Windows 11

Microsoft has released the KB5064081 preview cumulative update for Windows 11 24H2, which includes thirty-six new features or changes, with many gradually rolling out. These updates include new Recall features and a new way of displaying CPU usage in Task Manager.

The KB5064081 update is part of the company’s optional non-security preview update schedule, which releases updates at the end of each month to test new fixes and features coming to the next month’s  Patch Tuesday.

Unlike regular Patch Tuesday cumulative updates, monthly non-security preview updates do not include security updates and are optional.

You can install the KB5064081 update by opening Settings, clicking on Windows Update, and then “Check for Updates.”

Because this is an optional update, you will be asked if you want to install it by clicking the “Download and install” link unless you have the “Get the latest updates as soon as they’re they’re available” option enabled, which will cause the update to automatically install.

Once installed, this optional cumulative release will update Windows 11 24H2 systems to build 26100.5074.

The August 2025 preview update features numerous new additions that are gradually rolling out, including an updated method for displaying CPU workload metrics in Task Manager.

For years, Windows Task Manager’s Processes tab displayed CPU usage using a “Processor Utility” metric, which could display confusing or incorrect results.

The method ignored the number of cores a processor had, so a single, maxed-out core on a 16-core CPU could show overall usage at 100%. It also compared workload against the chip’s base clock speed rather than its actual operating frequency, so when turbo boost pushed cores above their regular speed, usage could spike beyond 100% and then get clipped in the display.

These quirks meant the numbers shown in the Processes tab usually did not match what was displayed in the Performance or Users tabs, or within third-party monitoring tools.

According to WindowsLatest, Microsoft has now standardized CPU reporting throughout Task Manager, with the Processes tab now using the same formula already used in the Performance and Users tabs.

The new CPU load is calculated as:

(Δ Process CPU Time) ÷ (Δ Elapsed Time × Logical Processors)

This updated CPU utilization formula is now rolling out with this update.

For users who prefer the legacy view, Microsoft has added an optional “CPU Utility” column in the Details tab. However, by default, Task Manager will now show consistent CPU metrics across the entire application.

The complete list of changes that are gradually rolling out includes:

  • [Recall] New! Recall opens to a personalized homepage that puts your recent activity and top-used apps and websites front and center, making it easy to pick up where you left off. After turning on snapshot collection, the homepage highlights key productivity features like Recent Snapshots, which show the latest snapshots to help you quickly resume tasks, and Top Apps and Websites, which display the three apps and websites you’ve used most in the past 24 hours. You can set filters in Settings to control which apps and websites are saved in snapshots. A new navigation bar on the leftmost side of the screen provides quick access to Home, Timeline, Feedback, and Settings.

  • [Click to Do] New! When you launch Click to Do for the first time, you’ll see a quick interactive tutorial. It shows how to complete tasks faster by demonstrating actions on both text and images—such as summarizing large blocks of text or removing image backgrounds. To revisit the tutorial later, select More options  > Start tutorial.

  • [General] New! When an app requests access to location, camera, microphone, or other device capabilities, Windows shows a redesigned system dialog box. To emphasize the privacy prompt, the screen dims slightly, and the prompt appears at the center of the screen.

  • [Taskbar]

    • New! The larger clock with seconds is now back in the notification center, displayed above the date and calendar. To turn this option on, go to Settings > Time & language > Date & time, and turn on Show time in the Notification Center.

    • Fixed: If you accidentally click and drag your mouse across the taskbar preview thumbnail, the preview might stop working.

  • [Search on the Taskbar]

    • New! When you use Search from the Windows taskbar, a new grid view will help you more quickly and accurately identify the desired image within your search.

    • New! Search on the taskbar now provides clearer status information. If your search results are incomplete while your PC is organizing files in the background, Windows shows a notice with a link to check progress. You can dismiss the notice when you’re done. There is also a status for files and folders, so you can easily tell whether they’re available online (cloud) or stored on your device.

  • [Lock screen] New! More widget options and support for lock screen widget personalization (previously referred to as “Weather and more”) are rolling out. After initial launch with Windows Insiders in the European Economic Area (EEA), these updates are expanding to all regions. You can add, remove, and rearrange lock screen widgets such as Weather, Watchlist, Sports, Traffic, and more. Any widget that supports the small sizing option can be added. To customize your lock screen widgets, go to Settings > Personalization > Lock screen.

  • [File Explorer]

    • New! Dividers now separate top-level icons in the File Explorer context menu.

    • New! When you’re signed in with a work or school account (Entra ID), File Explorer will display people icons in the Activity column and the Recommended section at the top of File Explorer Home. Hover over or select a person’s icon to open their Microsoft 365 Live Persona Card, which shows who they are and how they’re connected to the file.

    • Fixed: If you try to use the unblock open in Properties for a file, it still shows as blocked when you open Properties the next time.

  • [Windows Hello]

    • New! As part of the enhanced passkey features released in September 2023, you’ll see a redesigned Windows Hello interface. These modernized visual updates support fast, clear communication that appear across multiple authentication flows, including the Windows sign-in screen, passkey, Recall, the Microsoft Store, and more.

The Windows security credential experience for passkey offers a cleaner, more intuitive interface designed to support fast, secure sign-in. You can now easily switch between authentication options such as passkeys or connected devices.

    • Fixed: Windows Hello might recognize your face on the login screen, however it would still fail and then prompt you to enter your pin. If you continue experiencing issues, you might need to go to the Facial Recognition section under Settings > Accounts >Sign-in options and select Improve recognition.

    • Improved: Fingerprint login after standby is now more robust.

  • [Settings]

    • New!  Windows activation and expiration prompts match the Windows 11 design and appear as system notifications when action is required. There also have been improvements to messaging under Settings > System > Activation.

    • New! You can go to Settings > Privacy & security > Text and Image Generation to see which third-party apps have recently used generative AI models provided by Windows. You can also choose which apps are permitted to use them—putting you in charge of your device’s AI experience.

    • New! As part of the Copilot+ PC experience, the agent in Settings helps you quickly find and change settings. Initially available on Snapdragon®-powered Copilot+ PCs, agent in Settings now supports AMD- and Intel™-powered Copilot+ PCs. It currently works only when your primary display language is set to English.

    • Fixed: Settings might crash if you attempt to add a security key under Settings > Account > Sign-in options.

  • [Task Manager] New! Task Manager now uses standard metrics to show CPU workload consistently across all pages, aligning with industry standards and third-party tools. If you prefer the previous view, you can enable a new optional column called CPU Utility in the Details tab to display the earlier CPU usage value shown on the Processes page.

  • [Widgets]

    • New! Multiple dashboards are now available in your Widgets Board. This gives you more space for your favorite widgets and helps you stay informed with a feed that connects you to current events. A new navigation bar on the left side makes it easy to switch between your widget’s dashboard and other views like the Discover feed. After initial launch in the EEA, these updates are expanding to all regions.

    • New!  A new visual experience is available for the Discover feed on the Widgets Board. The layout is more organized, personalized, and engaging. Copilot-curated stories are now included, offering a well-rounded view of each topic with summaries, videos, and images from trusted MSN premium publishers. To customize your feed, go to Widgets > Discover dashboard > Personalization settings.

  • [Windows Backup for Organizations] New! Windows Backup for Organizations is now generally available! Experience seamless device transitions with enterprise-grade backup and restore. Whether you’re refreshing your organization’s devices, upgrading to Windows 11, or deploying AI-powered PCs, this solution helps sustain productivity with minimal disruption, ensuring business continuity and organizational resilience.

  • [PowerShell 2.0] Starting in August 2025, Windows 11, version 24H2, will no longer include Windows PowerShell 2.0. This legacy component was introduced in Windows 7 and officially deprecated in 2017. Most users won’t be affected, as newer versions such as PowerShell 5.1 and PowerShell 7.x remain available and supported. If you use older scripts or tools that depend on PowerShell 2.0, update them to avoid compatibility issues.

  • [Live captions] Fixed: Changing the opacity of live captions in Settings > Accessibility > Captions > Caption Style, has no effect.

  • [Input]

    • Fixed: Attempting to type Chinese with an IME after copying something with CTRL + C can result in the first character not displaying.

    • Fixed: An underlying issue related to textinputframework.dll could result in certain apps like Sticky Notes and Notepad crashing.

  • [dbgcore.dll] Fixed: An underlying issue with dbgcore.dll could result in certain apps, including explorer.exe, crashing.

  • [Kerberos] Fixed: There might be an underlying crash in Kerberos when attempting to access a cloud file share.

  • [Login] Improved: Addressed some underlying cases which could lead to you seeing a blank white screen, or a screen saying, “just a moment”, for a few minutes when logging into your PC.

  • [Miracast] Fixed: An issue where, on certain devices, audio would initially play but stop a few seconds after casting to a TV.

  • [Audio] Improved: Addressed an underlying audio service stops responding which could impact the ability to play audio in certain cases.

The good news is that some fixes or improvements in the KB5058502 update are available immediately:

  • [Device management] Fixed: This update addresses an issue that prevented some system recovery features from working properly due to a temporary file sharing conflict. This affected certain device management tools and disrupted key functions on some devices.

  • [File system] Fixed: An issue in Resilient File System (ReFS) where using backup apps with large files could sometimes exhaust system memory.

  • [Input]

    • Fixed: This update addresses an issue with the Chinese (Simplified) Input Method Editor (IME) where some extended characters appear as empty boxes.

    • [Fixed This update addresses an issue that prevents typing on the touch keyboard when using the Microsoft Changjie, Microsoft Bopomofo, or Microsoft Japanese Input Method Editors (IMEs). The issue occurs after switching to a previous version of the IME.

  • [Performance] Fixed: This update addresses an issue that slows application installation on ARM64 devices. Some installers might take longer to complete.

Microsoft reports two known issues with this release: a bug that causes incorrect CertificateServicesClient (CertEnroll) errors to appear, and lag/stuttering in audio and video performance when using Network Device Interface (NDI) to stream or transfer feeds between PCs.

The company is now rolling out a fix for the CertificateServicesClient (CertEnroll) errors , but it is gradually rolling out over the next four weeks.

CFTC Clears Path for Foreign Crypto Access to US Traders https://earlybirdsinvest.com/cftc-clears-path-for-foreign-crypto-access-to-us-traders/ https://earlybirdsinvest.com/cftc-clears-path-for-foreign-crypto-access-to-us-traders/#respond Fri, 29 Aug 2025 09:46:38 +0000 https://earlybirdsinvest.com/cftc-clears-path-for-foreign-crypto-access-to-us-traders/

The Commodity Futures Trading Commission (CFTC) has introduced a new set of rules that could allow international crypto exchanges to legally engage with US customers.

On August 28, the agency published an update to its registration framework for foreign commodity exchanges.

This update applies to both traditional and cryptocurrency markets. It outlines how overseas companies can receive approval to offer services to American users.

Acting CFTC Chair Caroline D. Pham emphasized that this step addresses confusion created by past regulatory methods. Pham stated that the new policy provides companies with a clear path back into the American market.

She also referred to the update as part of the CFTC’s effort to meet the goals of President Donald Trump’s administration.

Under the previous regulatory environment, US-based exchanges were restricted in the types of services they could provide. For example, they faced limits on offering perpetual futures, leverage, and staking rewards.

As a result, exchanges such as Binance

$12.32B

, Bybit

$4.12B

, and Bitget

$4.5B

, which operate outside the US, have become leaders in the crypto derivatives market.

Pham also shared in a post on X that the CFTC’s decision could help reconnect global exchanges with US markets. She noted that this may influence how these markets evolve in the future.

The announcement came after Kristin Johnson revealed she would be stepping down from her position at the CFTC on August 26. What did she say? Read the full story.

VivoPower to acquire $100M Ripple stake after SEC clears path for new fundraising https://earlybirdsinvest.com/vivopower-to-acquire-100m-ripple-stake-after-sec-clears-path-for-new-fundraising/ https://earlybirdsinvest.com/vivopower-to-acquire-100m-ripple-stake-after-sec-clears-path-for-new-fundraising/#respond Tue, 12 Aug 2025 06:59:22 +0000 https://earlybirdsinvest.com/vivopower-to-acquire-100m-ripple-stake-after-sec-clears-path-for-new-fundraising/

VivoPower International PLC has outlined a strategy to acquire $100 million Ripple shares as part of a broader initiative to integrate XRP into its corporate treasury, according to an Aug. 11 statement.

According to the statement, the $100 million investment will expose VivoPower to 211 million XRP tokens, currently valued at around $696 million.

VivoPower said it will hold both Ripple shares and XRP tokens as part of the strategy, becoming the first publicly listed US company to offer its shareholders access to both. The dual acquisition approach allows the firm to secure Ripple shares at a discount compared to market prices.

Importantly, VivoPower will obtain full legal ownership of the Ripple shares it acquires, with its name recorded directly on Ripple’s shareholder register. The firm has partnered with leading digital asset custodians such as BitGo and Nasdaq Private Market LLC to facilitate these transactions.

VivoPower CEO Kevin Chin emphasized that this move aligns with VivoPower’s long-term objective of building a robust treasury model that diversifies its holdings and offers significant upside potential for its shareholders.

The firm also noted that it will avoid purchasing Ripple shares held in special-purpose vehicles (SPVs) due to the extra fees and complexities they bring. An independent auditor will conduct quarterly reviews of VivoPower’s Ripple shareholdings to ensure transparency and accountability.

Ripple’s fundraising

VivoPower’s purchase of Ripple’s share comes less than a week after the US Securities and Exchange Commission (SEC) granted the blockchain firm a waiver from the “bad actor” designation.

The designation had stemmed from a 2020 lawsuit in which the SEC accused Ripple of selling unregistered securities.

While the parties settled in May 2025, the injunction technically remained in place. The regulator said recent circumstances justified the waiver, clearing the way for Ripple to seek new investment without legal barriers.

Following the waiver, pro-crypto lawyer John Deaton stated:

“Ripple can continue to raise money in the private markets. One might even argue, it’s business as usual – as if the lawsuit against Ripple and the $125M fine never happened.”

SEC liquid staking guidance clears ‘last hurdle’ for staking in spot crypto ETFs https://earlybirdsinvest.com/sec-liquid-staking-guidance-clears-last-hurdle-for-staking-in-spot-crypto-etfs/ https://earlybirdsinvest.com/sec-liquid-staking-guidance-clears-last-hurdle-for-staking-in-spot-crypto-etfs/#respond Tue, 05 Aug 2025 23:48:04 +0000 https://earlybirdsinvest.com/sec-liquid-staking-guidance-clears-last-hurdle-for-staking-in-spot-crypto-etfs/

Fresh US Securities and Exchange Commission (SEC) staff guidance on liquid staking is stoking expectations that US regulators will soon allow staking within spot crypto exchange-traded funds (ETFs).

Co-founder of The ETF Institute Nate Geraci called the guidance “the last hurdle” before the SEC can approve staking in spot Ethereum (ETH) ETFs.

Furthermore, he noted that liquid staking tokens (LSTs) would be used to manage liquidity inside funds, a key concern for the Commission.

His comments echo the SEC Division of Corporation Finance’s view that, under the structures described, liquid staking activities do not involve offers or sales of securities.

Additionally, staking receipt tokens (SRT) function as receipts for the underlying assets rather than as securities themselves.

Industry read-through

LSTs allow funds to keep staked exposure liquid, maintaining on-chain staking rewards while holding a transferable receipt token that can be used for portfolio operations, collateral, or redemptions without fully unwinding staking positions.

Lucas Bruder, CEO of Jito Labs, said in a note that the statement showed an “incredibly nuanced understanding” of current liquid staking arrangements.

He added:

“We will see expanded use for LSTs in both traditional and novel financial instruments, including ETFs.”

Regarding the impact of the decision, Bruder is looking forward to fully-staked ETFs via LSTs coming to market.

The CEO of Jito Labs and other industry players met with the SEC in mid-February to discuss staking rules for ETFs.

According to the meeting logs, LSTs were discussed to address the agency’s concerns about redemption timing. The participants highlighted that LSTs within an ETP framework avoid direct involvement in the staking process, streamlining the process.

The liquid staking statement builds on a May 29 staff view that other forms of protocol staking likewise do not require registration, and that features such as early withdrawals or slashing protection do not by themselves convert staking into a securities offering.

However, the SEC emphasized that its view applies to administrative and ministerial provider roles and specific fact patterns. Consequently, arrangements that go beyond those boundaries may be treated differently.

Circle Rockets After Stablecoin Bill Clears Senate, Pushes Post-IPO Rally to Over 500% https://earlybirdsinvest.com/circle-rockets-after-stablecoin-bill-clears-senate-pushes-post-ipo-rally-to-over-500/ https://earlybirdsinvest.com/circle-rockets-after-stablecoin-bill-clears-senate-pushes-post-ipo-rally-to-over-500/#respond Thu, 19 Jun 2025 09:25:28 +0000 https://earlybirdsinvest.com/circle-rockets-after-stablecoin-bill-clears-senate-pushes-post-ipo-rally-to-over-500/

Circle (NYSE: CRCL) soared 34% on Wednesday, adding another 6% after-hours, as the U.S. Senate passed a landmark bill laying the groundwork for regulated, dollar-backed stablecoins.

The move pushed Circle’s stock to $199.59 on Wednesday’s closing, with a high of $211.87 in after-hours trading. The stock is now up over 540% since its June 5 debut, marking one of the fastest climbs for a crypto stock after opening to the public.

The GENIUS Act outlined how U.S. firms can issue and manage fiat-backed stablecoins for payments. It still needs House approval and President Donald Trump’s signature, but the Senate vote signals strong bipartisan support for bringing crypto payments into the U.S. regulatory perimeter.

“History is being made,” Circle CEO Jeremy Allaire said on X, calling the bill a breakthrough for American competitiveness.

Trump, in a Truth Social post, said the bill would make the U.S. the “undisputed leader in digital assets.”

“The Senate just passed an incredible Bill that is going to make America the UNDISPUTED Leader in Digital Assets — Nobody will do it better, it is pure GENIUS,” Trump’s Truth Social post reads. “Digital Assets are the future, and our Nation is going to own it.”

Circle, the issuer of USDC, currently the world’s second-largest stablecoin by circulating value, has long pushed for clear rules around crypto dollars. Wednesday’s rally reflects investor confidence that Circle will be the chief beneficiary if the U.S. formally embraces stablecoins as digital cash equivalents.

Volume surged to over 60 million shares, nearly 2 times the average. CRCL traded between $148 and $200.89 on the day. Its market cap now sits above $48 billion, dwarfing several legacy payments firms.

Bernstein analysts, who initiated coverage on CRCL earlier this week, said the bill would “re-shore stablecoin innovation” and draw activity back from offshore issuers to regulated U.S. players.

“The bill clearly defines stablecoins as payment stablecoins,” said analyst Gautam Chhugani, “making their legal treatment closer to digital cash—and opening the door to mainstream adoption beyond crypto rails.”

Argentine Anti-Corruption Office clears President Milei of ethics violation over LIBRA promotion https://earlybirdsinvest.com/argentine-anti-corruption-office-clears-president-milei-of-ethics-violation-over-libra-promotion/ https://earlybirdsinvest.com/argentine-anti-corruption-office-clears-president-milei-of-ethics-violation-over-libra-promotion/#respond Mon, 09 Jun 2025 04:18:15 +0000 https://earlybirdsinvest.com/argentine-anti-corruption-office-clears-president-milei-of-ethics-violation-over-libra-promotion/

Argentina’s Anti-Corruption Office has determined that President Javier Milei did not violate any ethics laws when he promoted the Solana-based LIBRA memecoin in February.

In a resolution issued on Friday, the office declared that Milei’s Feb. 14 X post constituted a personal statement rather than an official announcement as a public servant. Therefore, Milei’s post did not result in any ethics violations, the document signed by Alejandro Melik, head of the Anti-Corruption Office, stated.

The Anti-Corruption Office is a decentralized agency that reports to the Argentine Ministry of Justice. Its chief, Melik, was appointed by the Milei administration in December 2023.

The office had launched an investigation into whether Milei had engaged in any misconduct after the LIBRA token price rose and cratered within hours of his X post promoting the project. Milei himself had requested the investigation and even created a special task force he disbanded last month after it fulfilled its mandate to examine his ties to the LIBRA token.

The case is still being investigated by an Argentine federal court, which froze Milei and his sister’s assets amid the probe.

The LIBRA scandal

The scandal erupted when Milei published an X post that was largely construed as an endorsement by the Argentine President. The post that was deleted within six hours and contained links to the Viva La Libertad Project website and the token’s contract number, which helped investors find it on Solana, stated:

“This private project will be dedicated to stimulating the growth of the Argentine economy by funding small businesses and Argentine entrepreneurs.”

Immediately following Milei’s post, the price of LIBRA rose sharply to around $5, but tanked soon after. Several investors lost millions of dollars as the token’s value fell by around 95%. The scandal rocked the Argentine market, even leading to a stock market crash days later.

Immediately after the token lost value, triggering an uproar on social media, including allegations of insider trading, Milei deleted the post. In a new post on Feb. 15, he clarified that he had no ties to the project, but had decided to delete the previous post after learning about the details of the project.

On Feb. 18, Milei said that he “acted in good faith” when he “shared” the project, and had, therefore, “made no mistakes.” His intention was not to promote the memecoin but to raise awareness about an effort to support Argentine businesses using crypto.

The same day, however, a local media outlet reported that LIBRA co-creator Hayden Davis boasted about his ‘control’ over Milei, thanks to his donations to Milei’s sister, Karina Milei.

Public trust in Milei’s administration cratered after the scandal.

The findings of the Anti-Corruption Office

The Anti-Corruption Office classified Milei’s post as a personal, non-official activity by the President of Argentina. It reiterated that the post “did not imply any governmental activity” since it was published from Milei’s personal X account, which receives no official management contributions or public resources.

The resolution added that Milei’s X account, where he presents himself as an “economist” and not a public official, predates his term as a congressman. The bureau, therefore, declared that the post was an expression of his personal opinion, a civil and political right guaranteed by the constitution.

The conclusion was further strengthened by the fact that the message was not disseminated through any official governmental accounts. The document added:

“…the post under analysis did not refer to public policies, programs, government decisions, or announcements with legal or budgetary effects.”

SEC Clears Lawsuits on Kraken & Other Crypto Firms, While XRP’s Settlement Remains Pending https://earlybirdsinvest.com/sec-clears-lawsuits-on-kraken-other-crypto-firms-while-xrps-settlement-remains-pending/ https://earlybirdsinvest.com/sec-clears-lawsuits-on-kraken-other-crypto-firms-while-xrps-settlement-remains-pending/#respond Sun, 13 Apr 2025 00:56:08 +0000 https://earlybirdsinvest.com/sec-clears-lawsuits-on-kraken-other-crypto-firms-while-xrps-settlement-remains-pending/ Amidst its ongoing crypto regulatory changes, the U.S. Securities and Exchange Commission (SEC) has dropped its charges against major crypto firms Kraken, ConsenSys, and Cumberland DRW.

New leadership under the Trump administration has played a significant role in the SEC’s dismissal of these lawsuits, paving the path towards broader U.S. crypto adoption. At the same time, Ripple has agreed to resolve its current SEC civil case by paying a $50 million penalty, but the lack of an official SEC announcement has left the crypto industry in limbo.

Why the SEC Dropped Charges Against Kraken, ConsenSys, and Cumberland DRW

Now that the SEC has dropped these cases, it cannot refile the same lawsuits it started against Kraken and the other firms involved. Based on Kraken’s latest announcement, the dismissal of charges was based on a “regulation-by-enforcement” approach that disregarded the leading crypto exchange’s consistent business model without merit.

In 2023, Kraken was accused of operating as an unlicensed securities exchange, broker, and clearing agency. The SEC argued that the platform enabled crypto trades that qualified as securities without proper registration.

kraken app overview

Regarding the ConsenSys SEC case, the company drew attention for its MetaMask staking service, which allowed users to earn passive crypto rewards. The SEC suggested this service could be seen as offering securities without approval, raising concerns within the DeFi (decentralized finance) community.

In the Cumberland DRW SEC case, the major crypto trading player was said to have processed over $2 billion worth of transactions. This allegedly violates the SEC’s securities registration requirements, resulting in various civil penalties for the firm.

The Trump Administration’s Influence on SEC Crypto Policy

In February 2025, President Donald Trump appointed former SEC Commissioner Mark Uyeda as the agency’s Acting Chair. Since Uyeda’s tenure, the SEC has shifted its direction on U.S crypto regulation, away from aggressive enforcement toward more open communication with the crypto industry.

Instead of resorting to legal action, the SEC has opened dialogue through informational forums, meetings, and roundtable discussions initiated by its Crypto Task Force. The next crypto roundtable will be hosted on April 11, 2025.

Chairman Uyeda’s leadership style differs from past chairs, who often relied on immediate regulatory enforcement. Many hope this shift in direction leads to new cryptocurrency policies better suited to blockchain technology’s adaptive and unique use cases.

Kraken Plans to Go Public After SEC Dismissal

With the Kraken SEC case dismissed, the leading crypto exchange is considering a potential IPO (initial public offering). Due to regulatory woes, Kraken had previously delayed efforts to bring the company public. However, the latest developments in U.S. crypto regulations have brought a possible IPO launch back on the table.

If the exchange proceeds with going public, the IPO would introduce the first major U.S. crypto exchange listing since Coinbase’s 2021 listing on Nasdaq. While no official date has been given, analysts see the case’s dismissal as a positive signal towards Kraken’s future as a global exchange.

Why XRP’s Regulatory Status Remains Unclear

Ripple Labs has settled its case with the SEC, resolving civil claims of its unregistered securities sales. The cryptocurrency firm announced it will pay $50 million from the initially proposed $125 million fine, with the remainder waived as part of the settlement.

brad garlinghouse, the CEO of RIpple

Ripple’s legal troubles with the SEC started in late 2020, when the Agency accused the firm and two of its executives of raising $1.3 billion through an unregistered sale of XRP tokens. In a 2023 ruling, U.S. Judge Analisa Torres ruled that XRP sales on public exchanges were not considered securities transactions.

However, Torres found that $728 million worth of XRP sold to institutional buyers did fall under securities rules. This finding contributed to the initial fine, which was later lessened in the current $50 million settlement.

While Ripple CEO Brad Garlinghouse announced the XRP legal status update as a significant win, some investors still await the SEC’s official statement on the matter.

How These Regulatory Changes Impact Crypto Adoption

With these major legal actions now closed, investors can expect to see improvements in crypto market sentiment. These developments have lessened regulatory uncertainty risks that deterred large investors from backing profitable digital asset firms.

Additionally, crypto trading platforms like Coinbase, Binance, and Kraken can regain momentum and continue offering compliant crypto products and services to savvy retail investors.

Is Kraken’s Legal Win a Turning Point for Crypto Exchanges?

SEC’s dismissal of charges against Kraken, ConsenSys, and Cumberland DRW could be a stepping stone towards more stable and factual U.S. crypto regulatory practices. With the SEC under the Trump administration, crypto innovation can start anew now that previous restrictive policies are being lifted.

However, the SEC and its Crypto Task Force must still address looming questions surrounding DeFi activities, crypto staking, and AI integration in blockchain technology. Still, the recent dismissals reflect a steady progression towards future crypto market adoption.

SEC clears Ethereum ETF options trading for BlackRock and Fidelity https://earlybirdsinvest.com/sec-clears-ethereum-etf-options-trading-for-blackrock-and-fidelity/ https://earlybirdsinvest.com/sec-clears-ethereum-etf-options-trading-for-blackrock-and-fidelity/#respond Thu, 10 Apr 2025 12:43:31 +0000 https://earlybirdsinvest.com/sec-clears-ethereum-etf-options-trading-for-blackrock-and-fidelity/

The US Securities and Exchange Commission (SEC) approved proposals from Nasdaq and Cboe to list and trade options on spot Ethereum (ETH) exchange-traded funds (ETFs) managed by BlackRock and Fidelity, according to April 9 filings.

The orders were granted for the iShares Ethereum Trust (ETHA) and the Fidelity Ethereum Fund (FETH) following a review process that included amendments, public comments, and regulatory justification for new product listings under Section 19(b) of the Securities Exchange Act of 1934.

Contracts to offer American-style exercise and standard settlement

Both filings approved options with American-style exercise and physical settlement. The approved contracts will adhere to existing listing rules applicable to ETF options, including margin, strike intervals, series expiration cycles, and minimum trading increments.

The ETHA and FETH options will be subject to a 25,000-contract position and exercise limit per market side, just as the options for Bitcoin (BTC) ETFs were approved last year.

Nasdaq and Cboe emphasized the conservative nature of the 25,000-contract cap, which was derived from a comparative analysis with other ETFs and commodity-based trusts.

Additionally, Nasdaq noted that the notional risk of a maximum position in ETHA would represent less than 0.03% of the Ethereum market’s capitalization and below 4.4% of the trust’s outstanding shares. Cboe compared the proposed limits to those set for Bitcoin-based ETFs and similarly structured commodity products.

The approvals follow a precedent set for spot Bitcoin ETF options, which received SEC authorization on Sept. 23, 2024, and began trading in November 2024.

As happened last year, options trading requirements from other issuers are likely to be approved, with trading starting in the same week as ETHA and FETH.

Trump Nominee Paul Atkins Clears Senate Panel for U.S. Securities and Exchange Commission (SEC) Chair: Report https://earlybirdsinvest.com/trump-nominee-paul-atkins-clears-senate-panel-for-u-s-securities-and-exchange-commission-sec-chair-report/ https://earlybirdsinvest.com/trump-nominee-paul-atkins-clears-senate-panel-for-u-s-securities-and-exchange-commission-sec-chair-report/#respond Thu, 03 Apr 2025 18:44:35 +0000 https://earlybirdsinvest.com/trump-nominee-paul-atkins-clears-senate-panel-for-u-s-securities-and-exchange-commission-sec-chair-report/

Paul Atkins, Donald Trump’s nominee for chair of the U.S. Securities and Exchange Commission (SEC), advanced through the Senate Banking Committee on Thursday.

According to a Reuters report, the committee approved Atkins in a 13-11 vote, with all Democrats opposing the nomination.

Atkins, a former SEC commissioner, is known for his deregulatory stance and ties to the cryptocurrency industry.

The nomination now moves to the Senate floor for final confirmation. If confirmed, Atkins will succeed Acting Chair Mark Uyeda, who has led the SEC since January. Atkins has pledged to prioritize regulatory clarity for digital assets and streamline capital formation processes.

Critics, including Senator Elizabeth Warren, have raised concerns about Atkins’s record during the 2008 financial crisis and his advisory role with the collapsed crypto exchange FTX.

Despite opposition, Atkins is expected to secure confirmation in the Republican-controlled Senate.

During his nomination hearing before the Senate Banking Committee on March 27th, Atkins said that he had witnessed how regulations impact markets and investors.

“Since 2017, as I have led industry efforts to develop best practices for the digital asset industry, I have seen how ambiguous and non-existent regulations for digital assets create uncertainty in the market and inhibit innovation.”

To address the challenges stemming from the absence of clear rules for digital assets, Atkins said he will work to establish a regulatory framework for crypto.

“A top priority of my chairmanship will be to work with my fellow Commissioners and Congress to provide a firm regulatory foundation for digital assets through a rational, coherent, and principled approach.”
