, Cameron and Tyler Winklevoss.

Quintenz, nominated by President Donald Trump to lead the US Commodity Futures Trading Commission (CFTC), shared the messages on X on September 10.

He stated that he was concerned President Trump “might have been misled” by the twins and wanted to show his side of the story.

The conversation included a message from Tyler Winklevoss regarding Gemini’s legal dispute with the CFTC, which resulted in a $5 million settlement. In the July 25 text, Tyler accused the regulator of blocking the company’s ability to defend itself fairly in court.

He said, “The CFTC totally abused the deliberative process privilege, amongst many other abuses, to prevent us from even being able to defend ourselves fairly in court”.

According to Quintenz, the brothers wanted him to reassure them about what they described as the agency’s “lawfare trophy hunting”.

He said he refused to give such guarantees. Quintenz explained:

I believe these texts make it clear what they were after from me, and what I refused to promise.

He added that after this exchange, Cameron and Tyler reached out to President Trump and requested that his confirmation be delayed.

On August 26, Kristin Johnson announced that she will leave her role at the CFTC on September 3. What did she say? Read the full story.

Trump's CFTC Hopeful Quintenz Takes His Dispute With Tyler Winklevoss (Very) Public https://earlybirdsinvest.com/trumps-cftc-hopeful-quintenz-takes-his-dispute-with-tyler-winklevoss-very-public/ https://earlybirdsinvest.com/trumps-cftc-hopeful-quintenz-takes-his-dispute-with-tyler-winklevoss-very-public/#respond Thu, 11 Sep 2025 00:04:57 +0000 https://earlybirdsinvest.com/trumps-cftc-hopeful-quintenz-takes-his-dispute-with-tyler-winklevoss-very-public/

Brian Quintez, U.S. President Donald Trump’s nominee to run the Commodity Futures Trading Commission, published a text exchange he had with Tyler Winklevoss in his first public statement since his confirmation process appeared to stall over the summer at the White House’s direction, saying he believed that Trump “might have been misled.”

Quintenz shared a series of text messages he said he’d exchanged with Tyler Winklevoss, the co-founder and CEO of crypto exchange Gemini — which is set to go public this week — and Winklevoss Capital. Cameron Winklevoss, Tyler’s twin brother and co-founder, may have also been in the group chat, which was titled “tw-cw-bq” but did not send any messages in the screenshots shared by Quintenz. In the chat, dated July 24, Tyler Winklevoss asked Quintenz if he’d seen a post on X from June 17 where Tyler announced Gemini had filed a complaint with the CFTC’s inspector general about Division of Enforcement attorneys who had pursued charges against Gemini.

“I believe these texts make it clear what they were after from me, and what I refused to promise,” Quintenz said in his posts, representing a highly unusual move for a nominee in the midst of a federal confirmation process. “It’s my understanding that after this exchange they contacted the president and asked that my confirmation be paused for reasons other than what is reflected in these texts.”

Before the Senate left Washington for its August break, Quintenz’s nomination was set for what was thought to be an easy procedural step in the Senate Agriculture Committee to advance it to the floor for his final confirmation vote. But the White House halted that vote for reasons it didn’t make clear at the time, though Gemini co-founder Tyler Winklevoss had been waging a rhetorical campaign to stop his confirmation.

Winklevoss told CoinDesk in an interview in July that he’d been making the case that Quintenz was a bad choice because of the former commissioner’s wish to increase the CFTC budget to oversee the crypto industry, his past views on the legal liability for crypto developers and what Winklevoss characterized as Quintenz’s improper attempts to influence the CFTC on behalf of prediction market firm Kalshi.

Quintenz’s post on Wednesday suggested that, in his view, Winklevoss was upset that Quintenz did not join in criticism of CFTC’s enforcement efforts after the agency pursued charges against Gemini that were settled in January.

“I know we had spoken about this in the winter where I recalled my original extreme disappointment at [the Enforcement Division] for pursuing this so aggressively,” a text from Quintenz said. “I commit to you to having a fair and reasonable review of the matter and the division and individuals involved to determine if they acted inappropriately.”

He went on to say that a “fully confirmed chair” should be the person to handle the matter, but that if someone currently employed by the CFTC was “communicating with” the Winklevosses, he would have to “give that careful thought.”

Winklevoss asked if Quintenz was saying that Gemini should have waited to file their complaint until after the Senate confirmed the former commissioner, to which Quintenz replied that “any decision or response to your complaint should be made by and given the full weight of the confirmed chair.”

The crypto executive said they had spoken about the CFTC’s enforcement effort against Gemini after Quintenz asked for the Winklevoss brothers’ endorsement in December.

“Cultural reform, which includes rectifying what happened to us, should be the highest priority,” Winklevoss said. “I’d like to understand your thoughts on this and how you plan to align with President Trump and the administration’s mandate to end the lawfare and make amends for it.”

He added that he would “be happy to raise the issue with the president himself” if Quintenz thought he was being undermined by current CFTC employees.

Quintenz, Winklevoss and a spokesperson for Gemini did not immediately return requests for comment. CoinDesk could not independently verify the texts’ authenticity.

In July, a coalition that represented the vast majority of the crypto industry came out to press President Donald Trump to move forward to get Quintenz confirmed, calling him the “right person at the right time” to run the CFTC. Though the Senate has been back from break for a while and has returned to its confirmation work for many of Trump’s appointees, the committee hasn’t yet scheduled a follow-up vote for Quintenz

Meanwhile, Securities and Exchange Commission Chairman Paul Atkins has been pressing forward on an industry-friendly “Project Crypto” initiative while the temporary chief at the CFTC, Acting Chairman Caroline Pham has been standing in at the sister agency with a similar “crypto sprint.” The two of them have made recent joint moves to clear the regulatory path for digital assets.

Trump CFTC pick alleges Tyler Winklevoss attempted to influence his appointment, discloses private texts https://earlybirdsinvest.com/trump-cftc-pick-alleges-tyler-winklevoss-attempted-to-influence-his-appointment-discloses-private-texts/ https://earlybirdsinvest.com/trump-cftc-pick-alleges-tyler-winklevoss-attempted-to-influence-his-appointment-discloses-private-texts/#respond Wed, 10 Sep 2025 22:03:49 +0000 https://earlybirdsinvest.com/trump-cftc-pick-alleges-tyler-winklevoss-attempted-to-influence-his-appointment-discloses-private-texts/

President Trump’s CFTC chair nominee Brian Quintenz alleged that Tyler Winklevoss attempted to derail his confirmation after Quintenz refused to promise favorable treatment regarding the exchange’s past litigation with the commission.

According to private text messages released by Quintenz on Sept. 10, Winklevoss shared Gemini’s 13-page complaint against the CFTC Inspector General in a July 2025 exchange.

He claimed the agency pursued “dubious false statements charges” and “selectively and unfairly weaponized” enforcement against the company.

Winklevoss described seven years of “lawfare trophy hunting” by the commission in the leaked messages.

Transparency claims

Winklevoss questioned why the CFTC sued Gemini rather than “parties that defrauded us of $10mil” or CBOE. He also questioned why the commission continued pursuing Gemini “after it knew its investigation was started based on a false whistleblower.”

Quintenz consistently refused to make specific commitments, stating that “any decision or response to your complaint should be made by and given the full weight of the confirmed chair.”

He committed only to addressing matters “fully and fairly if and when I am confirmed,” while emphasizing the importance of proper process.

Winklevoss then expressed disappointment that Quintenz hadn’t reviewed their complaint despite previous discussions.

Additionally, the Gemini co-founder stressed that “cultural reform, which includes rectifying what happened to us, should be the highest priority” and urged Quintenz to align with President Donald Trump’s mandate to end regulatory warfare.

Quintenz explained his approach of waiting for confirmation before forming judgments. He added that he decided “to wait until I can get into the role to get that view as opposed to trying to get it now through current leadership.”

He described having “a very poor experience with that on every important issue or decision so far” when dealing with existing commission staff.

The message release comes two days before Gemini’s planned IPO on Sept. 12.

Quintenz claimed that Winklevoss contacted Trump in an effort to pause his confirmation for undisclosed reasons following their exchange.

He added that he disclosed the discussions with Winklevoss to protect the President from misinformation and demonstrate his commitment to transparency over personal advancement.

SEC and CFTC aim to harmonize crypto rules, boost US market leadership https://earlybirdsinvest.com/sec-and-cftc-aim-to-harmonize-crypto-rules-boost-us-market-leadership/ https://earlybirdsinvest.com/sec-and-cftc-aim-to-harmonize-crypto-rules-boost-us-market-leadership/#respond Fri, 05 Sep 2025 21:30:44 +0000 https://earlybirdsinvest.com/sec-and-cftc-aim-to-harmonize-crypto-rules-boost-us-market-leadership/

The U.S. Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) will hold a joint roundtable on Sept. 29 to advance regulatory coordination in the digital asset sector.

In a Sept. 5 joint statement, the agencies said fragmented oversight in the past had discouraged innovation and driven some crypto activity overseas. They stressed that harmonization is no longer optional, noting that a failure to coordinate has created uncertainty that hinders economic activity even when products are legally permissible.

SEC Chairman Paul Atkins and CFTC Acting Chairman Caroline Pham emphasized that harmonization can lower barriers, improve efficiency, and reaffirm US leadership in financial markets.

According to the financial regulatory chiefs:

“By working in lockstep, our two agencies can harness our nation’s unique regulatory structure into a source of strength for market participants, investors and all Americans.”

The event follows the President’s Working Group on Digital Asset Markets recommendations, which urged regulators to create a fit-for-purpose framework that supports innovation while protecting investors.

Key priorities

The Sept. 29 roundtable will examine measures to align US markets with the global, always-on economy.

Among the priorities under consideration is the expansion of trading hours across select asset classes. The financial regulators said markets such as foreign exchange, gold, and crypto already operate continuously, and extending trading windows could improve liquidity while maintaining investor protections.

The agencies also plan to review frameworks for prediction markets and perpetual contracts. By clarifying rules for event-based contracts and onshoring compliant perpetual swaps, they aim to channel more trading activity back to US platforms.

Another proposal centers on portfolio margining. A coordinated framework could allow firms to recognize offsetting positions across asset classes and reduce capital inefficiencies.

The SEC and CFTC stressed that harmonized margin requirements would make net exposures easier for market participants while preserving risk safeguards.

The agencies further intend to explore exemptions that provide safe harbors for decentralized finance (DeFi) projects. These exemptions would create structured environments for peer-to-peer trading of spot, leveraged, or margined products without undermining investor protection standards.

SEC and CFTC Open Door to Spot Crypto on Regulated US Exchanges https://earlybirdsinvest.com/sec-and-cftc-open-door-to-spot-crypto-on-regulated-us-exchanges/ https://earlybirdsinvest.com/sec-and-cftc-open-door-to-spot-crypto-on-regulated-us-exchanges/#respond Wed, 03 Sep 2025 11:52:52 +0000 https://earlybirdsinvest.com/sec-and-cftc-open-door-to-spot-crypto-on-regulated-us-exchanges/

Financial regulators in the United States have issued a new statement explaining how licensed exchanges can offer spot crypto trading.

In a joint release, staff from the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) said that regulated trading platforms, both domestic and certain international ones, may offer spot crypto products under current laws.

This update aims to provide more clarity for exchanges such as national securities exchanges (NSEs), designated contract markets (DCMs), and foreign boards of trade (FBOTs).

The statement emphasizes that these activities are not restricted, as long as the platforms follow established rules and remain in touch with the agencies.

The joint note explained that exchange operators are encouraged to reach out to SEC or CFTC staff for assistance or to ask questions. The agencies also stated that they are prepared to review exchange applications, address concerns regarding custody and trade clearing.

They also ensure that new spot offerings meet standards for transparency, market surveillance, and customer protection.

Under this framework, platforms such as the New York Stock Exchange, Nasdaq, CME Group, and Cboe Global Markets, as well as some CFTC-recognized foreign trading boards, may qualify to list spot crypto products. The agencies recommend that these platforms speak directly with regulatory staff before launching any crypto-related services.

U.S. market regulators took a coordinated step to encourage the growth of crypto markets, issuing a joint staff statement on Sept. 2 that affirmed registered exchanges are not barred from offering certain spot crypto asset products.

The Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) said the statement reflects their staff divisions’ shared view that regulated platforms can facilitate spot commodity trades.

The agencies framed the move as part of a broader push to expand market choice and bring digital asset innovation back onshore.

Coordinated regulatory effort

SEC Chairman Paul Atkins called the joint statement a milestone for the industry, highlighting the agency’s commitment to fostering competition among trading venues.

CFTC Acting Chairman Caroline D. Pham positioned the announcement as a reversal from previous policy uncertainty, linking it to President Donald Trump’s push to make the US “the crypto capital of the world.”

The effort stems from ongoing initiatives: the SEC’s “Project Crypto” and the CFTC’s “Crypto Sprint.” Both programs aim to modernize regulatory frameworks, building on recommendations from the President’s Working Group on Digital Asset Markets.

A clear pathway

The agencies’ trading and market oversight divisions said they would continue engaging with industry stakeholders to address concerns and assess potential products.

Registered exchanges are encouraged to approach staff at either regulator for guidance on compliance. The statement comes as the CFTC gears up to restore US access for offshore exchanges after issuing new guidance last month.

The joint statement indicates that the SEC and CFTC intend to maintain open channels for dialogue and anticipate further actions to support the growth and development of U.S. digital asset markets.

The Commodity Futures Trading Commission (CFTC) has introduced a new set of rules that could allow international crypto exchanges to legally engage with US customers.

On August 28, the agency published an update to its registration framework for foreign commodity exchanges.

This update applies to both traditional and cryptocurrency markets. It outlines how overseas companies can receive approval to offer services to American users.

Acting CFTC Chair Caroline D. Pham emphasized that this step addresses confusion created by past regulatory methods. Pham stated that the new policy provides companies with a clear path back into the American market.

She also referred to the update as part of the CFTC’s effort to meet the goals of President Donald Trump’s administration.

Under the previous regulatory environment, US-based exchanges were restricted in the types of services they could provide. For example, they faced limits on offering perpetual futures, leverage, and staking rewards.

As a result, exchanges such as Binance

$12.32B

, Bybit

$4.12B

, and Bitget

$4.5B

, which operate outside the US, have become leaders in the crypto derivatives market.

Pham also shared in a post on X that the CFTC’s decision could help reconnect global exchanges with US markets. She noted that this may influence how these markets evolve in the future.

The announcement came after Kristin Johnson revealed she would be stepping down from her position at the CFTC on August 26. What did she say? Read the full story.

Crypto groups endorse Brian Quintenz for CFTC amid regulatory standoff with banks https://earlybirdsinvest.com/crypto-groups-endorse-brian-quintenz-for-cftc-amid-regulatory-standoff-with-banks/ https://earlybirdsinvest.com/crypto-groups-endorse-brian-quintenz-for-cftc-amid-regulatory-standoff-with-banks/#respond Thu, 21 Aug 2025 00:22:04 +0000 https://earlybirdsinvest.com/crypto-groups-endorse-brian-quintenz-for-cftc-amid-regulatory-standoff-with-banks/

The Crypto Council for Innovation (CCI) and the Blockchain Association jointly issued a letter on Aug. 20 endorsing Brian Quintenz for Chairman of the US Commodity Futures Trading Commission (CFTC).

In the letter to President Donald Trump, the groups emphasized that confirming Quintenz promptly is critical to advancing his administration’s agenda to foster a “golden age” for digital assets in America.

According to the group:

“Each of our organizations has had the privilege of knowing and working with Mr. Quintenz firsthand, and we can attest to his deep expertise, sound judgment, proven leadership, and integrity.”

They further noted that Quintenz’s experience positions him to guide the CFTC at a decisive moment for US financial markets and the broader digital asset ecosystem.

Their endorsement also frames him as uniquely equipped to implement regulations that support responsible innovation, safeguard market integrity, and maintain American economic competitiveness.

They wrote:

“Mr. Quintenz’s extensive experience and substantive and technical understanding of blockchains, digital assets, and financial markets makes him exceptionally well-suited to lead the CFTC at this critical juncture.”

Quintenz, who was nominated in February, saw his confirmation vote delayed after concerns arose over potential conflicts of interest, highlighted by notable industry figures like the Gemini co-founders Tyler and Cameron Winklevoss.

Pushback against bankers

The same coalition also opposed a recent initiative by US banks to amend provisions in the GENIUS Stablecoin Regulation Act.

In an Aug. 19 letter, the groups argued that the proposed changes would create an uncompetitive environment favoring banks while limiting broader industry growth, innovation, and consumer choice.

Last week, the Bank Policy Institute (BPI) and other banking groups urged lawmakers to address what they described as a legislative gap that prevents exchanges and affiliated firms from offering indirect yields on stablecoins.

The traditional financial institutions warned that this gap could drive up to $6.6 trillion in deposits from the traditional banking sector into digital assets.

However, the crypto organizations countered that payment stablecoins operate under distinct frameworks and should not be treated like bank products.

They stressed that allowing regulated platforms to share benefits with customers is “a feature that promotes financial inclusion, fosters innovation, and ensures American leadership in the next generation of payments.”

Lawmakers to review Trump’s CFTC chair nominee ahead of full Senate vote https://earlybirdsinvest.com/lawmakers-to-review-trumps-cftc-chair-nominee-ahead-of-full-senate-vote/ https://earlybirdsinvest.com/lawmakers-to-review-trumps-cftc-chair-nominee-ahead-of-full-senate-vote/#respond Sat, 19 Jul 2025 03:30:20 +0000 https://earlybirdsinvest.com/lawmakers-to-review-trumps-cftc-chair-nominee-ahead-of-full-senate-vote/

The Senate Agriculture Committee will consider President Donald Trump’s nominee for chair of the Commodity Futures Trading Commission, Brian Quintenz, as lawmakers weigh a broader shift in crypto regulation that could dramatically expand the agency’s role.

The committee is scheduled to review Quintenz’s nomination during a July 21 hearing, ahead of a full Senate vote regarding his appointment expected next week.

His confirmation would come at a pivotal moment as Congress debates the Digital Asset Market Clarity (CLARITY) Act legislation. The legislation aims to establish a clear regulatory framework for the digital asset industry and designate a primary supervisor.

Quintenz, a former CFTC commissioner, may have to lead the agency alone. Acting Chair Caroline Pham and Commissioner Kristin Johnson are both anticipated to depart by the end of 2025, and no additional nominations have been announced.

The CLARITY Act, which passed the House on July 17 with bipartisan support, proposes a regulatory framework that would designate the CFTC as the lead watchdog for most digital commodities, including crypto.

Its future in the Senate remains uncertain, with possible amendments and political divisions still in play. Senate Banking Committee leaders have expressed interest in moving the bill forward before October, though no formal vote has been scheduled.

If passed, the legislation could recalibrate the balance of power between the CFTC and the SEC, the nation’s two primary financial regulators.

While the crypto industry has largely backed the bill as a step toward clearer oversight, regulatory leadership changes may complicate implementation.

The CFTC’s existing leadership has signaled support for the proposed reforms, emphasizing the agency’s readiness to adapt.

Should Quintenz be confirmed without further appointments, he may find himself guiding the CFTC through one of the most consequential shifts in its history without additional support.

Polymarket, a crypto-based prediction platform, is no longer under investigation by US regulators, the Department of Justice (DOJ) and the Commodity Futures Trading Commission (CFTC).

The two agencies have officially dropped their inquiries without filing any charges.

Polymarket’s CEO, Shayne Coplan, confirmed in a July 15 post on X following a report by Bloomberg, which cited a source familiar with the matter. He reflected on events following the 2024 US elections, when Polymarket had drawn attention for accurately predicting the results.

He added that the process was difficult, but he was relieved that it was over. Coplan also stated that they had cooperated fully and were now cleared.

Polymarket had already faced regulatory pressure in the past. In 2022, the CFTC fined the company $1.4 million for failing to register its services. At the time, Polymarket agreed to close some of its markets and follow the agency’s rules more closely.
