasted around the world just a few days later, as the new Vera C. Rubin Observatory began broadcasting its “first light” — its inaugural images of the cosmos. I found myself pinching-to-zoom through a picture that contains roughly 10 million galaxies in a single frame, a vista so vast it would take 400 4-K TVs to display at full resolution. I could hold the universe itself on my screen.

Perched 8,660 feet up Cerro Pachón in the Chilean Andes, where the crystal-clear nights provide an exceptionally clear window into space, the Vera C. Rubin Observatory began construction in 2015 with funding from the US National Science Foundation (NSF) and the US Department of Energy. Named for the pioneering astronomer Vera Rubin, whose work on galaxy rotation helped prove the existence of dark matter, the observatory was built to run a single, audacious experiment: the 10-year Legacy Survey of Space and Time.

It will photograph the entire Southern Hemisphere sky every few nights to tackle four grand goals: unmask dark matter and dark energy, inventory the Solar System’s asteroids and comets, chart the Milky Way’s formation, and capture every transient cosmic event.

What makes Rubin so special is its eye, which is a marvel. At its core is a 27-foot-wide dual mirror cast from 51,900 pounds of molten glass that is still light enough to sweep across the sky in seconds. The mirror directs a flow of light from the cosmic depths to the 3.2-gigapixel LSST Camera, a 5-by-10-feet digital jumbotron that is the largest digital camera ever made. It’s like a massive magnifying glass paired with the world’s sharpest DSLR: Together they capture a swath of the night sky equivalent to 45 full moons every 30 seconds.

And those images, which will be continuously shared with the world, are jaw-dropping. The headlining shot from Rubin’s debut, nicknamed “Cosmic Treasure Chest,” stitches together 1,185 exposures of the Virgo Cluster, our nearest major collection of galaxies, some 55 million light-years away.

But the Rubin Observatory is about much more than producing pretty cosmic wallpaper. Its unprecedented scale gives it the ability to search for answers to grand questions about space science. The NSF notes that Rubin will gather more optical data in its first year than all previous ground telescopes combined, turning the messy, ever-changing sky into a searchable movie.

It’s not just pretty pictures

As I’ve written before, the world has made great strides in planetary defense: Our ability to detect and eventually deflect asteroids that could be on a collision course with Earth. Rubin has already begun paying dividends toward that goal.

In a mere 10 hours of engineering data, its detection software identified 2,104 brand-new asteroids — including seven near-Earth objects, heavenly bodies whose orbit will bring them near-ish our planet.

That haul came from just a thumbnail-sized patch of sky; once Rubin begins its nightly scan of the whole Southern Hemisphere, it’s projected to catalog over 5 million asteroids and roughly 100,000 NEOs over the next decade, tripling today’s inventory. That will help NASA finally reach its congressionally mandated target of identifying 90 percent of the 25,000 city-killer-class NEOs (those over 140 meters) estimated to be out there.

How powerful is Rubin’s eye? “It took 225 years of astronomical observations to detect the first 1.5 million asteroids,” Jake Kurlander, a grad student astronomer at the University of Washington, told Earth.com. “Rubin will double that number in less than a year.”

The nebulae are surrounded by dense star fields and golden interstellar dust clouds. Dark filaments of cosmic dust snake through the frame, especially near the pink emission areas. The overall color palette includes warm golds, reds, cool blues, and purples, highlighting active regions of stellar birth and ionized gas.

And the images that Rubin captures will go out to the entire world. Its Skyviewer app will allow anyone to zoom in and out of the corners of space that catch Rubin’s eye, including celestial objects so new that most of them don’t have names. Looking at the app gives you a sense of what it must have been like to be one of the first human beings, gazing up at a sky filled with wonder and mystery.

Finding perspective in a pixel

It might seem strange to highlight a telescope at a moment when the world feels as if it is literally on fire. But the Vera Rubin Observatory isn’t just a triumph of international scientific engineering, or an unparalleled window on the universe. It is the ultimate perspective provider.

If you open the Virgo image and zoom all the way out, Earth’s orbit would be smaller than a single pixel. Yet that same pixel is where thousands of engineers, coders, machinists, and scientists quietly spent a decade building an eye that can watch the rest of the universe breathe, and then share those images with all of their fellow humans.

Seeing Rubin’s images brought to mind the lines of Walt Whitman’s “When I Heard the Learn’d Astronomer.”

I wander’d off by myself,

In the mystical moist night-air, and from time to time,

Look’d up in perfect silence at the stars.

On days when life on our little world feels chaotic, Rubin’s first-light view offers a valuable reminder: We’re just one tiny part in a tapestry of 10 million galaxies, looking up from our planet at the endless stars.

President Trump’s media company has been given the green light by the U.S. Securities and Exchange Commission (SEC) to invest its treasury holdings in Bitcoin (BTC).

In a press release, Trump Media says its previous registration filing with the SEC has been declared effective by the regulator on June 13th, allowing the company to move forward with a prospectus.

Trump Media previously filed with the SEC to adopt a Bitcoin treasury because it views BTC as an “apex instrument of financial freedom.”

Devin Nunes, Trump Media’s CEO and President, said that investing in BTC would “help defend our Company against harassment and discrimination by financial institutions, which plague many Americans and US firms.”

A BTC treasury would also be useful for subscription payments, a utility token and other planned transactions across the company’s subsidiaries – Truth Social and Truth+ – according to Nunes.

Says Nunes,

“We’re aggressively implementing our plans to expand the Company, our offerings, and our capabilities. By simultaneously enhancing and growing our social media platform, TV streaming platform, and our FinTech brand while establishing a Bitcoin treasury, we aim to continue rapidly transforming Trump Media into an indispensable company for the expanding customer base of the Patriot Economy.”

United States Securities and Exchange Commission (SEC) Chair Paul Atkins says the agency is considering enacting a blockchain relief framework that could see key actors allowed to offer products and services “expeditiously.”

Speaking at SEC headquarters for the Crypto Task Force’s final roundtable in its “Spring Sprint Toward Clarity” program, Atkins suggested that the federal regulator may offer an immediate innovation-friendly framework with regard to the blockchain sector as a whole.

“While the Commission and its staff work to propose fit-for-purpose rules of the road for on-chain financial markets, I have directed the staff to consider a conditional exemptive relief framework or ‘innovation exemption’ that would expeditiously allow registrants and non-registrants to bring on-chain products and services to market,” Atkins said.

“An innovation exemption could help fulfill President Trump’s vision to make America the ‘crypto capital of the planet’ by encouraging developers, entrepreneurs, and other firms that are willing to comply with certain conditions to innovate with on-chain technologies in the United States,” he added.

The newly confirmed SEC head also criticized the agency’s previous regulatory stance toward digital assets under then-chair Gary Gensler, stating that the regulator “must adopt a regulation based on the authority that Congress has given us.”

“The prior U.S. government administration discouraged Americans from participating in these market-based systems by asserting through lawsuits, speeches, regulation, and threatened regulatory action that participants and staking-as-a-service providers may be engaged in securities transactions,” he said.

SEC Shifts Toward Crypto-Friendly Stance

Atkins’ latest remarks come as the SEC undergoes major transformation under the Trump administration, shifting away from its regulation-by-enforcement strategy to a more crypto-friendly approach to the digital asset sector.

In the past few months alone, the commission has dropped several high-profile lawsuits against key players in the crypto industry, including Coinbase, Ripple, and Robinhood Crypto.

However, it is still unclear what a crypto regulatory framework will look like in the years to come.
