The US Securities and Exchange Commission (SEC) received a request from Andreessen Horowitz (a16z) and the DeFi Education Fund (DEF) asking the agency to create a “safe harbor” for certain blockchain applications.

The proposal targets non-fungible token (NFT) platforms and some decentralized finance (DeFi) tools.

It argued that these projects should not automatically fall under broker-dealer, exchange, or clearing-agency registration rules.

The groups addressed their letter to Commissioner Hester Peirce, who leads the SEC’s Crypto Task Force. The request follows a call from the Working Group on Digital Assets, formed under President Donald Trump, that encouraged regulators to consider relief for certain DeFi providers.

Recently, the SEC and private plaintiffs have sued firms accused of operating as unregistered intermediaries. Names cited in public filings include Cumberland DRW, Coinbase

The letter proposed that only those apps that do not pose risks the Exchange Act’s broker-dealer rules were meant to address should qualify for the safe harbor. Services that function like core intermediaries or that present a risk to investors would remain fully subject to the SEC’s oversight and enforcement.

The organizations said a safe harbor would provide three practical benefits. First, it would draw a clearer line between products that must register and those that do not. Second, it would preserve the SEC’s authority to act against high-risk behavior. Third, it would reduce legal uncertainty for teams in the United States.

The DeFi Education Fund (DEF), a policy advocacy group backed by an early Uniswap grant, has called on the US Senate Banking Committee to take a more measured approach to DeFi regulation.

In a formal response to the draft Responsible Financial Innovation Act of 2025 (RFIA), DEF and a coalition of top crypto firms outlined a framework they believe can safeguard innovation without undermining national security or consumer protections.

DEF Calls for Clear DeFi Rules, Developer Protections in Senate Response

The DEF’s response pushes for four key pillars, including distinguishing between DeFi developers and intermediaries, defining which entities are required to register with federal authorities, setting decentralization criteria, and ensuring technology-neutral rulemaking.

These suggestions come amid the Senate’s call for public feedback on the RFIA, which builds on the earlier CLARITY Act.

Lawmakers say they aim to strike a balance between market growth and financial oversight, but DEF argues that a nuanced understanding of decentralized systems is essential.

One of the more urgent issues raised in the letter involves the ongoing federal case against Tornado Cash developer Roman Storm.

DEF criticizes current FinCEN guidance used in the prosecution, warning that treating non-custodial software code as a financial service sets a dangerous precedent.

“Software that does not take custody or control should not be regulated as an intermediary,” DEF states, urging legislative clarification.

The coalition also emphasized the need for federal preemption to override conflicting state laws.

According to DEF, without preemption, well-funded traditional financial players could exploit state-level loopholes to target DeFi developers and suppress emerging competition.

Andreessen Horowitz Flags Gaps in Draft Crypto Bill

On Thursday, Andreessen Horowitz (a16z) also urged US lawmakers to revisit and revise the draft crypto regulation bill, warning that the current proposal could open legal loopholes and weaken investor protections.

While the draft seeks to clarify the regulatory landscape for digital assets, a16z argues that the framework as written poses legal and structural risks, especially around the treatment of “ancillary assets.”

Ancillary assets refer to digital tokens sold alongside investment contracts, typically without providing buyers with equity, dividends, or governance rights.

a16z said using this category as the foundation for new legislation “without significant modifications” is problematic.

The firm believes this structure contradicts the Howey test, which is the longstanding legal standard for determining whether an asset qualifies as a security under U.S. law.

“Rewriting Howey,” the letter stated, “would depart from settled law and endanger investor protections.”

Instead, a16z supports the CLARITY Act’s narrower definition of “digital commodities” and recommends codifying a control-based decentralization model.

This would assess whether any party retains unilateral control, operational, financial, or governance, over a blockchain system.

According to the firm, decentralization should mark the point at which an asset transitions from a security to a commodity.

US Securities and Exchange Commission (SEC) Chair Paul Atkins showed openness to allowing cryptocurrencies in 401 (k) retirement plans for Americans, but highlighted the need for responsible disclosure.

During a Bloomberg interview published Friday, Atkins did not rule out allowing cryptocurrencies into 401 (k) plans. Still, he emphasized that education on the risks associated with such an investment is crucial.

“Disclosure is key and that people need to know what they are getting into,” Atkins said when asked about the potential inclusion of crypto into 401 (k) plans. Still, he added that he looks “forward to whatever may come out from the president.”

US President Donald Trump is reportedly set to sign an executive order that could allow 401(k) retirement plans to invest in assets other than stocks and bonds, such as cryptocurrencies. In April, Alabama Senator Tommy Tuberville said he would reintroduce a bill he sponsored in May 2022 that would scale back regulations on the types of investments used in 401(k) retirement plan fiduciaries.

A 401(k) is a US employer-sponsored retirement plan that allows workers to defer part of their salary into tax-advantaged investment accounts, often with employer matching contributions.

Expectations of crypto in 401 (k) plans

Also in April, Fidelity, a financial services company with $5.9 trillion in assets under management, introduced retirement accounts that will allow Americans to invest in crypto nearly fee-free. The three new accounts are a tax-deferred traditional IRA and two Roth IRAs (one of which is a rollover) that will enable the inclusion of Bitcoin (BTC), Ether (ETH), and Litecoin (LTC).

At the end of May, the US Labor Department rescinded guidance issued during the administration of former President Joe Biden administration that limited the inclusion of cryptocurrency in 401(k) retirement plans.

“We’re rolling back this overreach and making it clear that investment decisions should be made by fiduciaries, not D.C. bureaucrats,” US Secretary of Labor Lori Chavez-DeRemer said at the time.

Welcome to The Logoff: Today, I’m focusing on the Trump administration’s decision to withhold nearly $7 billion in federal education funding.

What just happened? The Trump administration refused to release congressionally mandated funding to support a variety of education initiatives: after-school and summer programs, programs for students who are learning English, teacher training, classroom technology, and more.

The nearly $7 billion was allocated to states and local schools, and should have gone out on Tuesday. Its loss will be particularly harmful because school districts have already made plans with the assumption that the money would be there, only to have it pulled at the last minute.

What is the administration saying? The Trump administration argues the withholding isn’t a freeze and is instead because the funds are under review. But this argument is likely a fig leaf, given the administration’s opposition to the programs in question and its previous efforts to withhold funding for programs it disagrees with. What the administration appears to be doing is called impoundment — the decision not to spend money that Congress has already appropriated for a specific purpose.

Can they do that? Not really — but we’ll see how the courts rule, since the administration’s decision is almost certain to be challenged in court. Though the president can request Congress withdraw funding — and making that request would trigger a temporary freeze — the administration hasn’t done so in this case.

What’s the big picture here? The Trump administration is waging a war against the congressional power of the purse, led by Office of Management and Budget director Russ Vought (of Project 2025 fame).

The decision to withhold education funding is one of a number of efforts to wrest spending power from Congress, and recent reporting suggests the administration is considering ways to step up its attack and challenge restrictions on impoundment more broadly. If it’s successful, it will be a major expansion of Trump’s powers — and another blow to Congress’s.

My first Bitcoin, a nonprofit focused on grassroots Bitcoin education, has announced that it will receive a $1 million grant from the start. This funding will help expand efforts to provide free open source Bitcoin education to the world.

“The revolution in Bitcoin education is that it teaches students how to think and what to think,” said the founder and executive director of my first Bitcoin John Dennehy. “Funding from sources with their own incentives is the biggest vulnerability to threaten it. Education funds it. It doesn’t take away government money, it cuts funds frequently from businesses and businesses. The subtle impact of funding has ruined FIAT education.

The grant will expand its reach to first Bitcoin and provide the ability to improve tools such as Bitcoin diploma, intro courses, and teacher training workshops. It also strengthens the hub of online schools and community, making Bitcoin education more accessible to people everywhere.

This funding is not just a milestone, it is a statement. Dennehy added: “My first Bitcoin is a proof of concept for all independent Bitcoin educators. Staying on a mission makes the other side even stronger, even if it’s challenging.”

My first Bitcoin started in 2021 as a small local project. Since then, it has grown into a global movement. Over the years, the team has taught tens of thousands of students to test and refine the material based on real-world feedback.

In 2022, my first Bitcoin awarded 38 high school students in El Salvador with Bitcoin diplomas. As part of the program, students had 10 lessons including introduction to the monetary system, Fiat, financial history results, understanding Bitcoin, wallet and Bitcoin network, dual spending issues and nodes, security and mining, the value of Bitcoin, the Lightning Network and the future of Bitcoin, and the final project.

In 2023, the organization launched an independent Bitcoin Educator Node Network. It has over 65 projects in over 35 countries. These include the circular economy, meetup groups, and other local Bitcoin projects. What brings them together is a shared commitment to six core values. “Their education is independent, fair, community-driven, Bitcoin-only, quality, with a focus on empowerment rather than profit.”

“Open source money deserves open source education. Over the past few years, we have seen an increasing demand for resources around the world. We are committed to serving everyone in the Bitcoin space who needs support.”

Ripple has pledged $25 million in its RLUSD stablecoin to support US education through nonprofit organizations DonorsChoose and Teach For America.

The contribution, revealed on May 5, aims to support teachers, fund classroom projects, and expand access to essential academic resources for underserved communities across the United States.

This initiative comes at a time when concerns about the quality of education are growing. A 2024 Gallup survey found that more than half of US adults expressed dissatisfaction with K-12 education.

Ripple’s donation seeks to help close that gap by funding critical needs inside classrooms and providing extra academic support for students.

According to Ripple, the funds will be used to fulfill teacher requests, purchase supplies, and expand tutoring programs like Teach For America’s Ignite. The company also plans to support a nationwide STEM challenge to nurture innovation and problem-solving skills among young learners.

Ripple CEO Brad Garlinghouse said:

“We hope to inspire others to do the same, starting with Teacher Appreciation Week, and leading into the rest of the year to support students and teachers with the resources they need to build a stronger future for themselves and their communities.”

RLUSD’s utility meets social impact

A notable aspect of the donation is that a large portion would be disbursed in RLUSD, Ripple’s stablecoin. Based on CryptoSlate data, RLUSD currently has a market cap of over $316 million.

According to the firm, the stablecoin donation highlights the growing utility of digital assets in charitable giving, as they provide a fast and efficient channel for delivering impact where it’s needed most.

Earlier this year, Ripple contributed $50,000 in RLUSD to support wildfire response efforts in California. The funds were directed to the Los Angeles Fire Department Foundation to aid first responders in protecting communities.

These efforts align with Ripple’s broader social impact strategy, Ripple Impact. Since 2018, the company has contributed over $200 million to humanitarian efforts, educational initiatives, and blockchain training programs in over 80 countries.

The premier program, scheduled for May 27th at Venetian Expo Hall, will provide legal and financial experts with the opportunity to inform legal and financial experts about the ever-evolving regulatory environment surrounding Bitcoin.
