Brian Quintez, U.S. President Donald Trump’s nominee to run the Commodity Futures Trading Commission, published a text exchange he had with Tyler Winklevoss in his first public statement since his confirmation process appeared to stall over the summer at the White House’s direction, saying he believed that Trump “might have been misled.”

Quintenz shared a series of text messages he said he’d exchanged with Tyler Winklevoss, the co-founder and CEO of crypto exchange Gemini — which is set to go public this week — and Winklevoss Capital. Cameron Winklevoss, Tyler’s twin brother and co-founder, may have also been in the group chat, which was titled “tw-cw-bq” but did not send any messages in the screenshots shared by Quintenz. In the chat, dated July 24, Tyler Winklevoss asked Quintenz if he’d seen a post on X from June 17 where Tyler announced Gemini had filed a complaint with the CFTC’s inspector general about Division of Enforcement attorneys who had pursued charges against Gemini.

“I believe these texts make it clear what they were after from me, and what I refused to promise,” Quintenz said in his posts, representing a highly unusual move for a nominee in the midst of a federal confirmation process. “It’s my understanding that after this exchange they contacted the president and asked that my confirmation be paused for reasons other than what is reflected in these texts.”

Before the Senate left Washington for its August break, Quintenz’s nomination was set for what was thought to be an easy procedural step in the Senate Agriculture Committee to advance it to the floor for his final confirmation vote. But the White House halted that vote for reasons it didn’t make clear at the time, though Gemini co-founder Tyler Winklevoss had been waging a rhetorical campaign to stop his confirmation.

Winklevoss told CoinDesk in an interview in July that he’d been making the case that Quintenz was a bad choice because of the former commissioner’s wish to increase the CFTC budget to oversee the crypto industry, his past views on the legal liability for crypto developers and what Winklevoss characterized as Quintenz’s improper attempts to influence the CFTC on behalf of prediction market firm Kalshi.

Quintenz’s post on Wednesday suggested that, in his view, Winklevoss was upset that Quintenz did not join in criticism of CFTC’s enforcement efforts after the agency pursued charges against Gemini that were settled in January.

“I know we had spoken about this in the winter where I recalled my original extreme disappointment at [the Enforcement Division] for pursuing this so aggressively,” a text from Quintenz said. “I commit to you to having a fair and reasonable review of the matter and the division and individuals involved to determine if they acted inappropriately.”

He went on to say that a “fully confirmed chair” should be the person to handle the matter, but that if someone currently employed by the CFTC was “communicating with” the Winklevosses, he would have to “give that careful thought.”

Winklevoss asked if Quintenz was saying that Gemini should have waited to file their complaint until after the Senate confirmed the former commissioner, to which Quintenz replied that “any decision or response to your complaint should be made by and given the full weight of the confirmed chair.”

The crypto executive said they had spoken about the CFTC’s enforcement effort against Gemini after Quintenz asked for the Winklevoss brothers’ endorsement in December.

“Cultural reform, which includes rectifying what happened to us, should be the highest priority,” Winklevoss said. “I’d like to understand your thoughts on this and how you plan to align with President Trump and the administration’s mandate to end the lawfare and make amends for it.”

He added that he would “be happy to raise the issue with the president himself” if Quintenz thought he was being undermined by current CFTC employees.

Quintenz, Winklevoss and a spokesperson for Gemini did not immediately return requests for comment. CoinDesk could not independently verify the texts’ authenticity.

In July, a coalition that represented the vast majority of the crypto industry came out to press President Donald Trump to move forward to get Quintenz confirmed, calling him the “right person at the right time” to run the CFTC. Though the Senate has been back from break for a while and has returned to its confirmation work for many of Trump’s appointees, the committee hasn’t yet scheduled a follow-up vote for Quintenz

Meanwhile, Securities and Exchange Commission Chairman Paul Atkins has been pressing forward on an industry-friendly “Project Crypto” initiative while the temporary chief at the CFTC, Acting Chairman Caroline Pham has been standing in at the sister agency with a similar “crypto sprint.” The two of them have made recent joint moves to clear the regulatory path for digital assets.

Polymarket $10k bet on NASCAR race turns to $60k dispute following Zelensky controversy https://earlybirdsinvest.com/polymarket-10k-bet-on-nascar-race-turns-to-60k-dispute-following-zelensky-controversy/ https://earlybirdsinvest.com/polymarket-10k-bet-on-nascar-race-turns-to-60k-dispute-following-zelensky-controversy/#respond Sat, 26 Jul 2025 09:45:58 +0000 https://earlybirdsinvest.com/polymarket-10k-bet-on-nascar-race-turns-to-60k-dispute-following-zelensky-controversy/

A routine $10,000 prediction market on Polymarket covering Sunday’s NASCAR Cup Series race erupted into a dispute in UMA’s history after the oracle rejected an early settlement proposal, despite it being accurate.

As reported by the X user known as Domer on July 24, the clash has revived questions about how UMA’s optimistic‑oracle process balances speed, clarity, and fairness.

How a $10k market became a $60k fight

When the checkered flag fell at 6:58 p.m. ET, Denny Hamlin crossed the line first and was later confirmed as the winner following NASCAR’s post‑race inspection.

One minute after the finish, a veteran Polymarket trader, known as “GeopoliticsWizard,” posted 40 settlement proposals to UMA, one for each driver contract, paying the required 750 USDC bond on each.

Ninety minutes later, other users challenged every proposal, arguing the submitter had not waited for inspection. Under UMA’s rules, each dispute also required a 750 USDC bond.

With 40 proposals and 40 disputes, total staking ballooned to $60,000, six times the underlying market size. The ultimate split is predetermined: the winning side collects its 40 bonds ($40,000) while UMA keeps the remaining $20,000 as protocol revenue.

UMA’s published documentation does not require proposers to wait for inspections. Instead, it directs them to use an “authoritative public source.”

NASCAR’s leaderboard showed no caveats or asterisks. Even so, on-chain voters judged the submissions “Too Early,” siding unanimously with the disputers. The vote came after NASCAR confirmed Hamlin’s win at 8:26 p.m., and disputes were lodged at 8:27 p.m.

The ruling wiped out roughly $30,000 in net value for the proposer, turning a previously profitable account into a negative one, according to posts from Domer.

How UMA works

UMA uses a three‑step “propose–dispute–vote” loop. Anyone may submit a settlement answer with a bond. If unchallenged during a short liveness window, the answer becomes final.

A challenger can post an equal bond to force a token‑holder vote. The majority receives the combined bonds, while the minority forfeits theirs.

The model is designed to be fast and decentralized, yet the NASCAR case shows that costs can dwarf a market’s notional value when disputes escalate.

Earlier in July, UMA faced backlash over a $200 million Polymarket contract on whether Ukrainian President Volodymyr Zelensky would appear in a “suit.”

After initially ruling “Yes,” UMA reversed course following challenges about what qualifies as a suit, exposing how ambiguous wording can grind the oracle to a halt.

Days later, a separate Major League Baseball market erroneously paid out to the wrong team. UMA stated that a technical glitch and lack of dispute caused the mistake and promised refunds.

The bigger picture

In Domer’s view, the NASCAR episode lays bare a deeper problem: UMA’s voting base has shrunk to a small circle of “trusted” regulars whose financial incentives often align with disputers, rather than with neutral accuracy.

When Polymarket itself stays neutral, as it did here, UMA leans on these insiders for guidance, and “they comply.”

He added:

“The voting system is more centralized than ever, with a community more dormant than ever […] The group that disputed spammed the Discord heavily, so it had to be ‘Too Early’, and UMA voters did as they were told.”

Domer concluded that such dynamics turn legitimate traders into collateral damage.

Tornado Cash co-founder may seek trial delay amid witness dispute https://earlybirdsinvest.com/tornado-cash-co-founder-may-seek-trial-delay-amid-witness-dispute/ https://earlybirdsinvest.com/tornado-cash-co-founder-may-seek-trial-delay-amid-witness-dispute/#respond Thu, 10 Jul 2025 23:26:37 +0000 https://earlybirdsinvest.com/tornado-cash-co-founder-may-seek-trial-delay-amid-witness-dispute/

Tornado Cash co-founder Roman Storm’s lawyers have signaled that they may request a brief delay in his upcoming criminal trial if a judge allows testimony from a hacker who allegedly used the platform, according to July 10 court filings.

In a filing with the U.S. District Court for the Southern District of New York, Storm’s defense team asked to exclude the unnamed witness, arguing prosecutors disclosed the individual after the agreed deadline.

The witness is described as the perpetrator of an alleged hack who laundered funds through the Ethereum-based mixer to obscure trails.

According to the defense:

“[The testimony] would be unfairly prejudicial as it would likely confuse and mislead the jurors into believing that Mr. Storm was involved in the underlying purported hack or intended to facilitate it, which is not true.”

Storm’s attorneys argued the testimony could provoke “an angry response” from jurors, unfairly impacting their perception of the defendant. They reserved the right to seek a continuance if the court denies the motion to exclude.

Storm’s trial is set to begin on July 14, nearly two years after he was indicted on charges of money laundering, conspiracy to operate an unlicensed money transmitter, and conspiracy to violate U.S. sanctions. The judge is expected to rule on the witness motions by the end of this week.

Federal prosecutors have called several witnesses “victims” of Tornado Cash-enabled crimes. In a June post on social media, Storm said:

“SDNY is trying to crush me, blocking every expert witness. If I lose, DeFi dies with me.”

The developer has received strong support from the crypto community, including Paradigm founder Matt Huang, Ethereum co-founder Vitalik Buterin, and the Ethereum Foundation. Supporters have contributed considerably to his legal defense and argued that writing code should not be criminalized.

Alexey Pertsev, another Tornado Cash co-founder, was sentenced to over five years in prison in the Netherlands in 2024 for money laundering. Roman Semenov, also named in Storm’s indictment, remains at large, with reports suggesting he may be in hiding in Russia.

Storm’s trial is scheduled to begin with jury selection on Monday before Judge Katherine Failla.

OpenAI’s $6.5 Billion Deal Hits a Bump Over ‘io’ Name Dispute https://earlybirdsinvest.com/openais-6-5-billion-deal-hits-a-bump-over-io-name-dispute/ https://earlybirdsinvest.com/openais-6-5-billion-deal-hits-a-bump-over-io-name-dispute/#respond Mon, 23 Jun 2025 17:26:10 +0000 https://earlybirdsinvest.com/openais-6-5-billion-deal-hits-a-bump-over-io-name-dispute/

OpenAI has taken down online content related to its planned partnership with Jony Ive’s hardware company, io, after a court stepped in due to a trademark dispute.

The issue came up after a startup named iyO, which is building earbuds powered by artificial intelligence (AI), claimed that the name “io” was too close to its own.

A judge agreed there might be confusion and issued a restraining order, which stops OpenAI from using the name “io” in any promotional materials for now.

However, the judge did not make a final decision but said the argument had enough weight to stop OpenAI’s use of the name “io” for now.

As a result, OpenAI removed a video from its website and YouTube channel that featured CEO Sam Altman and Ive discussing their collaboration. The video was intended to showcase the friendship between the two and showcase their shared vision for a new type of hardware designed with AI in mind.

In a June 22 post on X, OpenAI said:

This page is temporarily down due to a court order following a trademark complaint from iyO about our use of the name “io”. We don’t agree with the complaint and are reviewing our options.

Despite the legal issue, OpenAI said the deal itself has not been affected. The company still plans to proceed with the acquisition of io, valued at around $6.5 billion.

On June 5, OpenAI attempted to dismiss a lawsuit filed by The New York Times, which would require the company to retain copies of all user interactions. What was OpenAI’s response? Read the full story.

OKX CEO Defends Exchange Amid Justin Sun Freeze Dispute https://earlybirdsinvest.com/okx-ceo-defends-exchange-amid-justin-sun-freeze-dispute/ https://earlybirdsinvest.com/okx-ceo-defends-exchange-amid-justin-sun-freeze-dispute/#respond Sun, 04 May 2025 11:59:54 +0000 https://earlybirdsinvest.com/okx-ceo-defends-exchange-amid-justin-sun-freeze-dispute/

OKX CEO Star Xu has responded to accusations from Tron founder Justin Sun, who claimed the exchange failed to act on a law enforcement request to freeze stolen funds linked to a hack of Tron’s official X account.

Sun alleged that OKX ignored a “freeze notice” from law enforcement following the May 3 breach, during which Tron’s X account was compromised.

The attacker reportedly posted a malicious smart contract address, sent direct messages, and engaged with unfamiliar accounts.

Justin Sun Says OKX Ignored Freeze Request

In a now-deleted post, Sun stated that the exchange had been contacted via official email but had not responded, leaving him with “no other way” to reach OKX’s compliance team.

“These stolen funds do not belong to me; I’m acting to protect the community,” Sun claimed.

Star Xu dismissed the allegations. “OKX has a consumer protection policy governed by law,” Xu wrote on X.

“We can’t freeze a customer’s funds based on your personal X post or oral communication. As the CEO of HTX, I think you should understand this.”

Xu added that OKX’s law enforcement (LE) cooperation team reviewed its email accounts, including spam folders, and found no official request related to the case.

“Our LE cooperation team just checked the email, including the spam box; we haven’t received any request related with this case,” he said.

Xu also posted a screenshot of Sun’s original deleted message and challenged him to share evidence of the alleged freeze notice, including the time and source of the request.

The incident adds to a growing list of social media hacks in the crypto space.

On March 15, Yu Hu, founder of crypto AI platform Kaito, had his account hijacked to spread false warnings about compromised wallets—shortly after attackers opened a short position in KAITO tokens.

Similarly, on Feb. 26, the Pump.fun X account was compromised to promote a fake governance token.

In another instance, UK MP Lucy Powell’s X account was hacked on April 15 to promote a scam token.

Crypto Hacks Surge in 2025 as Losses Top $1.74 Billion in Four Months

Hackers stole over $92.4 million from crypto projects in April 2025 alone, according to blockchain security firm Immunefi.

The figure represents a 27.3% year-over-year increase and more than double the losses reported in March.

April’s attacks occurred across 15 incidents, with two major exploits accounting for the bulk of the damage.

UPCX, an open-source platform, lost $70 million in a single attack, while decentralized exchange KiloEx was hit for $7.5 million.

Other affected projects included Loopscale, ZKsync, Term Labs, and Bitcoin Mission, each experiencing losses exceeding $1 million.

Cumulatively, the first four months of 2025 have already seen $1.74 billion in crypto losses—more than all of 2024, which totaled $1.49 billion.

Immunefi previously noted that Q1 2025 was the worst quarter for hacks in crypto history, driven largely by massive breaches of centralized exchanges Phemex and Bybit.
