A bank employee is pleading guilty to stealing from the lender’s customers and lying to conceal her guilt, according to the US Attorney’s Office for the Eastern District of Virginia.

The Eastern District says Truist Bank employee, Ahshah Dior Martin, stole $195,000 from at least 70 Truist Bank accounts.

Martin started gathering banking information on her would-be victims in 2023 after improperly accessing the bank’s computer systems.

“Then, she initiated fraudulent debits and withdrawals from these accounts for her own benefit. For instance, Martin repeatedly initiated payments from customer bank accounts to a child support payment processor, through which Martin paid herself.”

The victims Martha stole from while working at Truist Bank were diverse and comprised of both individuals and entities, according to the Eastern District. They included “multiple churches, a children’s museum, an eye tissue bank non-profit organization, manufacturing and construction companies, a small business making customized holsters, and the North Carolina Wing of the Civil Air Patrol.”

Truist Bank fired Martin in April of 2024 but she frustrated efforts by the eighth-largest US bank by total assets to retrieve the computer she had been issued at work.

“To conceal her wrongdoing and prevent the return of her Truist laptop, Martin faked her own death. On April 17, 2024, in response to an email from Truist asking for the computer, Martin responded, “Sorry to inform you, she has passed away.””

The former Truist Bank employee spent the money she stole on “cosmetic products, clothing, travel expenses, dining, and at a hookah bar,” the Eastern District says.

Martin faces up to three decades in prison. She will be sentenced in November.

Grok refuses to pick winner for Crypto Rover competition citing ZachXBT pump and dump evidence https://earlybirdsinvest.com/grok-refuses-to-pick-winner-for-crypto-rover-competition-citing-zachxbt-pump-and-dump-evidence/ https://earlybirdsinvest.com/grok-refuses-to-pick-winner-for-crypto-rover-competition-citing-zachxbt-pump-and-dump-evidence/#respond Mon, 21 Jul 2025 09:05:58 +0000 https://earlybirdsinvest.com/grok-refuses-to-pick-winner-for-crypto-rover-competition-citing-zachxbt-pump-and-dump-evidence/

X’s Grok chatbot declined to select a winner for a $1,000 Ethereum giveaway organized by crypto influencer Crypto Rover, citing prior allegations of pump-and-dump activity detailed by on-chain investigator ZachXBT.

In replies to users participating in the weekend contest, Grok stated it was abstaining from choosing a winner due to “substantiated reports” implicating Rover in schemes that could compromise community safety.

The messages are now unavailable but circulated in screenshots showing Grok referencing ZachXBT’s findings and calling for caution. The interaction stemmed from a routine promotional giveaway in which Rover, who posts under @rovercrc and has over 1 million followers, invited users to like, repost, and follow his account for a chance to win the prize.

As ZachXBT reported, the allegations center on a project Rover was contracted to promote in May 2023. The deal included a $10,000 payment, a percentage of the project’s token supply.

According to the investigation, Rover made no promotional posts as agreed and later claimed he would delay content until “better market conditions,” while threatening legal action against the project’s team for attempting to call him out.

ZachXBT linked Rover’s wallet activity to subsequent token sales, generating roughly 40 ETH in profits. The funds were routed to a known Bybit deposit address previously associated with Rover.

The probe also identified 10 fresh wallets tied to the same promotional period that accumulated 9 percent of the token’s supply shortly before Rover posted about the asset. The project team behind the meme coin ceased communications shortly after, with no further updates beyond May 2023. In previous posts, Rover reportedly stated he could “pump projects from half a million to ten million easy,” a remark ZachXBT highlighted as part of a broader pattern of manipulative behavior.

Rover did not publicly address Grok’s specific decision and has continued to tag Grok for his next giveaway.

Not all of Grok’s responses refused to engage with Crypto Rover. Many replies to Crypto Rover and his followers affirmed that the bot would select a winner for the giveaway. However, per the latest posts, none was chosen by the bot.

Grok, developed by xAI, has previously drawn scrutiny for its erratic output, including unverified claims and inflammatory responses, though its creators position it as a “maximally truth-seeking” assistant.

ZachXBT’s forensic investigations have become a fixture in crypto accountability circles, with previous work cited in law enforcement actions and asset recoveries totaling over US $210 million, per a 2024 Wired profile.

Can Nvidia Stock Hit New Heights? To say that investors were on the edge of their seats ahead of Nvidia‘s (NVDA -0.27%) highly anticipated financial report may well be an understatement. As the poster child for the artificial intelligence (AI) revolution, the company has become the benchmark for the tech industry at large and the yardstick by which progress in AI is being measured.

While the chipmaker delivered better-than-anticipated results on both the top and bottom lines, there were a few blemishes in what would have been an otherwise spotless report.

Let’s take a look at what the results reveal, and if they give us any insight into the future of AI.

Paint by numbers

Investors had high hopes ahead of Nvidia’s fiscal 2026 first quarter (ended April 27), and the AI chipmaker delivered. The company generated record revenue of $44.1 billion, up 69% year over year and 12% quarter over quarter. This drove adjusted earnings per share (EPS) of $0.81, which climbed 33%.

For context, analysts’ consensus estimates were calling for revenue of $43.25 billion and EPS of $0.75, so Nvidia sailed past expectations with some wiggle room.

Fueling the bullish results was a record-setting performance from the data center segment, which continues to drive growth. The segment — which includes processors used for data centers, AI, and cloud computing — generated revenue that surged 73% year over year to $39.1 billion, driven by continuing demand for AI.

One item of note was the Trump administration’s tightening export restrictions. Nvidia’s H20 processor was originally designed to meet the already rigid requirements for AI chips destined for China. However, demand evaporated thanks to the new, more stringent licensing requirements, causing Nvidia to take a $4.5 billion charge in Q1 — though that was lower than the $5.5 billion estimate the company provided last month.

The impact of the move trickled its way down the financial statements. For example, if not for the write-off, Nvidia’s adjusted EPS would have clocked in at $0.96, resulting in a hit of about $0.15 per share.

However, as revenue jumped 69%, operating expenses climbed just 44%, sending more to the bottom line and helping blunt the impact of the lost sales to China. Nvidia’s cash stockpile has grown over the past year, with cash and marketable securities of $53.7 billion, an increase of 71%. Free cash flow of $26.1 billion soared 75%.

CEO Jensen Huang provided commentary about the future of the AI revolution, and the rock star chief executive didn’t mince words:

Global demand for Nvidia’s AI infrastructure is incredibly strong. AI inference token generation has surged tenfold in just one year, and as AI agents become mainstream, the demand for AI computing will accelerate. Countries around the world are recognizing AI as essential infrastructure — just like electricity and the internet — and Nvidia stands at the center of this profound transformation.

This pronouncement, combined with the company’s robust business performance, helped drive Nvidia stock higher in after-hours trading, with shares up more than 4% (as of this writing).

The tariffs wild card

Management expects the company’s growth spurt to continue. Nvidia is guiding for record second-quarter revenue of $45 billion, which would represent year-over-year growth of 50%. This was largely in line with Wall Street’s consensus estimates, but the devil is in the details. The number includes a loss of approximately $8 billion in its fiscal Q2 revenue from the H20 chips, thanks to the more stringent export requirements.

Despite the hit to its growth, investors remain bullish on Nvidia stock. Shares are currently selling for roughly 32 times next year’s expected earnings. While that’s a modest premium, it’s still an attractive price to pay for a company expected to grow its profits by 39% this fiscal year and 35% in its fiscal 2026 — even after the hit to China sales.

Nvidia CFO Colette Kress revealed, “Large cloud service providers remained our largest [customers] at just under 50% of data center revenue.” A quick calculation reveals that 44% of Nvidia’s total revenue is currently dependent on the world’s largest cloud infrastructure providers, including Amazon Web Services, Microsoft‘s Azure Cloud, and Alphabet‘s Google Cloud. Honorable mention goes to Meta Platforms, which has also significantly scaled up capital expenditures (capex) to build out its data centers.

As evidenced by Nvidia’s results, the data center build-out continues, and the world’s largest tech companies and cloud providers have telegraphed their intention to continue the heavy spending that has characterized the build-out of AI infrastructure. Nvidia continues to dominate the data center GPU market, with more than 90% of the market.

For long-term investors, this quarter is one data point in a long track record of impressive execution. Nvidia remains at the heart of the AI revolution, which illustrates that the stock likely has much higher to go from here. It continues to be one of my highest-conviction stocks.

SDNY evidence withholding will undermine accusations against Samourai’s wallet https://earlybirdsinvest.com/sdny-evidence-withholding-will-undermine-accusations-against-samourais-wallet/ https://earlybirdsinvest.com/sdny-evidence-withholding-will-undermine-accusations-against-samourais-wallet/#respond Tue, 06 May 2025 02:22:48 +0000 https://earlybirdsinvest.com/sdny-evidence-withholding-will-undermine-accusations-against-samourais-wallet/

A letter submitted this morning by the defense of Samourai wallet developers Keonne Rodriguez and William Ronergan Hill revealed that the Southern District of New York (SDNY) had suppressed clear evidence in criminal cases.

According to the filing, the prosecution had consulted Fincen about the feasibility of bringing in unauthorized money transmission fees for non-mandatory services before the developer charged them.

“Mixers like Samourai, who own private keys and do not detain cryptocurrency, strongly suggest that Samourai is not acting as an MSB,” Finsen told prosecutors.

In internal communications, the prosecutor says it could lead to fees based on “functional controls” of the code, perhaps referring to Samourai’s control over the user interface and the coin join server of the Samourai wallet. Prosecutors said such arguments were “never addressed in the guidance,” and admitted that “that could be a difficult argument.”

Communication between Fincen and SDNY was revealed following the so-called Brady request, ordering the government to hand over evidence that could exonerate the accused developer.

The government will need to hand over the evidence exempted to the defense two weeks after filing the latest indictment. The later disclosure of such highly relevant material may mislead the courts, arguing that the letters have an impact on both the bail requirements imposed on the developer and the tendency of judges to refuse to file a motion for rejection.

The defense is currently seeking a hearing to determine potential remedies for SDNY’s actions, including the dismissal of the charges.

“It’s hard to imagine a clear example of “prosecutorial regulation” than what we have here,” said the defense, referring to the recent Blache memo. “The relevant regulators telling prosecutors that Samourai’s wallets are not gold senders have indicted the same general guidance that Rodriguez and Hill relied on to guide their actions, and prosecutors have stepped forward and run a money services business that is not exempt anyway.”

Fincen’s attitude towards non-lawful service providers shared with SDNY echoes 2019 guidance. This states that “cryptocurrency wallet providers will be classified as transmitters if the host is completely independent of their value (contractually mandated to access value only from the owner.”

Advocacy groups and legal scholars have long argued that the prosecution of Samourai wallet developers and the prosecution of tornado cash developers Roman Storm and Rome Semenov are clear violations of Finsen guidance.

Samourai’s Brady Request was successful, but a similar request was rejected last year to try to disclose to the government that it contains “materials that have not yet been produced from materials received from OFAC and Fincen (substantial communications with these agencies).

As Storm points out in X, he was arrested the same day he consulted the prosecutor of Samourai Wallet about the feasibility of unauthorized money transmission fees, making it seem that SDNY is even more aware of the spread of that charge throughout Storm’s prosecution.

“Fincen explicitly informed SDNY prosecutors that no remittance license is required for Samourai Wallet’s non-mandatory design, but the DOJ has indicted the developer. “The prosecutor exemplifies regulations through criminal prosecution, directly opposes the directions of the AG Blanche Deputy Bureau, and undermines the Trump administration’s crypto policy.”

“Brady Violation,” wrote JW Verret, an anti-money laundering expert, in X.

“The fact that the prosecutor attempted to withhold this information from the defense is a serious ethical violation and could lead to a case,” Verret told Bitcoin Magazine. “That’s if the DOJ doesn’t drop it all together, given that the main justice effectively ordered such cases to be removed.”

“Like we said,” writes Peter Van Valkenburgh of Conicenter in X.

“If they are not a remittance under Fincen’s guidance, the defense said in the letter.

Do Kwon’s Legal Battle Drags On with More Evidence in Play https://earlybirdsinvest.com/do-kwons-legal-battle-drags-on-with-more-evidence-in-play/ https://earlybirdsinvest.com/do-kwons-legal-battle-drags-on-with-more-evidence-in-play/#respond Sun, 09 Mar 2025 20:05:52 +0000 https://earlybirdsinvest.com/do-kwons-legal-battle-drags-on-with-more-evidence-in-play/

Manhattan Judge Paul Engelmayer has postponed a court hearing for former Terraform Labs CEO Do Kwon, allowing both sides more time to review new evidence.

Originally set for March 6, the hearing has been pushed to April 10.

The delay follows a request from prosecutors, who informed the court that they would soon provide an additional four terabytes of evidence. This new material includes records from electronic accounts, as well as documents from various third parties.

Prosecutors had previously shared 600 gigabytes of data with Kwon’s defense team. These files included information from four cell phones previously owned by Kwon, along with emails from his personal and business accounts. Other materials include documents related to his extradition, statements he made to US regulators, and records of cryptocurrency transactions.

Despite this delay, Kwon’s trial is still scheduled to begin on January 26, 2026. The court has set a July 1, 2025, deadline for pretrial motions, with responses due by August 11, 2025.

Kwon was extradited to the US in December 2024 after being arrested in Montenegro in March 2023. He was caught attempting to board a flight to Dubai using a fake Costa Rican passport, which led to a four-month prison sentence.

After his release, authorities approved his transfer to the US, where he appeared before a judge on January 2, 2025.

More Trouble For Do Kwon? Hearing Delayed As New Piles Of Evidence Surface https://earlybirdsinvest.com/more-trouble-for-do-kwon-hearing-delayed-as-new-piles-of-evidence-surface/ https://earlybirdsinvest.com/more-trouble-for-do-kwon-hearing-delayed-as-new-piles-of-evidence-surface/#respond Wed, 05 Mar 2025 11:12:04 +0000 https://earlybirdsinvest.com/more-trouble-for-do-kwon-hearing-delayed-as-new-piles-of-evidence-surface/

The legal troubles of Do Kwon are far from over. A US federal judge has postponed his court hearing, originally set for March 6, after prosecutors uncovered a massive amount of new evidence.

With four terabytes of additional data now in play, the case against the Terraform Labs co-founder is becoming even more complex.

Massive Data Dump Forces Delay

Prosecutors have handed over 600 gigabytes of data to Kwon’s defense team so far. This includes materials from his phones, emails, and other electronic accounts. But now, with four terabytes of new evidence to examine, both sides need more time to prepare.

The court has pushed the hearing date to April 10 to allow prosecutors to sort through the files and the defense to review what could be critical information. The judge’s decision reflects the size of the data and its potential impact on the case.

Key Deadlines Before Do Kwon Trial

This delay has not changed the date of the trial—January 26, 2026. Both sides have until July 1 to submit pretrial motions; the deadline for reply is August 11. These filings most certainly will affect the arguments put up in court and during the trial.

After the prosecutors stated in a letter dated February 27 that they expected to produce an extra 4 gigabytes of discovery to the defense by the end of next week, Judge Paul Engelmayer delayed a hearing scheduled for March 6 to April 10 in an order dated March 3.

After January 2025 pleading not guilty to nine felony fraud charges, Kwon enters a protracted legal fight. As the case develops, his defense team will work to refute the evidence and assertions of the prosecution.

The Collapse Of Terra And Kwon’s Arrest

Terraform Labs, the company Kwon co-founded, collapsed in May 2022. The failure of its algorithmic stablecoin, TerraClassicUSD (USTC), wiped out $60 billion in market value. The fallout led to widespread losses, investigations, and lawsuits.

BTCUSD trading at $88,335 on the daily chart: TradingView.com

After the collapse, Kwon moved between Singapore and Dubai before being arrested in Montenegro in March 2023 for using a fake passport. He served a four-month sentence there before being extradited to the US in December 2024.

What’s Next For Do Kwon?

With the case growing more complicated, Kwon’s future remains uncertain. The addition of four terabytes of evidence raises new questions about the strength of the prosecution’s case. If this material contains damning information, it could be bad news for Kwon.

For now, all eyes are on the upcoming hearing in April. The extra time may help both sides prepare, but it also signals that the legal battle over Terraform Labs is far from finished.

US court delays Do Kwon hearing as prosecutors unveil 4 terabytes of evidence https://earlybirdsinvest.com/us-court-delays-do-kwon-hearing-as-prosecutors-unveil-4-terabytes-of-evidence/ https://earlybirdsinvest.com/us-court-delays-do-kwon-hearing-as-prosecutors-unveil-4-terabytes-of-evidence/#respond Tue, 04 Mar 2025 21:58:13 +0000 https://earlybirdsinvest.com/us-court-delays-do-kwon-hearing-as-prosecutors-unveil-4-terabytes-of-evidence/

A US federal court has postponed a key hearing in the case against Terraform Labs co-founder Do Kwon after prosecutors submitted an extensive amount of new evidence, significantly broadening the case.

According to court filings, the status conference, originally scheduled for March 10 in the Southern District of New York, has been pushed to April 10.

Hearing delayed

Prosecutors argued that the defense requires additional time to analyze the newly provided four terabytes of discovery. The court concurred, citing the “voluminous discovery” as justification for the delay.

Court documents indicate that on Feb. 27, the US government handed over 600 gigabytes of evidence to Kwon’s legal team, including data from his cellphones, emails, and crypto transactions.

Authorities now intend to provide an additional four terabytes of discovery by next week.

Despite the postponement, the jury trial remains scheduled for Jan. 26, 2026. Additionally, victims of the Terraform Labs collapse have until April 30 to submit claims for financial losses.

The delay in Kwon’s case introduces further complexity to an already high-profile legal battle. With an immense volume of discovery materials now under review, his defense team must navigate a challenging process ahead of trial.

Federal prosecutors allege that Kwon knowingly misrepresented the stability of Terraform’s ecosystem, leading to one of the most significant financial downturns in crypto history.

Meanwhile, Kwon continues to deny any wrongdoing and claims that the market downturn was unforeseen rather than the result of fraudulent activity.

SEC case

Kwon, who was extradited from Montenegro to the US on Dec. 31, 2024, entered a not guilty plea on Jan. 2 to multiple fraud-related charges. His case stems from the collapse of Terraform Labs’ algorithmic stablecoin, TerraUSD, which resulted in roughly $40 billion in investor losses in 2022.

Kwon’s extradition followed a prolonged legal battle between authorities in Montenegro, South Korea, and the US. Terraform Labs has also faced scrutiny from the Securities and Exchange Commission (SEC), which has accused Kwon of orchestrating a large-scale crypto fraud.

In April 2024, a jury found Do Kwon and Terraform Labs liable for defrauding investors in crypto asset securities. The SEC had argued that Kwon and his company misrepresented the stability of their ecosystem, leading to significant investor losses.

Following the jury’s verdict, the SEC filed a motion requesting $5.3 billion in disgorgement and civil penalties against Terraform Labs and Do Kwon. This amount was described as a “conservative” but “reasonable approximation” of the ill-gotten gains from the alleged fraud.

The court ultimately imposed a $4.5 billion fine on both Kwon and Terraform Labs.
