Shiba Inu (SHIB) continues to battle bearish pressures in the cryptocurrency market as the meme coin faces volatility. Amid these developments, Lucie, the marketing lead of the SHIB ecosystem, has dropped insights into the asset’s appeal factors.

Exchanges and wallet distribution boosting SHIB’s credibility

In a post shared with the community on X, Lucie highlighted that the distribution of Shiba Inu is not centralized in a few individuals. Rather, it is spread across several major exchanges and people.

According to Lucie, major wallets on Binance, Robinhood, Crypto.com, among others, have trillions of SHIB in their custody.

These SHIB tokens are held on behalf of the millions of users invested in the Shiba Inu project. The volume of SHIB held in the wallets of these exchanges represents the top 10 holders’ count.

Besides these wallets on exchanges, individuals also have a sizable number of SHIB in their custody. The SHIB marketing executive noted that over 1.5 million individual wallets are hosted on Ethereum alone. This suggests the massive spread of ownership distribution.

In terms of geographic spread, Shiba Inu is highly concentrated in the United States of America, India, Turkey and East Asia. Other regions include Europe, Latin America, Africa and Southeast Asia.

She noted that this decentralized nature of SHIB holders could serve to enhance security and prevent price volatility from a few controlling owners.

Market performance and “Sparktember” outlook

As of this writing, the Shiba Inu price was changing hands at $0.00001243, representing a 1.18% increase in the last 24 hours.

However, investors remain cautious of the bearish outlook of the meme coin, resulting in a 17.5% decline in trading volume to $180.3 million within the same time frame.

Despite this outlook, there is growing optimism among some community members that September will be bullish. They expect the month to trigger utility and new launches for SHIB and have dubbed it “Sparktember.”

How the dog-themed meme coin performs will be revealed with the passing of time.

Federal authorities are challenging the outcome of a sentencing decision involving two Estonian citizens who admitted to running a large-scale crypto mining scam.

The appeal, submitted to the Ninth Circuit Court of Appeals, disputes both the judge’s final order and the process that led to it.

Estonians Sergei Potapenko and Ivan Turõgin had previously admitted to organizing a fraudulent crypto operation that raised over half a billion dollars. The scam sold fake mining contracts under the HashFlare brand between 2015 and 2019.

According to the investigation, the two displayed false profit data to users via online dashboards, despite not having the mining equipment they had advertised.

In February, both men pleaded guilty to conspiracy charges related to this activity. Prosecutors argued that they tricked around 440,000 individuals across the world and requested prison terms of 10 years for each of them.

However, on August 12, Judge Robert S. Lasnik issued “time served”, along with three years of supervised release and fines of $25,000 each.

The judge explained that the court had taken into account the possibility of transferring the sentence to Estonia, where both defendants would serve their time.

He noted that if the transfer request was denied, the two might end up with longer sentences and be held in immigration custody indefinitely after serving time in the US.

On August 22, Anton and James Peraire-Bueno asked a Manhattan court to stop prosecutors from using their Google search activity in an upcoming trial. Why? Read the full story.

The Ethereum Foundation (EF) has pledged to donate up to $500,000 to Tornado Cash’s co-founder, Roman Storm, to support his ongoing legal defense. This follows the recent trial verdict that found Storm guilty of one of three charges.

Ethereum Foundation Supports Tornado Cash’s Co-Founder

On Thursday, the Free Pertsev and Storm fundraiser revealed that the Ethereum Foundation will match donations up to $500,000 to support the Tornado Cash co-founder’s legal defense following this week’s verdict.

In an X post, the fundraiser’s team explained that they “will need these funds and more to continue the fight for Roman at the trial court and on appeal. The outcome of these proceedings will set major precedent for developers worldwide.”

As reported by Bitcoinist, the US Department of the Treasury’s Office of Foreign Assets Control (OFAC) sanctioned Tornado Cash in August 2022 for failing to impose effective controls to prevent malicious actors from laundering funds through the protocol, including $455 million by the North Korea-linked hacking group, Lazarus Group.

Storm was detained and indicted following the Tornado Cash sanctions and charged with conspiracy to commit money laundering, conspiracy to commit sanctions violations, and conspiracy to operate an unlicensed money-transmitting business.

On August 6, the verdict of the long-awaited trial, which started on July 14 after being delayed twice, was announced. Notably, the jury was unable to come to a unanimous decision regarding two of the three charges: conspiracy to commit money laundering and conspiracy to commit sanctions violations.

Nonetheless, the jury found the Tornado Cash co-founder guilty of the remaining charge: conspiracy to operate an unlicensed money transmitting business, which could lead to a 5-year conviction for the crypto mixer’s co-founder.

After the verdict, he told journalist Elenor Terret that the verdict was “a big win. The ‘1960’ charge is bullshit and we’re going to fight it all the way. You know how President Trump said ‘fight, fight, fight’? We’ll do that too.”

As the Free Pertsev and Storm team detailed, “Roman risks up to 5 years of jail time if he doesn’t win the appeal, and potentially decades if the government decides to retry Counts 1 & 3.”

What’s Next For Storm’s Defense?

Unchained host and journalist Laura Shin interviewed former prosecutor Sam Enzer to discuss the mixed verdict and what’s next for the Tornado Cash co-founder. Enzer noted that before getting to appeal, “Roman gets to move for a new trial or a judgment of a quibble.” After that, “there will be a briefing on that. The court, Judge Failla will rule.”

As the former prosecutors explained, if the Judge rules that the conviction was proper on the conspiracy to operate an unlicensed money transmitting business count, they could proceed to sentencing. Additionally, the government could retry Storm on the two counts for which the jury was hung.

So, it is possible that they could be retried, or the judge could say, I think the conviction was inappropriate, and could say that on the counts that the jury hung on, those should have been acquitted.

Enzer asserted that if either of these “extreme” outcomes happens, the case could go on appeal after making its way through the district court, adding that “who appeals will depend on what the outcome is. If the government’s upset with the outcome, it’ll be them appealing. If Roman’s upset with the outcome, he’ll be appealing.”

A former OpenSea product manager has successfully overturned his conviction in what was once hailed as the first insider trading case involving non-fungible tokens.

The ruling by a US federal appeals court on Thursday marks a significant setback for prosecutors hoping to apply traditional financial crime laws to the fast-evolving crypto sector.

The case centered on Nathaniel Chastain, a 35-year-old Massachusetts native who managed homepage curation at OpenSea, the world’s largest NFT marketplace.

In May 2023, Chastain was convicted of wire fraud and money laundering for using insider knowledge to buy NFTs just before they were featured on the platform’s front page, then flipping them for profit.

OpenSea NFT Insider Case Undone by Misguided Jury Guidance

Court filings showed he made roughly $57,000 through 15 such trades, using anonymous wallets to conceal his identity. He later transferred the proceeds into his personal account.

Prosecutors described the scheme as theft of confidential business information, arguing it constituted a misuse of OpenSea’s property.

However, on appeal, the 2nd US Circuit Court of Appeals in Manhattan disagreed. In a 2-1 decision, the court ruled that the jury received flawed instructions, effectively allowing a conviction based solely on unethical behavior rather than actual theft of property with commercial value.

Appeals Court Faults Vague Jury Instructions in OpenSea Case

Judge Steven Menashi, writing for the majority, said the lower court erred by telling jurors that Chastain could be guilty even if the information he used lacked tangible value to OpenSea. He also criticized the instruction that jurors could convict if they found Chastain’s conduct violated broad notions of honesty and fair play.

Menashi warned that using such a standard could make nearly any deceptive act a criminal offense. The appeals court returned the case to US District Judge Jesse Furman for further proceedings. It is not yet clear whether prosecutors intend to retry Chastain.

Court Narrows Definition of ‘Property’ in Wire Fraud Cases

The ruling sharply limited how the government can apply the wire fraud statute to confidential information. The court held that such information must have clear commercial value to the employer—something prosecutors failed to prove in this case.

The featured NFT data, according to the opinion, was not monetized by OpenSea and was not treated as a valuable asset internally. That made it too “ethereal” to qualify as property under the law.

Compounding the problem for the government, the jury was told it could convict based on conduct that was merely unethical. That instruction, the court found, “tainted the verdict beyond repair.”

Judge Jose Cabranes dissented, saying he would have upheld the conviction. The US Attorney’s office in Manhattan has not commented on whether it plans to pursue the case again.

Ruling Undercuts DOJ’s Early Effort to Police NFT Markets

Chastain had already served his three-month prison sentence while his appeal was pending. His legal team welcomed the decision, calling the case a “miscarriage of justice.”

The conviction was announced in June 2022, as the NFT market was booming, estimated at nearly $40b.

Prosecutors had positioned the case as a signal that the digital asset space would not escape scrutiny. Thursday’s ruling, however, may force the government to rethink how it approaches crypto-related offenses.

In a separate matter, OpenSea itself came under regulatory fire last year when the SEC launched an investigation into whether the platform operated as an unregistered securities exchange. That probe closed without action in February, according to co-founder Devin Finzer.

Ethereum-focused firms BitMine and SharpLink Gaming have each surpassed $1 billion in ETH holdings.

BitMine disclosed on July 17 that it now holds 300,657 ETH, valued at approximately $1.04 billion. The firm acquired its holdings at an average price of $3,461.89 per token.

Conversely, SharpLink Gaming has also expanded its Ethereum position, purchasing an additional $68.4 million worth of ETH.

Blockchain analysis platform Arkham Intelligence pointed out that this latest purchase, combined with ETH’s price appreciation, brings SharpLink’s total holdings to an estimated $1.10 billion, not including any staking rewards.

Meanwhile, separate data from the Strategic ETH Reserve places SharpLink’s wallet at 280,600 ETH, worth about $962.8 million at the time of the report.

According to Oblong Research, this wave of institutional purchases reflects a broader realization that Ethereum is not just a speculative asset but a foundational layer for the growing on-chain economy.

With roughly $237 billion in value secured on its network, ETH is increasingly viewed as “digital oil,”  a productive base asset that powers a wide range of decentralized applications.

Urgent appeal to help defend Tornado Cash’s Roman Storm and the right to financial privacy https://earlybirdsinvest.com/urgent-appeal-to-help-defend-tornado-cashs-roman-storm-and-the-right-to-financial-privacy/ https://earlybirdsinvest.com/urgent-appeal-to-help-defend-tornado-cashs-roman-storm-and-the-right-to-financial-privacy/#respond Sun, 13 Jul 2025 21:06:48 +0000 https://earlybirdsinvest.com/urgent-appeal-to-help-defend-tornado-cashs-roman-storm-and-the-right-to-financial-privacy/

Tornado Cash co-founder Roman Storm took to Twitter with an urgent plea for support, ahead of his high-profile trial date tomorrow. Storm, who has been battling legal charges for nearly two years, is calling on the crypto community to help raise $500,000 in the next few days and $1.5 million in the coming weeks to cover escalating legal fees, expert witnesses, and research costs as the case stretches beyond its initial two-week projection.

Who is Roman Storm, and what is Tornado Cash?

Storm, for the uninitiated, is a prominent blockchain developer and co-founder of Tornado Cash, a privacy-focused Ethereum mixing service. Tornado Cash enables users to obfuscate the origin and destination of crypto transactions, providing a layer of privacy on public blockchains.

He has been entangled in legal proceedings since his arrest in August 2023, when U.S. authorities charged him with conspiracy to commit money laundering and sanctions violations related to Tornado Cash. He has spent nearly two years under restrictive conditions, facing mounting legal and financial pressure as his trial date approaches on July 14, 2025.

In a recent urgent appeal, Storm revealed a critical funding shortfall: $500,000 needed within days and $1.5 million required in the coming weeks.

Why this case matters for crypto, privacy, and freedom

Storm’s defense centers on the principle that writing and publishing open-source code is a form of free speech protected under the First Amendment. The outcome of this case could set a precedent for how governments treat software developers and open-source contributors worldwide.

Tornado Cash and similar privacy tools are essential for safeguarding user anonymity in a financial system that is increasingly surveilled. The prosecution of Storm is seen by many as a direct challenge to the right to financial privacy and the legitimacy of privacy-preserving technologies.

The case also raises concerns about government overreach and the potential criminalization of software development. If Storm is convicted, it could have a chilling effect on innovation and deter developers from working on privacy-enhancing technologies.

Community support and how you can help

The crypto community has rallied around Storm, viewing his case as a battle for fundamental freedoms. Vitalik Buterin, co-founder of Ethereum and a leading voice in the blockchain space, publicly donated $170,000 to Storm’s legal defense fund earlier this year, and many other prominent crypto members have also joined the cause.

Storm’s team has set up a donation portal at freeromanstorm.com to collect contributions for his legal defense. Every donation, large or small, supports the broader fight for privacy, free speech, and the right to develop open-source software.

Storm’s trial is more than a personal legal battle. It’s a referendum on the rights of developers, the future of privacy in digital finance, and the limits of government power in the age of open-source technology. The outcome will resonate far beyond the crypto world, affecting anyone who values privacy, innovation, and freedom of expression.

US courts end coin centre tornado cash appeal https://earlybirdsinvest.com/us-courts-end-coin-centre-tornado-cash-appeal/ https://earlybirdsinvest.com/us-courts-end-coin-centre-tornado-cash-appeal/#respond Tue, 08 Jul 2025 02:46:51 +0000 https://earlybirdsinvest.com/us-courts-end-coin-centre-tornado-cash-appeal/

On July 3, 2025, the U.S. Court of Appeals for the 11th Circuit agreed to terminate the appeal made by Crypto Advocacy Group Coin Center to OFAC regarding the Ethereum-based mixing service Tornado Cash.

The court’s decision comes about two months after the US Treasury removed tornado cash from its OFAC sanctions list after it was listed for more than three years.

The firing of the case officially concludes the challenging OFAC decision to include tornado cash on the Coincenter sanctions list.

Coin Center Executive Director Peter Van Valkenburgh commented on X today that the government doesn’t want to continue defending interpretations of sanctions laws that it appears to be too broad.

The appeal, inspired by a memo from U.S. Associate Attorney General Todd Blanche, said the U.S. Department of Justice would no longer target cryptographic technologies like mixers.

Tornado cash developers are still on trial

Despite the fact that the appeal has been dropped and the tornado cash is no longer on the OFAC sanctions list, the technology creators are still facing criminal charges.

Roman Storm, co-founder and developer of Tornado Cash, is scheduled to appear in federal court in the Southern District of New York on Monday, July 14th, 2025.

Storm is currently facing money laundering and sanctions violation claims, but he has confirmed that he has not made any profit from illegal transactions made through the tornado cash service.

In September this year, Storm’s lawyers filed an motion to dismiss the charges, saying Tornado Cash did not meet the definition of a money transfer machine under the Bank Secrets Act (BSA). However, the court denied the motion, saying that the scope of the BSA does not require the technology to control user funds.

Alexey Pertsev, another co-founder of Tornado Cash, was found guilty in the Netherlands in May 2024 and sentenced to five years in prison.

Roman Semenov, co-founder of the third Tornado Cash, has been appointed to the FBI since August 2023 and is hoping for the FBI. The US Department of Justice plans to acquire Smenov on the same charges as Storm.

Tornado Cash support: Ethereum Foundation pledges $1M to Storm’s defense, entities boost Pertsev appeal https://earlybirdsinvest.com/tornado-cash-support-ethereum-foundation-pledges-1m-to-storms-defense-entities-boost-pertsev-appeal/ https://earlybirdsinvest.com/tornado-cash-support-ethereum-foundation-pledges-1m-to-storms-defense-entities-boost-pertsev-appeal/#respond Fri, 13 Jun 2025 22:22:19 +0000 https://earlybirdsinvest.com/tornado-cash-support-ethereum-foundation-pledges-1m-to-storms-defense-entities-boost-pertsev-appeal/

Tornado Cash developers Roman Storm and Alexey Pertsev received renewed support from the crypto community on their respective trials for deploying the open-source code behind the mixer.

The Ethereum Foundation on June 12 donated $500,000 to Tornado Cash developer Roman Storm’s legal defense. It said it will match another $750,000 from public contributors as the US money laundering case approaches trial.

Storm acknowledged the pledge minutes later on X, describing it as critical to “standing up for privacy and the right to code.” The new commitment follows a $1.25 million grant from venture firm Paradigm earlier this year and brings total community-raised backing for Stormto roughly $3 million.

The Tornado Cash developer currently remains on $2 million bail in Washington state. Prosecutors arrested him on August 23, 2023, and charged him with conspiring to launder more than $1 billion in crypto, including funds moved by North Korea’s Lazarus Group.

A federal judge has kept the July 14, 2025, jury date on the calendar.

Advocacy groups file brief for Pertsev

In the Netherlands, Coin Center and the DeFi Education Fund lodged an amicus brief supporting Tornado Cash coder Alexey Pertsev’s appeal of his money laundering conviction. The filing argues that immutable smart contract code is a neutral tool and that holding developers liable would chill open-source innovation.

Pertsev’s case already drew a $1.25 million Ethereum Foundation grant on February 26 that carried the same “privacy is normal, and writing code is not a crime” message seen in Storm’s funding drive.

Dutch agents arrested Pertsev in Amsterdam on August 10, 2022, two days after the US Treasury sanctioned Tornado Cash.

Judges tried him on March 25 and 26, 2024, and sentenced him to 64 months for facilitating the laundering of roughly $1.2 billion on May 14. He left prison under electronic monitoring on February 7, 2025, while his appeal proceeds in s-Hertogenbosch.

OFAC delisted Tornado Cash smart contract addresses on March 21 after an appeals court ruled the immutable code could not be sanctioned as property. The removal eased token restrictions but did not end the parallel criminal cases against the developers.

Spain demands tighter bank oversight, fuels Bitcoin appeal https://earlybirdsinvest.com/spain-demands-tighter-bank-oversight-fuels-bitcoin-appeal/ https://earlybirdsinvest.com/spain-demands-tighter-bank-oversight-fuels-bitcoin-appeal/#respond Sun, 11 May 2025 10:00:46 +0000 https://earlybirdsinvest.com/spain-demands-tighter-bank-oversight-fuels-bitcoin-appeal/

Update (May 10 2025): Following a detailed review of Royal Decree 253/2025, the official BOE text, and multiple independent fact‑checks, we determined that an earlier version of this article inaccurately claimed Spaniards must give 24‑hours’ notice to tax authorities before withdrawing more than €3,000 in cash and could face fines of up to €150,000 for non‑compliance. In reality, the reporting duty falls on banks and fintechs, not on individual savers, and the €150 k penalty applies only to institutions that fail to file the required data. The article has been fully updated to correct these points and provide a comprehensive, sourced explanation of the new rules.

The short version: the decree targets banks and fintechs, not ordinary account‑holders, but it still pushes Spain closer to total financial transparency.

Where the rumor came from

The story began with an April‑28 article in Madrid Informa, echoed by several English‑language blogs and a Fintechnews CH syndication. A thread by CitizenX CEO Alex Recouso snowballed on X, drawing an expletive‑laden reply from podcaster Peter McCormack. None of those posts linked to the Boletín Oficial del Estado (BOE) where the law was actually published.

What Royal Decree 253/2025 actually does

  • Amends Articles 37, 38 and 38 bis of Spain’s General Tax Management Regulations (Real Decreto 1065/2007) and adds a new Article 38 ter. (BOE‑A‑2025‑6599)
  • Requires banks, e‑money institutions and card issuers to file:
    • Monthly reports of cash deposits, withdrawals, loans and account balances over €3,000.
    • Monthly reports of merchant card payments (the old €3,000 annual threshold disappears).
    • Annual reports on all card activity—charges, reloads and ATM cash, unless the card moves less than €25,000 a year.
  • Extends the duty to foreign fintechs serving Spanish residents.
  • Shifts most of the workload from yearly to monthly filings, tightening AEAT’s risk‑analysis window from 12 months to roughly 30 days. (KPMG summary)

Myth‑busting: no 24‑hour notice, no €150k fine for private savers

Fact‑checkers at InfoVeritas debunked the claim that citizens must “pre‑notify” withdrawals. Article 38 merely obliges financial institutions to include any cash movement above €3,000 in their information return. There is no language in Royal Decree 253/2025 compelling an individual to file a form or wait 24 hours before touching their own money.

The headline €150,000 figure is the maximum administrative penalty the AEAT can impose on entities that systematically fail to file or falsify the new reports, roughly 0.5 % of their annual revenue under Spain’s graduated sanctions regime (Law 58/2003, Article 199). Private customers are not in scope.

Who can really be fined and for what

Obligated party Trigger Potential fine
Bank / fintech / card issuer Late, incomplete or false monthly or annual file €150 – €150,000 (Art. 199 LGTT)
Individual customer None under Royal Decree 253/2025 (usual AML/KYC rules still apply) N/A

Why privacy advocates (and Bitcoiners) still care

Even without a pre‑notice mandate, Spain’s reporting overhaul means the tax agency will receive granular, near‑real‑time data on every sizable cash movement and virtually every card transaction. Civil‑liberties groups argue that such mass data collection flips the presumption of innocence, while crypto proponents see it as yet another advertisement for self‑custodied digital money.

“When state authorization is required to access your money, it’s no longer your money.” —Alex Recouso, CitizenX

Recouso’s post misstates the law but captures a sentiment echoed across Bitcoin Twitter: every new reporting layer nudges users toward censorship‑resistant rails.

Part of a broader EU clamp‑down

Spain’s move parallels the EU’s draft Anti‑Money‑Laundering Authority package, which seeks a €10,000 pan‑EU cap on cash payments and mandatory transaction‑monitoring APIs. Italy, France and Portugal already enforce sub‑€3,000 cash limits for commercial payments. The European Commission wants the final rules enacted before the 2026 AMLA launch.

Takeaways for Spanish savers and for crypto markets

  1. You can still walk into your branch and withdraw €3,001 tomorrow. Expect questions and ID checks, but no pre‑filing duty.
  2. Your bank—not you—will tell AEAT about it in its next monthly file.
  3. Penalties target the institution if it hides or delays that data.
  4. The decree turbo‑charges a surveillance trend that makes bearer‑less, peer‑to‑peer assets like Bitcoin look increasingly attractive.

Bottom line: the cash‑ban apocalypse headlines are exaggerated, but Spain’s new rules do shrink the remaining pockets of financial privacy. Crypto’s “be your own bank” narrative just got another tail‑wind, minus the misinformation.

The US dollar could suffer a major sell-off by Asian investors and exporters triggered by trade tensions, according to a pair of macroeconomic and currency strategists.

Eurizon SLJ Capital’s analysts Stephen Jen and Joana Freireat say in a new investment note that Asian investors have accumulated a massive pile of USD that could be ditched en masse if trade wars intensify and the dollar weakens, reports Bloomberg.

According to the analysts, if the US-driven trade conflict grows, a significant number of Asian investors could bring substantial capital back home or seek to bolster their defenses against a declining USD.

That, they warn, could leave the dollar facing a $2.5 trillion “avalanche” of selling.

“We suspect these dollar hoardings by Asian exporters and institutional investors may be extremely large – possibly on the order of $2.5 trillion or so – and pose sharp downside risks to the dollar vis-à-vis these Asian currencies.”

Bloomberg says its dollar gauge has dropped about 8% from a February high. Meanwhile, Asian currencies have strengthened versus the greenback in the past month.

President Trump signed an executive order in April that imposed a 10% tariff on all imported goods entering the US, with the stated aim of increasing domestic manufacturing. The President also issued a proclamation that slapped reciprocal tariffs on dozens of countries.

The Trump administration says it is currently engaging with more than a dozen countries around the world to craft new trade deals.

Meanwhile, US Treasury Secretary Scott Bessent and Trade Representative Jamieson Greer are set to meet with their Chinese counterparts to discuss trade and economic issues in Switzerland this week.
